    Most of you will know my story from my DMP thread, but here is a quick re-cap.

    I am going through a long/messy/expensive divorce. I had mounting debts and was basically living on my O/D or what little left I had on credit cards to make my monthly payments. I took a deep breath and sought advice from CAB/CCCS and both advised Bankruptcy. However I wasn’t ready to take that step so spoke to National Debtline and with their help worked out my own DMP. This had been going very with some reviews every now and then, but now the year is up, the fun and games are beginning even though I have made every payment on time apparently it is not good enough. Egg is the first to not accept that my situation has not changed in anyway shape or form and want me to go about sending them a new I & E form, tell them what I owe other creditors etc... even though I have told them nothing has changed since the last lot of info I sent them and I could only continue to pay the £88 per month that I was paying them. This was not good enough.......

    Soooooooo with a bit of advice from Niddy, some chats and a read of others UE diary’s I have decided to take the step and go down the UE route. Obviously I need to open a new bank account before I can start anything with the Co-op, but will be doing that over the next week or so.

    Egg – Credit Card

    1) Credit Card
    2) Start Date 22/07/2003.
    3) Approx Balance - £7,612
    4) Last full payment – September 2009.
    5) &nbspas on arrangement plan - £88 – last payment 25th November, 2010.
    6) No default issued as of yet, on credit report shows as on AP
    7) At the moment still with Egg. After a year on AP Egg refused to extend the AP any more, I explained that my situation had not changed in anyway.

    18th December - CCA request sent with £1 cheque
    21st December – letter received by Egg and signed for.
    Various phone calls and a letter chasing for payment throughout December from Egg
    30th December - Egg cashed £1 cheque
    31st December - Received CCA from Egg Niddy says
    5th January CCA query letter sent
    Couple of phone calls in Jan - not answered - emails on my on line account telling me they MUST speak to me.
    18th January SAR request sent with £10 cheque
    18th January - phone call
    18th January - letter received - scanned in and sent to Niddy
    26th January - letter received - asking for times/dates and nature of calls to enable to help them find the details they need.
    27th January - Letter sent as per Niddy's instruction
    4th February - letter received asking for £1 fee for CCA....
    12th February - SAR received
    17th March - letter received from (wait for it) CCA on behalf of Egg saying if they don't contact them they WILL send a representative to my address
    14th March - Telephone Harrassment letter sent
    17th March - Door step vist letter sent to CCA
    24th March - two letters recevied one from EGG dasted 21st March saying think you for your complaint. the other from Egg masquarading as CCA dated 18th March saying they are doing checks on my re property ownership validation of empolyment details blah.. and i should contact them immediately othterwise they MAY pass on to their solicitors
    31st March - letter received saying they have looked into my complaint and as they are trying to help me they need to telephone me so they will keep on ringing even though I have asked them to stop and they have enclosed a I and E form (printed from the natinal debt line) and I should fill it in and get it back to them by 7th April - o and they will hold off calling me until 7th April
    11th June - DEFAULT NOTICE issued by egg dated 7th June
    12th July - letter dated 6th July from Egg saying my egg card agreement has been terminated
    4th August - letter from MOORCROFT sending a notice of intended litigation
    10th August - Harrasment Letter sent
    18th August - letter dated 9th August from Moorcroft - in nice yellow envelope and typed in that very business type font of comic sans!!! anyway says I need to contact them before 16th to stop the possible litigation action.
    1st Sept - Letter dated 16th August from Moorcroft - compliance department ........
    September - letter from Moorcroft saying as they have not heard from me - if they do not hear back from me in 28 days they will close my account and pass it back to their client

      HBOS Credit Card

      1) Credit card
      2) Start Date 26/10/2006
      3) Approx Balance - £10,673
      4) Last full payment – July 2009
      5) On Arrangement Plan - £108 – paid up date last payment on 22nd December, 2010.
      6) Default issued on 29/9/2010
      7) At the moment Account is in hands of Blair Oliver Scott. Interest has been frozen.

      4th January - CCA request sent with £1 cheque to BOS
      18th January - SAR request sent to Halifax to cover all my accounts with them and £10 cheque
      27th January - Letter received from HBOS asking me to call to discuss my excact requirements for SAR request
      28th January - Letter received from Halifax saying they have enclosed a reconstituted version of the executed agreement and that they have requested a copy of my original singed agreement which will be with me shortly.
      1st February - called regarding letter about SAR - confirming I wanted all info they held on me for all three accounts
      8th February - Letter received from Halifax with my signed agreement
      11th February - Niddy says Letter sent CCA missing prescribed terms
      14th/15th/16th February - SAR received along with two letters
      24th February - Letter from Halifax with signed agreement (same as the one sent with the SAR) and Letter from Blair Oliver Scott saying I am in arreas with my payment plan and can I pay £108 to make it up to date.
      27th April - letter from Blair Olivier Scott saying my immediate Action is Required
      5th May - Telephone harrasment and doorstep letter visit sent to BOS
      5th May - Notice of Court Proceedings from Blair Oliver Scott
      6th May - Sent Threat by DCA to commence litigation proceedings
      19th May - letter back from HBOS saying sorry for the upset and inconvenince they are causing me - but the debt is still owed and BOS will still continue to recover the debt and it may be sold on to an external debt recovery specialist
      21st May - letter from HBOS saying they will continue to write to me and telephone me where necessary and although I have said the account is in dispute i have given them no valid reason for this and have no reason to withhold paymennt to the account. They will also not enter into any further correspondence regarding this matter.
      15th July - letter received dated 8th July from HBOS with Notice of Legal Action and my account has been passed to their litigation department......
      26th July - threat by credit to commence litigation proceedings sent
      18th July - letter received dated 12th august - basically saying thanks for contacting them and would i accept their apologies for any inconvience and upset that they have caused me - but bascially they feel they can contact me as they do not agree that the account is in dispute and they have explained why they feel the debt is enforceable. They also state I received their final reply on 11th May and if i want to complain to the FOS i must do it within 6 months of the date of that later. and finally they have said they will not enter into any further communication regarding this matter and futher correspondence i send them will be added to their files for reference only
      September - letter received from Halifax saying thatas they have written to me saying that my account is enforcable can i contact them immediately to let them know my proposals for payment
      10th November - letter received dated 4th November - NOTICE OF LEGAL ACTION they have passed my account to thier Litigation Department to commence court action for payment!!!
      11th November - threat by credit to commence litigation proceedings sent
      18th November - letter received dated 14th November - just saying they have already written to me on 12th August - saying that the account is enforcable and i can contact the Ombusman if I remain dis-satisfied - meantime can i call their helpline to make proposals for payment
      21st December - letter dated 19th December - NOTICE OF LEGAL ACTION received - my account has been passed to this Department's legal secction to commence a court action for payment
      4th January - threat by creditor to commence litigation proceedings sent

        Co-operative Bank – Credit Card

        1) Credit Card
        2) Start Date 29/11/20001.
        3) Approx Balance - £6,208
        4) Last full payment – September 2009
        5) On Arrangement Plan - £75 – paid up to date last payment 23rd December, 2010.
        6) No default, credit report just shows on AP
        7) Still with Co-operative Bank. This credit card was originally taken out with Northern Rock as part of our Together Mortgage, can’t remember when Co-op took the card over – maybe 3/4 years ago?? At the moment my current bank account is with the Co-op. Being charged some interest and card charge.

        18th January - SAR request sent with £10 cheque
        24th March - letter received defaulting me dated 18th March. Never received SAR - my bank should all be changed over this month - just want to be sure my wages go to my new account then I will be sending out my CCA request.
        28th June - CCA request sent
        25th July - CCA received - will update to document thread
        10th August - missing prescribed terms letter sent
        30th August - letter received saying about my cancelled standing order - and now getting a few little phone calls (this account is obviously behind everything else due to co-op being my bank for a while)
        September - first letter saying they were investigating my complaint the next a letter saying that they have looked into my complaint and their findings were that I remain liable for the debt nd i need to contact their collections team to discuss my account and if they do no hear from me they may pass over to a DCA
        13th October - Letter received marked urgent saying they are concerned they haven't heard from me.
        19th October - two letters received - first one saying they have not heard from me and if fail to contact them they will issue me with a default notice before they instigage legal proceedings to recover the debt. The second letter was a "Telemessage" saying please contact them. On the plus side they have stopped ringing 30 times a day.
        10th November - two letters received dated 2nd November - one saying they cancelled my card and one with a default notice
        4th January - Telephone Harrassement letter sent

          Mint (RBS) – Credit Card

          1) Credit Card
          2) Start Date 4/8/2004
          3) Approx Balance - £5,289
          4) Last full payment – September 2009
          5) Currently on arrangement plan - £56 – last payment 22nd December 2010.
          6) Default issued 23rd December 2009.
          7) Still with Mint. Interest has been frozen

          4th January - CCA request sent with £1 cheque
          18th January - SAR request sent with £10 cheque
          20th January - letter received from Mint enclosing my letter saying they are unable to comply with my CCA request as I never enclosed my £1 payment
          26th January - RESENT CCA request with postal order STAPLED to the letter!
          31st January - Letter received from Mint enclosing my £10 cheque saying they were unable to complete my request as my letter was unsigned
          2nd February - Letter sent to Mint - requesting info again and poiting out letter does not need to be signed as per Niddy's instruction
          17th February - Letter received from Mint saying they are dissappointed not to have recevied my payment - also had about 3 or 4 phone calls - not been picked up!
          21st February - CCA received Niddy says
          22nd - going to blag - missing prescribed terms letter sent
          11th March - letter sent saying they have complied and they see no reason to enter in to any further correspondence (letter was dated 25th Feb!
          28th March - Payment demand sent by Triton for the full amount
          30th March - enough is enough template letter sent to Triton
          19th May - lots of calls from Triton
          3rd June - Urgent Action Required Letter (datd 19th May!)
          7th June - Notice of Legal Proceedings letter received (dated 30th May) from Triton
          8th June - threat of doorstep visit and Threat by Lender/D.C.A - To Commence Litigation Letters sent to Triton
          27th June - letter from GREEN AND CO saying they are likely to commence court proceedings against me without further notice or I can pay Triton within 7 days (letter dated 17th June I receved on 27th June)
          4th July - Threat to commence litigation letter sent
          8th July - Letter from Green and Co sayng they thank me for my letter but my response should've been sent to Triton not them and they have passed my letter to Triton and they will reply to me directly
          18th August - letter from RMA who have taken over this account
          September - one letter from RMA saying my account was seriously overdue, followed by another letter saying they were passing my account back to the original creditor and lastly a letter received on Saturday saying that lucky me had been selected for a settlement offer.
          15th October - letter received dated 7th October saying 30 day notice - saying unless i agree to one of there agreements they will ask Westminster Solicitors to investigate legal proceedings against me.
          1st November - Threat to commence litigation letter sent to RMA

            Overdrafts with Halifax (my account) and A & L/Santander (joint with Ex)

            Just for info as I know these can't be included in UE

            I have an O/D with Halifax approx £3,200 – paying £35 per month – all up to date – all interest has been frozen.

            Joint O/D with A&L now with SATANDEAR – currently standing at £723 with their outrageous charges been added. Have made a F&F offer of £200 – not heard anything back but they are not writing to me anymore but sending all correspondence to the Ex – so just sitting tight on that one.

            18th January - SAR request sent for both Halifax Accounts with £10 cheque

              Well done! Just sit tight and wait for responses then we'll work through everything....

              Time to cancel your dmp. You can do a new one at any time so don't fret...

              Cancel all payments from your bank, don't tell the lenders what you're doing but notify your dmp company (if appropriate) or if self managed, cancel all standing orders

                    What shall i do about Co-op Nid? Shall i get the barclays account opened ASAP?

                    As I am on my own DMP i just ring up and pay on my debit card - so obv won't do that next month...... is that right??

                          Morning looloo!

                          I've also stopped paying my DMP under the the advice of Niddy. I was with PayPlan since Nov 06 and my last payment was Oct 2010. I am at the stage of offering F&F settlement, no reply from them yet. I am scared what they'll do to me too.

                          Now that I have read your diary, it gives me a boost again and hope I will be strong enough to sort my debts out.

                          I wish you luck and hope it doesn't get too stressful.

                            Hi Looloo

                            As soon as I started the UE route, I opened up a shiny new bank account and had my wages paid in there (plus child benefit). As soon as you have applied for your CCA with a creditor you cease payments immediately, until such a time that you establish enforceability (which hopefully you won't).

                            You might consider changing your phone number, otherwise just ignore any calls. It depends how it might affect you personally to have the phone ringing - as it will ring! I haven't changed my number, and the phone calls have ceased now, but it rang it's little socks off to start with.
