    hello everyone
    nice shiny new site,hope to put my diary on later(only 2 b/cards so not a lot)been busy seeing my new granddaughter,born today ;happy
    not going to worry about b/card at the minute,nothing happening much anyways

      yes she is georgeous, thought she was never gonna come,daughter went 13 days over,shes calling her megan weighing in at 8lb 7 oz ,ill have to be careful in case i forget about why im on this site k

        heres my situation with barclaycard
        ive had the cards since about the mid 1980s,was a good payer for years up until about 2003
        couldnt pay the min payments even,so went to CAB for help
        they arranged an informal agreement with them to repay which worked ok
        then they started to add interest,which dosent help to get the debt down the interest went on for a year,then they just stopped adding it on
        another year down the line and they started adding it on at double the rate,so thats when i heard about UE
        lurked on the mse site and took the plunge
        the current state of play is as below

        17-6-10
        barclaycard cca request sent

        17-6-10
        b/card mastercard cca request sent

        no replies from them both,only them sending normal statements out
        1-7-10
        cca reminders sent to both

        no replies again,only letters stating what my arrears were

        advised off nid not to send S.10 as they were in default of S.78,didnt send it
        nothing else as yet,probably get another arrears letter,or an invitation from mercers to pay what you owe or else
        well there we go will update as and when

          Yep - just leave them and see what develops, enjoy the granddaughter and forget these for the time being.

            its all been quiet until today,got two leters from mercers today, both default notices of S.87 of cca act 1974
            was expecting these anyway
            would i be right in thinking that my response would be- Account sold while in dispute of my cca request,do i include a copy of my cca request with this letter or not,not sure,your advice would be most appreciated

              just been looking back over my correspondence and back in 2003 b/card mastercard issued a default notice,now they have, see my previous post issued 14 sept issued another one last week (can email both if you want)
              i thought you couldnt default some one on the same debt twice, ;N should i reply to them 1 or just send Acc sold while in dispute ?

                Nope you ignore matey - a default is expected and they require no response at all. Ignore them, both! ;Spank

                  Hiya

                  You cannot be defaulted twice for the same debt - well spotted ;--;

                  see here: ---> viewtopic.php?p=132#p132

                  You'll need to edit parts to reflect the fact you're asking the CRA to erase a duplicate default and send proof that one was added in 2003 and proof of the one recently added - for the same account. The CRA's will then remove them both cos the original one has expired in 09/2009 - you may need to mention this on the letter as well.....

                  Send a copy to all 3 CRA's - see here for addresses etc: ---> viewtopic.php?p=158#p158

                    thanks for that, will get letter off to all CRAs
                    i never checked any of the CRAs in the past so wont have seen that the first defaults were on in 2003,and with them having expired now, i checked and everything is fine,but they want to play funny b****rs and default me twice ;N ;N they probably didnt expect me to keep all my paperwork k

                      LOL, keeping all your paperwork is nuts - but well done! However a SAR could be interesting to see if they hide the first one and then when you query it's omission with the ICO they'd get buggered lol

                      Lets see what happens with the CRA's - as it is quite clear they should just remove both defaults, knowing them though they will raise a dispute and write to the OC asking for clarity and then come back 3wks later and say the lender says they must stay - at which point you get more assertive and remind the CRA's they are breaking the law and it is their responsibility to ensure their data is accurate, you've proved it is not and so will be seeking compensation and will complain to the ICO....

                      They will then remove it; if not then complain to the ICO and let them tell them to do it!

                          hope all is well
                          well since mercers sent default notices for both my accounts(b/card and mastercard)last month,
                          i received a letter from mercers for each account teling me that they are going to send a local company out to collect the amount i owe in full.
                          i guess your going to tell me (to file them away) that they wont, but i just wanted to be sure,more for our lasses sake more than mine.(she worries about all this)
                          would there be any correspondence i should be sending them or not

                          still waiting on the replys from the CRAs regarding them defaulting me twice(update as and when)

                          still recieving monthly statements off b/card which gets bigger each time-filed away

                          also just recieving default charge letters-filed away

                            Yep, update when they get back to you - could be some time, but they usually deal within 28days - even to say they've gone back to the lender.....
