    Red is just another silly trading name for Lowells, so doesn't make a jot of difference.

      Its this sort of BS that Lowell should be pulled up on. They shouldn't even be referring to BR if the debt is under £750, its just another way of trying to intimidate people who don't read the weasel words.

      So Lowell Portfolio have passed your alleged debt to Lowell Financial who are now going to pass the account on to Red/Lowell (dept nearest the toilet). Lucky you!

          Did you know Red specialise in assessing accounts for litigation and will be obtaining a copy of my credit file to review my financial circumstances....

            I would send an account sold in dispute, just to keep it nice and tidy. we know it's the same guys, but I would be playing them at their own game and send off the letter.

              Thanks, was going to ignore, but yes, I agree, time for letter ping pong I think as they seem to have 'forgotten' what the issue still is - received an application form when I made my CCA request

                Well, blow me down with a freaking feather!!

                I've had this going round the DCA's - Fredrickson, Red, Lowells, back to Fredricksons, Red, etc since 2012
                I've fired off sold whilst in dispute letters each time...

                Today, I have received COURT PAPERS
                Claimant Lowell Portfolio, using Bryan Carter Solicitors

                Guidance needed on what to put and where please

                Brief history
                Defaulted 2005
                DCA used threats and got me to set up card payments over the phone which later got changed to DD payments in 2008
                2009, I lost my job so had payments reduced
                Late 2010/Early 2011 sent CCA request - Niddy confirmed an application form, responded with CCA query Ceased payments 2010
                Early 2011 received statements, responded with NO CCA RECEIVED
                Late 2011 was 'passed' to RED, and on the merry go round we went
                Until today!

                    To be honest Elsa, if they've sent anything since November, I honestly wouldn't know or care.... My mother was told she had terminal cancer at the end of November so have sacrificed any sort of 'normal life' since then.
                    She passed away mid January, I'm currently trying to sort her 'estate' out at the minute, and my (ex) MIL passed away unexpectedly last week too so have got my own children devastated at the loss of both their grandparents in the space of 3 weeks to deal with too.
                    All my bills are paid by DD/STO so haven't worried about any of my post.

                        Thanks PlanB, really don't know my head from my backside right now, without this bunch of ass wipes joining in for good measure grrrr.

                        I've had a quick read of the link, but really need to go back to it when my head's clearer (ie later on after multiple coffee's lol)

                        Currently arguing the case of the banks removal of funds from Mum's bank account to repay the bank's own credit card, when there are other debts that need to be taken into account too!

                              Particulars:
                              Amount of £215.15, assigned in March 08 - over the phone
                              Notice of which has been given - Don't ever recall there being anything in writing... Payment was arranged on a monthly card payment, which expired so I set up a STO or DD (can't recall which)
                              failed to maintain contractual repayment - ceased payments due to no CCA supplied
                              Default notice served and not been complied with - ? Received and responded to merry go round of letters from various 'claimants' Hamptons, Fredricksons, Red etc, don't recall seeing a default notice though but if sent since November they could have done

                              Amount claimed 232.38, plus court fee of 25.00, solicitor of 50.00 so total amount 307.38

                                Hmmm, one is surprised that Lowell are prepared to go to court for such a paltry amount!?
                                And if they are in breach of your CCA request they will not be able to proceed!

                                Suggest that you request 'Full Disclosure' of all documents that their claim relies upon.
