    Hi

    I have a question regarding a CCA request on old Halifax credit card.

    I was originally being chased by Westcot however after sending them x2 CCA requests they did a sly one and sold the debt onto iQoR.

    After a few letters from iQoR I recently sent them a CCA but it appears they have passed it back to Halifax as they (Halifax) have just sent me a letter asking for my 16 didgit card number.

    The letter says:

    [size=5]Dear Mr So&So

    Account Reference: XXXXXXXXXX

    Thank you for you letter which I have attached for your reference.

    You have not quoted a valid account number.

    In order for us to consider your request, please supply us with a valid 16 digit credit card number for your account.

    So my question is, if I am disputing the fact I owe money... do I send Halifax this number? Surely they should have it already? What if I no longer have the card? I haven't checked so this could be a possibility.

    They do quote a 10 digit reference number on their letter, which is the same reference number used since this whole debacle started.

    Yep send the number... Always quite the a/c number when you write in.

      Thanks for the reply.

      I thought the reference they have been quoting me would be all they need but I will reply with the 16 digit credit card number if I can find it.

      What would you suggest if I can't find it though? Chance are I chopped the card up a long time ago.

      As I said, the 10 digit number on the letter is the reference number they have used ever since they started chasing me, before any DCAs were even involved.

        sorry - I misunderstood and thought you'd left it blank. If you've used their reference that they have supplied you, then that is suffice to comply as that reference will link to their file on you, from the lender which will then show them the card number.

        It's not for you to do that, they are chasing you so they must already have those details, if not i'd be questioning what, exactly they are chasing (as they mustn't know).....

          Hi,

          Thanks again for the reply. I should have maybe been more clear in my 1st post.

          Basically, ever since Halifax started chasing me they have been using a 10 digit reference number.

          I wont go into the details of my circumstances but due to other things being more important at the time I ignored them for ages until they eventually sold the debt onto Westcot, who used the same 10 digit reference number in all their letters.

          I sent Westcot a 12 day CCA request, which they ignored, so then a 30 day one and eventually they replied saying [size=5]"here's your postal order back, you need to contact Halifax about this".

          I was busy with other things and forgot about the matter until recently when I received a letter from iQoR, who must have bought the debt from Westcot. Again, iQoR are used the same 10 digit reference number.

          I then sent them a 12 day CCA request to which they replied with what I quoted in the 1st post.

          What would you suggest I do now? Do I reply to either Halifax or iQoR to say the I only have the 10 digit refence number which they have provided me with? I'm not that great at writing formal letters which is why the templates from here and other debt help sites have been so useful! I just can't find one that covers this situation.

          Unlrelated to this matter, I did have sucess with another card though. I was being chased by Lowell Group for a MBNA credit card and after sending them 12 day and 30 day CCA letters they replied to say MBNA couldn't find the original documents and that the case was closed and I owe them no money.

          I'm hoping the same happens now with Halifax / iQoR.

            Send the request again, and leave it at that - it remains UE until they do respond.

                Send to whoever owns the debt, however in this case i'd be prone to send to the original creditor.....

                  Niddy, I need you help again I'm afraid!

                  Got home from work last night to find a business card on my door mat with a number to call.

                  Turned out to be a local debt collector from Moorcroft (I suspect he's independant but they pay him to chase people). He'd actually been to visit me at home!

                  I told him the account was under dispute as neither Moorcroft or Halifax had responded to my CCA request.

                  He kept telling me that it didn't matter what I said or what letters I have sent because unless I agree to a repayment plan with him, then Halifax were going to take me to court.

                  I told him the debt was uneforceable due to no response to multiple CCA requests but he was adamant that it didn't matter, he kept saying "they'll take you to court, and 99% of the time they'll win".

                  I didn't admit to any debt and said that Halifax / Moorcroft need to read my last letter, to which he replied (1st with another threat of court) that he would pass the case back to head office.

                  Now I know these people use scare tactics but I was up all night worrying about this. Can they just ignore the CCA requests and take me to court?

                  What would you suggest I do now? Should I send both Halifax and Moorcroft another CCA request?

                    Hiya,

                    I am sure that Niddy will tell you the first thing you do is do NOT ring the Debt collectors. If you happen to be home when they call just tell them the account is formally in dispute and you will only discuss it in writing. Be firm and don't be scared, basically tell them to bugger off.!! Shut the door on them.

                    I had threats to send someone around and sent off this letter......> viewtopic.php?p=182#p182 and it did the trick.

                      Lets see if he says the same to me... whilst I record it, for the record, then i'll get his collection activity licence revoked as quick as that! Freaking muppets wind me up with their bully-boy lies....

                              Hiya, ok this is weird to say the least - they have sent an enforceable agreement - more on this in a minute! However, what confuses me is why they have sent 3 sets of terms, especially with the added mistake of the £12 default charges on the "original" agreement when at that time, their default charges were £25 not £12.

                              Then, if you look at the agreement, especially using the pdf you sent, and highlight one of the boxes on the LEFT and copy the content of the box and the start of the text below it - you'll see it all aligns perfectly, screen dump below:

                              Now, if you look at the same, on the RIGHT hand side, it is clearly not the same and shows that it is a recon that they have sent you - however the fact they added the default sums at £12 (as on the other 2 sets of terms they sent) helps to confirm this is in fact, unenforceable....
