    I have had a response to my CCA request from PRA group on the Halifax c/c debt, they have sent through statements from 2001 to 2006 and a copy agreement from 2006 or 2007, my signature appears nowhere in anything they have sent and the copy agreement is not dated.     How useful is it to offer a voluntary charge on your property while trying to make an offer pre court, especially when in actual fact it will only be a Restriction (single debt, joint owners)?

  • creditor not signed agreement can he charge interest and fees?

    If an agreement is not signed by the creditor, so an unexecuted agreement. My question is; does the creditor have the legal right to charge late fees interest etc.

    My own opinion is no! I appreciate he may be able to sign in the court room, if so that would not entitle him to backdate...
