    You can use this that cames from another template...

    You have happily been communicating with me for some years at this address and we both know that you know I am the person in question and that you're playing silly-buggers. You realise that no matter what your stance, now you've refused me access to "my data", ie my SAR, I will now use this against you as I now want to know what checks you put in place when you started hassling me to repay, what checks you put in place before sending statements and what steps you took to ensure you sent the actual account card to the right person? Did I have to sign each time you sent any of this information? I do not think so and so I therefore put to you that you've broken DPA several hundred times over the years - so come on, what is it to be then?

    I am sick of these games now and therefore you leave me no option but to take matters further. I have now formally complained about your behaviour to the ICO and FOS as you're abusing your position somewhat and this type of behaviour will not be tolerated any longer.

      Thanks but isnt there a template that says something on the lines 'its me!' as this lot are using the 'dont know who you are routine'.They answered within the timescale so I cant accuse them of running over.

        Is I said send the text I mentioned before, and an utility bill, and you could take a photocopy of your passport but hide your signature?? unless there is a better option of course

          I used bits of your suggested text ,thank you,plus I decided not to send any other info as the know its me.They are still within the timeframe so this I pointed out.Gives them time to respond properly.
          Bet I get another phone call.Recorded but not answered.

            Why not email the boss with your complaint and asking what the feck his minions are playing at - raymond.joabar@aexp.com

            He's had a few off me during a long running battle I am having with them.

            Whilst he doesnt answer them personally it generally stirs someone into action.....also you dont have to sign emails do you......

            Worth ago - just another tack to think about.

            PS - Amex really are feckers - they will lie and cheat,use every trick in the book to delay progressing / sorting whatever the issue is and all along will continue to harass you via in house and external agencies - stick with it and dont let em grind you down.You WILL come through the other end.
            Complain,complain and then complain some more -FOS, OFT ,ICO, et al.

              All points taken on board MattyA.
              Funny how they know its you when they are chasing for blood money and then a sudden lapse of recall when you have a go at them.
              I shan't give up MattyA,absolutely no bloody way.

                  Hi Niddy
                  Have received my SAR pack from Amex.
                  They have sent me an application form signed and a Cardmembers Agreement obviously not mine ,as the Cardmember signature has been inked out!
                  They have then included an example of an application for a Platignum Card.The only T&C's supplied are for Amex Green Card(Cleared and finished)
                  Then they supply a copy of Pre-Approved Application which has my sig on it.
                  However there is no signed agreement(apart from the inked out name)
                  I dont obviously want to waste your valuable time Niddy so I have not sent copies to you until you give me your OK or not as the case may be.

                      Thanks Niddy I will get this off asap.
                      Looking into the docs they sent me ,they are making reference to CCA 1974 and credit limits.So if this is a charge card then where are they coming from? This info is shown on the Pre Application form.(With my sig)

                          One more thing here Niddy
                          As this in their books etc is a Charge Card,although the indications from the SAR pack goes toward CCA regs,is it OK to make the CCA1974 Act reference in the letter ?
                          Actualy there is a lot of reference to CCA and perhaps I need something that at this moment treats it as a Charge Card but referring to missing PTs.

                            yea just send it as is.... it's fine.

                            However only if you have not responded to the recent CCA - if you have then just ignore them until they write again then send it....
