    Hi, I'm new to this, but thanks to a friend and a conversation we had this weekend over debts, realise I should have come here over a year ago!

    I am a single parent of 2, sadly on benefits, having been laid off 18 months ago. Living in a rented house, and have no vehicle.

    I have 2 defaults, one for a store card defaulted July 05, and one for a credit card defaulted October 05.
    (My ex was meant to pay these off, destroyed the cards, I paid him, he paid bills, he told me he had, he didn't. Both cards were in my name, so lesson learnt!)
    We split up.

    Fast forward to late 2008, I get contacted on my mobile (??) by Lowell informing me that they were currently outside my house, with a van, my window's were open and if I didn't make payment immediately, I'd be coming home to an empty house! I was at work at the time, unable to leave the 28 delegates to come home and get this mess sorted out, and tbh was in a hell of a state! I explained what I knew, which was obviously wrong not that I knew that at the time, and the upshot, after a lot of arguing, was that they agreed to take payments, can't remember how much now.
    Bear in mind, I had recieved NO letters, NO visits, and genuinely knew absolutely nothing about any of this
    You seriously don't want to even know about the conversation content I had with the ex that night! Good job he was a long way away at the time, or I'd have been paying with something of his on a platter! :grumble
    (I have since found out that there is nothing I can do about the arrangement I had with him, particularly because he's confirmed he'll deny there even WAS an agreement)

    Anyway, I digress.
    Fast forward to March 09, I lost my very well paid job and so could no longer maintain the payments at the original rate. Called Lowell the same day, informed them of my new circumstances, and they agreed to take new payments 1@ £2.50 pm the other @ £5pm whilst I sorted out my Income Support, Housing Benefit and Council Tax benefit.
    All payments have been made on time, religiously, as they come out by DD.
    Once I had got used to the drastically reduced income, I was able to free up and extra £5, which I asked to split between the two debts, they advised against this and put the lot to the smaller debt, so the payments now stand at £7.50 and £5 per month

    The smaller debt : will be paid off at the current rate in 2013 Default date Oct 05
    The larger debt : will be paid off at the current rate in 2019 Default date Jul 05

    I would just like to know if anyone has any advice over whether I can do anything about this?

    Please see this and add full details - viewtopic.php?p=6789#p6789 -- email me the agreements etc and we'll sort this for you. First off, they have clearly used illegal tactics to get you to pay - but more later when you provide full details.....

      Do I put on here the details, or send it privately?
      Oh, and I don't recall there being a written agreement as it was all set up over the phone (from memory - which isn't the best these days) although they did send me a 'statement' recently, although only one of the accounts was included, not both

        Just post it here - read that link I sent and you'll see what I mean..... I'll tidy the thread up later
          • 1. Type of account (credit card/loan)
            2. Date commenced (ideally before Apr 2007)
            3. Approx balance
            4. Date last paid (approximate date you last made a FULL payment)
            5. Are you on arrangement or not paying
            6. Status (default/in arrears/up-to-date)
            7. Account owner (who is writing to you, a DCA or the lender)


        ps nothing personal is asked for - obviously any agreements are to be emailed, do not post anything personal on here - but I don't ask for it. However the agreement should be emailed to me as-is, please don't blank it all out cos it makes it harder to establish if it is UE or not (if applicable)

          Type of account (credit card/loan) Credit and Store card can't remember which one is which as they're both showing Lowell as the Company name on Experian
          • Date commenced (ideally before Apr 2007) mar 2005 nov 2000
          • Approx balance (Default balance shown on Experian report) £420 £1031
          Do you want the current balance too?
          • Date last paid (approximate date you last made a FULL payment) Don’t have this information anymore thanks to the Ex
          • Are you on arrangement or not paying In an Arrangement with Lowells
          • Status (default/in arrears/up-to-date) Experian showing [8] default on both, but according to my records (home made spreadsheet) I am up to date with payments agreed with Lowell. (although our current balances differ it seems)
          • Account owner (who is writing to you, a DCA or the lender) Dealing with Lowells, have only received a statement once a year no other letters as yet

          As stated earlier - I'm not even sure if there is a written agreement in place, as I'm 99% positive this was set up over the phone, if there is one, I don't have a copy of it, but am going to have a look tonight

              It's one thing reading everyone else's (successful) journeys, quite another embarking on one yourself!
              I am aware from other posters that panicking gets no one anywhere, so will try not to, promise!, but I'll be honest with you...I be pooping my pants lol

              I shall send the letter's first thing, recorded delivery (I have been taking notice honest! )

              Questions at this stage:
              Am I jumping the gun by assuming I'm going down the unenforceability route? Or am i just checking out where I stand?
              I currently have them set up by DD - Upon reciept of the CCA request, what are the chances of them upping the amount from it's current amount?

                no pooping Always, we absolutely don't allow that!
                You will be fine. and no they can ask for whatever they like but they only get what you decide to give them. Niddy is just looking at your options, if these debts are pre 2007, they could be unenforceable, so no point in paying them, I think they have had enough from you?
                Don't worry, you are in very good hands, have another read at some of the diaries, read mine if you like, and see what can be achieved by his Niddiness!

                  They are definately pre 2007, as the default dates are 2005. I guess my concern is that as I've been paying something since 2008, I'm still going to have to pay them. It's paying the debt twice to my mind, and I know the anger is at the ex really, but financially it's been sooo hard since I lost my job, and as I'm in a very specialist industry, even harder to find a new one. I'm overqualified for practically everything I've gone for - including dinner lady at my son's school apparently lol! (Think they're worried I'll get bored and leave them in the lurch - chance would be a fine thing lol)

                  They were taking one by debit card, but got it transferred to DD when the card expiry date ran out - Glad about that now mind.

                  I shall pop over to look at your diary and hopefully feel less daunted by reading your experiances

                      You are in control. At this stage get a cca and continue as normal....

                      As for direct debit, you control that too. They can try and get more but you're covered under dd guarantee so don't worry. At this stage you're fact-finding......

                        Thank you both, I am absolutely terrified about what may happen, given that the default is due to expire next year anyway.
                        I gather from the friend who pointed me in this direction, that Lowell would have paid in the region of 10p per £100 owed, which means they have well and truly made their money and then some off me!
                        They are the only 2 'black' marks on my credit file, as I'm one of those people that hates debt, having got into a financial mess in my late teens, and have been paranoid about going there again. ALL of which was paid off thanks to overtime in about 6 months. I ate peanut butter and marmite on toast - yes at the same time lol, and baked spuds - with butter hijacked from the canteen at work lol. Not even a tin of beans passed my lips in that time lol. (I can laugh about it now but at the time......I cried myself to sleep every single night)
                        Which is another reason why I'm so angry with my ex that his actions allowed this to happen knowing full well how I felt about bills not being paid on time grrrrr! The original dd's were in the joint account, and rather than move them to my own account, it was just easier to leave them where they were (thus, ironically, avoiding any missed payments) and give him the money when I got took off the account. Isn't hindsight wonderful lol

                        If it's possible for you/someone to answer:
                        Should it be a case that the debt is UE - ooo look at me using the right abbrv's lol - would the recommendation be, after following Niddys procedures with sending all relevant letters etc, to cease payments, and if so, would that not then register or trigger a newer default date?
                        Obviously if 'on paper' things are 'in order' I'm doomed until 2019, and I accept that fate too lol

                        Don't worry Niddy, I'm not panicking, just curious as to the possibilities. I like to know the positives AND the negative side of things
                        I do feel like I'm paying this a second time - granted that's not Lowells fault, but stings all the same.

                          One debt = one default. Your default will drop off after 6yrs whether debt paid or not.
