  • Natwest defaulted account without me knowing PLEASE HELP

    Hi all,

    I recently had my credit report from experian and was shocked to find natwest had defaulted my current account back in feb even though i was paying them regularly. I received no warning from them no default letters etc. If i knew i would have paid them as soon as.

    I have been in contact with the complaints department at natwest and whoever i get through to doesnt seem to help. All of them can't seem to explain anything some I get put through say yes we can remove the default and others just say a specialist case handler will be in touch.

    A couple of days ago I received a call from natalie from the customer care team, she said she would be dealing with the case because i had made an urgent complaint and wanted some information. she then said she would send me everything she has on the case and all my data back in the post and that i should read it and then call her back directly so we can resolve it.
    Now after receiving her letter she hasn't sent me any data on my account or the default notices or letters just a letter about our conversation of our phone call she made notes on and hasn't offered anything instead says she can't offer a resolution i should contact triton to arrange payment.

    I know after reading this forum there are some extremely helpful people on here.

    What i would like to know is do i send them an F&F settlement or a SAR or a Original agreement request.

    I'm a little confused on what to do as I need the default removed as it was totally unreasonable and unfair. My credit report except for this is perfect no late payments or problems with others.

    PLEASE could someone help this default has basically stopped me from getting a mortgage or any lending facility from the bank. I am happy to pay them.

    The current account details are

    Type of account (Natwest Current account overdraft)

    Date commenced (2010)

    Approx balance (2500)

    Date last paid (september 2012)

    Are you on arrangement (yes)

    Status (default)

    Account owner (who is writing to you, Natwest bank)

    Any help will be greatly appreciated

    I'm not all that well up on defaults (mine are all because I haven't paid) but I didn't want to read and run.

    Someone will probably be along later who ill be able to provide more assistance.

    If all else fails you could try getting in touch with the MD of Products and Marketing at Natwest - les.matheson.@rbs.com especially as you're willing to pay, haven't had any default notices and customer services have been anything but customer services.

    I was just wondering if you've moved since you opened the account and NatWest have been sending letters to the wrong address?

      Someone else will be along to help.

      But if you were on an arrangement to pay, and its below the minimum payment (which im guessing it is, as triton are dealing with your payments) then registering a default, is correct.

      Its a true reflection on how the account activity has been going on.

      If you pay below the min amount required then they will default you.

      That being said, you should have received a default notice with information regarding what you can do to rectify the arrears before a default is placed on your credit file. If that didnt happen then there is an issue.

      One of which someone else may be able to help with.

        Just to clarify no. No DN under s.87/s.88 is necessary to register anything within cra's. a lender can default you within 30-90 days since first late or not as per terms payment.

        The s.87/88 notice needs to be sent if they formally demand full repayment. An agreement to pay does not mean they won't add a default, sadly, as you've found out.

        Unlikely they'll do anything I'm afraid plus they're within their rights to apply it if you were more than one payment late as at the original due date.

          Hi I haven't moved been at the same address for a while, even i'm not sure where the notices or warnings have gone. Thats if they have sent them

            I was in an arrangement to pay but always paid and was never below minimum and often more than the minmum payment was made.

              I actually didnt make a late payment or miss one so not sure how they managed to work out that a default should have been placed. A notice was never sent for full repayment neither did i recieve a default so it came as a complete shock to me

              Is there anything that i can do here ?? will any of the templates you have be of any benefit or give me a chance to get anywhere

                Hi

                Ok this is an overdraft so they can demand repayment anytime, usually they'll give you 30 days to clear it. If you don't they'll usually allow you to pay £x per month till its clear. That said, because it is an arrangement then then can add a default if for any reason they removed the facility from you.

                If this was a credit card you'd need to miss the agreed 3% monthly repayment for at least 3 months before they'd consider a default. However after 6 you'll get one.

                With overdrafts they can recall it at any time and no notice needs to be given.

                Sadly your rights are limited as it is an overdraft which by defection is a short term facility and not an extended credit facility so should never be used as one. The fuckers seem to remove it when we rely on it. Yep that's cos we're all skint but it don't mean we are a huge risk overnight. *sighs*

                I don't agree with it but I do spell out the rules.

                The only way you have recourse for removal/argument is if you used the account as your main account and the overdraft was part of it in so much as you can prove nothing changed from month to month - plus of course proof they did not remove the facility.

                Questions...

                1. Is this your main account?
                2. If no, was it and you have since changed banks?
                3. Are your wages etc being paid into the account?
                4. Do you have a £2500 limit now or does it show £0 (on statements)
                5. Why are try-it-on involved? I guess they've sold the debt?

                  Yep I know but they don't take over live accounts hence my query is kinda suggesting they were in arrears in some capacity

                    The account wasn't my main account and no wages etc had been paid into it. i just had the facility and used it in an emergency. About 8 months before they defaulted, monthly payments were arranged and it was agreed once i was able to pay it all off i just needed to let them know. I havent recieved statements from them for a while.

                    I havent got a clue why triton are involved i dont even know who they are. I only found out about them when i recieved a letter from customer care about a resolution and being told i need to now contact them because no resolution can be met.

                    I think i understand now what you have said about the overdraft being recalled at any time being legal and something they can do. If this is correct than that is very sad and unreasonable.

                    I think i might have to accept that maybe there is nothing i can do with regards to removing the default.

                    But as a last resort is there maybe a letter of sympathy or some sort i could send that you know of that may give me a chance?

                    Maybe a letter to the ceo or someone high up on grounds that the default was unreasonable or something like that ?

                    I'm just thinking you never know they may have a heart and not all be a complete bunch of b******s!

                            If you can settle the balance Niddy may be able to sort it for you.

                            Triton are their in-house debt management team, its likely they passed it over to them the moment you defaulted or agreed a reduced payment.

                            Its usually how they do it.
