    Hi

    As a result of the following thread: ---> viewtopic.php?f=13&t=212

    I thought i'd have some fun with the firm, and see just how much they actually know - see how many lies they tell - and see how they mislead people. I shall post the results on this page for all to see, with a final response going to both the FOS and MoJ for intervention.

    I cannot stomach these firms, and the fact they are blatantly lying and taking £395 per account ( ;EEK ) from people by LYING and saying they can preserve their credit rating means they are in breach of varying regulations - something I will follow up directly with the appropriate authorities.

    Watch this space - i'll update the thread throughout the course of the day..... ;LOL

    I'm gonna ring the fool now and offer them my debt - I have what, 15 cards ranging between £2 - £20k balances with 10 loans and a few overdrafts? Yea, that should do it - maybe the total being £400k? Hmmm lets try that eh?

      The questions i'll be asking:

      1. Are you regulated by the MoJ - what is your number:

      2. Can you really wipe my debts?

      3. How do you do it?

      4. Is it guaranteed?

      5. Even though I took some out only last year?

      6. What about my overdrafts?

      7. What about my secured loan?

      8. What about my car finance?

      9. What about payday loans?

      10. OK, how much does it cost me?

      11. What can you guarantee me for this fee?

      12. Will my credit file remain intact?

      13. How so?

        Rung the number displayed on their sites - no Robert Clayton working for them.... they are not Knightsbridge but merely an agent for them.

        Ok, I say - have you got their number. He says sorry no, ring their head office. I say, oh - I was told that they can wipe my debts - if you're an agent you must have their contact number? He then gave me this number: 01162442251

        Right call 2 - here we go! I am not letting this drop now.... lol

          A. We tell them the agreement is not enforceable and get a judge to agree it - then they can never come after you for the debt.

          4. Is it guaranteed?
          A. Yes, 100%.

          5. Even though I took some out only last year?
          A. Not with those, but we can try - the judge can only say no...

          6. What about my overdrafts?
          A. No problem...

          7. What about my secured loan?
          A. Need to pay this but can still check for UE.

          8. What about my car finance?
          A. As above...

          9. What about payday loans?
          A. No problem, so long as you signed an agreement...

          10. OK, how much does it cost me?
          A. Nothing! If we win then we charge £495 per success.

          A. Yes - but nobody will lend to you for 3yrs because of the late payments.

          Ok, you'll probably already have seen the errors to their claims, with the answers shown in red above. There was a reason I asked these probing questions, these confirm one thing - are their claims real or false? Unfortunately, the latter prevails - they are cowboys.

          First things first, I spoke to a guy called Glynn - apparently they have a Glynn & Paul working at that office. They also use a woman, who is (i quote): "Eileen Sale is the top insolvency practitioner in midlands - i'm giving you her name so you can see for yourself".... He said he'd come and meet me halfway or somewhere neutral if necessay (I told him I lived in the south, when i'm actually in the north).

          Ok, so before I start stripping the above questions for errors - who can spot them? Lets see what you guys are learning here - i'll post a proper reply, with detailed analysis later but before that lets see what you have learned lol....

          Back soon - this is fun, may have to do this with a load of them and report on each! But why? They are all the same, out to make a buck from the needy.....

            What would be the point of trying (apart from takin gmy £395?) If it's after 2007 forget it.

            Again, secured loans don't come under CCA stuff...A

            8. What about my car finance?
            A. As above...
            Not if it's secured against somethign?

            9. What about payday loans?
            A. No problem, so long as you signed an agreement...
            Payday loans don't have a CCA?

            A. Nothing! If we win then we charge £495 per success.

            Blatant lie. You still owe the debt. Just can't be chased through the courts if it's UE. But you still owe the debt.

            12. Will my credit file remain intact?
            A. Yes - but nobody will lend to you for 3yrs because of the late payments.
            Erm did somebody say 3 years, it'll stay on your file for 6.

            13. How so?
            A. Because a judge sorts it all out

              2. Can you really wipe my debts?

              Nobody can guarantee such things; that alone is a breach of OFT and MoJ guidance - only a judge has the power to ensue such guarantees - from industry wide experience, they are not too keen to do such.
              This is a false claim by the CMC.


              3. How do you do it?
              A. We tell them the agreement is not enforceable and get a judge to agree it - then they can never come after you for the debt.

              Eh? So just like that, they go and get a judge to "sort it"? Wow - amazing.... Ok, Ok - so we all know that lots of provisions apply prior to court, but still, making such claims to an inexperienced person is madness.... i'm shocked! They made it sound like the judges were "on side with the consumer" - a fact we know, to be incorrect and misleading.

              4. Is it guaranteed?
              A. Yes, 100%.

              WTF! Ermm, the only guarantee here is if the lender comes back and confirms they cannot find the agreement, then you're guaranteed that a judge will not make an order against you (in line with s.127 CCA1974) - however, that is all. Nothing else, nothing more...

              Eh? So tell me then, if you use a payday loan don't you sign a new agreement every month? ergo they will ALL be post 04/07 so why bother? It is impossible to have an outstanding payday loan from pre 04/07 - unless of course you have one that you never paid in which case wouldn't matter cos they would have been CCA1974 exempt anyways! They are short terms agreed loans, you cannot seek UE on a payday loan - period!

              A. Nothing! If we win then we charge £495 per success.

              Right, so I had 22 creditors - at £495 each means i'd have to get £11k to let them sort this.... i'd rather take my chances and use the same £11k to make F&F offers....

              11. What can you guarantee me for this fee?
              A. No more debt

              Bollox! There are no guarantees, you could take the UE route then 5 years ater they find an agreement and guess what? it comes out of UE and becomes enforceable again. So this is yet another misleading claim!

              12. Will my credit file remain intact?
              A. Yes - but nobody will lend to you for 3yrs because of the late payments.

              Ok, this proved the guy knew little. 6yrs is the cut off point. He may have meant that in 3yrs of no activity on my credit file I may get accepted again, which can be true in rare cases but not considering I told him I had 22 creditors etc - the odds of them all defaulting me etc this year are slim, therefore it could well be8 years or as little as 1 year depends on the state of each account. Point is, this was utter rubbish as he did not explain things to me and seemed confused when I quizzed him on this.... bless him!

              Ermmm - I got angry and hung up not long after this. I nearly let slip and asked him if he paid a judge to do this cos to date few cases have been successful - moreso as a result of McGuffick and the Carey cases. We never go to court cos right now Judge Waksman will take the case and explicitly refer to carey meaning you will lose - so whatever we do, we never go to court!

                Well done you guys - you were spot on...

                Few minor blips; payday loans are now covered under CCA but it'd be almost impossible to get one of these deemed UE - they are revolving with agreements so the latest one would always be up to date. Similarly, car and secured finance can be CCA'd but why the hell you'd risk doing that fails to amaze me, point is with all the savings made on card debts you'd be better paying the secured loan and car finance - no?

                  The No comment parts is because the answer is debatable - not right nor wrong, just cant be bothered going into things cos it doesn't change the fact that these muppets are indeed cowboys and should be avoided at all costs!
