    Niddy,good evening.I have been paying a token payment to the above.I defaulted back in mid 2002.However I have never received a D/N but nevertheless they passed the account over, in the first instance to RMA and then in March 2005 to Brachers Solicitors.They sent me a fair amount of blurb about'you signed an application form and became bound by their t/cs'.They said they were attached,but did no they were not.Also I noticed that the card number they were using was different to the actual number.(Same amount o/s)
    I have looked at my Credit file and noticed that A/E have got me down as default notice issued February 2010.Thats bullshite ,I have never received anything relating to D/Ns at anytime.
    Brachers letters to me don't even mention it.My gut feel is that they could see my status getting close to coming of the file(5 yrs) and they put this fictious D/N in to keep it 'live'.
    However Brachers write to me every 3 months for an I & E and a proposal to increase my payment.I always send the I & E plus a 'no way am I increasing my token payment' reply.
    They write back with'our client is prepared to accept your offer with a review in 3 months'
    I have just received for the first time since 2002 a statement from AE showing my os balance.Whats this about?
    As this is a charge card am I stuffed under the CCA route etc.
    Please let me have your guidance here as I am getting pissed off with having to send the same info back.I would like to stop this and am a bit concerned as to what would/might happen.

      When did you last make a payment ?

          send them a CCA request...........

              Are charge cards subject to CCA?
              I got a gut feeling they are not.

                    Nope ,unfortunately this is not a store card .
                    However this account has NEVER been terminated via the DN route, where can I read about the brandon case please.

                      If I have no defence re Charge Cards then should I just keep up the small token payment rather than challenge them.Cos if I do challenge them it could possibly rouse the interest,so far not charged, to come into play.They would accept a F&F at about 50%,but thats too much for me.

                            I have not had a reply as yet from Paul ,but I'm sure that will follow later.However in the meantime how can AE show on my Credit ref file that they defaulted me in 2010 and yet I stopped paying them the full amount in 2002.Only paying a monthly token payment each month since then.Never missed a month either.Even if I'm not covered under CCA surely this cannot be right?

                              Send for the agreement and lets take a peek, before doing anything or worrying about anything!

                              Charge cards are definitely not CCA protected, however if they allow a cash advance or other credit card based features then it may be part regulated..... get the CCA first, if they reject the s.78 request then SAR them.

                              The devil is in the detail so we need the agreement before we suggest anything, sadly.
