At last I can start my diary!! (Here is a link to my first post with the background surrounding my debt situation - http://forums.all-about-debt.co.uk/s...ead.php?t=8705 )

    LLOYDS TSB

    Loan
    Started 11/06/2008
    Approx balance £19373.41
Unsure of date of last full payment
Currently on a DMP with CCCS
    Defaulted 25/08/2009
Debt is still with Lloyds TSB

01/02/2013 - CCA sent today (although loan taken out after 2007 so no doubt will be enforceable)

01/03/2013 - Nothing received yet so CCA reminder sent today
28/03/2013 - Reply received from Blackhorse in response to the reminder I sent on 1st March. They advise that they are unable to locate a credit agreement with the info that I have provided

They say by providing these documents they have satisfied their obligation under section 78 and they are not required to provide a copy of the original signed agreement, but that they are still endeavouring to locate the copy of my signed agreement etc etc. Will try and scan it in the next day or 2 to send to Niddy.

13/03/2013 - Niddy has advised and that I should send back missing PT's template!

            Thank you Spud!!

Yes finding this site has been so helpful, even just from the point of view that you realise you are not alone, and that there are a lot of people going through similar experiences. Been on other sites, that although helpful, often make you feel like a criminal for getting into debt. Truth is my husband and I had spotless credit files since we were both 18 ( we are now early 40's!!) but that counts for nothing when the going gets rough does it?

Will keep you all posted with any replies I get!

              Re: Stressedoutmum's UE diary

Sadly - Thats all too true.

You may have been a really good, Loyal and profitable customer for 20 odd years - Lose your job or some other event that puts you on your bum for a few months ect and the banks treat you like something you wipe off your shoes!

It is then that you realise that you are just a number and an inconvenience to them now that you are not a nice little payer.

Many on this site have experienced this - Me included - Which explains why all the people you will meet on this site are decent hardworking intelligent likeminded people who quite rightly want to fight back to being treated appaulingly by the banks.

Once they start to play by dirty rules - Can you blame consumers to be doing the same?

Im so glad you've found the site - I honestly dont think you would find better, Well rounded advice even if you were to pay for it

              Fingers crossed

                Absolutely Spud!!!!

And a major contributing factor to the demise of my husband's business was the total lack of support from the bank that he'd been with for over 15 years!! At the time there was all this talk of the government making sure that banks helped small businesses as much as possible, and we saw none of that! So you are right, it's time to fight back!!

                  Re: Stressedoutmum's UE diary

                  Hi there!

So I am a bit confused this evening.

I came home from work to find a letter from HSPF in Chester ( who are they?) thanking me for my recent statutory request for info on my loan. So at this point I am thinking this is my LLoyds TSB loan agreement. However, enclosed are 2 loan agreements, one from July 2000 and another from October 1998. Both are for loans we took out via my catalogue company. They have 'Preference Account' at the top and both agreements are with Capital Bank (can't even remember what the loans were for!)

Is it possible that these have been sent to me as they come under the Lloyds TSB umbrella now?

They have highlighted the PPI that was included in both of them, so looks like they are assuming I am requesting the agreements to dispute PPI.

I am wondering two things now. What about the Lloyds TSB loan from 2007 and the credit card, where are those agreements?? And should I be querying the PPI on both these loans? One amount is just over £3000 and the other is just under £1000. Both amounts look to have been added onto the amount of the loans we asked for.

Any thoughts would be greatly appreciated!

                        Hi,

                        HSPF Home Shopping Personal Finance.

I assume that these loans are fully cleared? If so, it could be worth looking at the PPI.

I will get someone to look in

Yep, and the lender would have been Halifax (preference account)...

Excellent, as both are paid off you'll get any refund due

Hmmm, they may try and offset so first, do a reclaim and get some cash then afterwards if you wanted you could use that cash to repay the other debts in F&F settlements.... or not! Up to you.

Well yes sure you'll be doing a reclaim on the loan accounts but whatever you do, do not mention the other accounts till afterwards or they may try and offset....

Di30 is your best bet regards the reclaims.... after you sort this then we can help with the card and other loan. Unless all accounts are paid off, are they? If so then do a reclaim across all accounts.
