    OK. Hello all just about to set back up my Diaries as a continuation from the site BaLWi.

    Please bare with me as i am going to set this up in stages and sort of in the order of the postman poppping it through my door.

    You may not recognise the name but i was previously Clear_JCR_Debt, but due to getting fed up with typing that each time to log in i thought Ahhwell was nice and easy (I turn the fast thing and password saver off)

    Anyways, the forum looks bloody awesome NiD you have put some blood sweat and tears into this and for that all i can offer is a thanks at the moment but you really do know your stuff

    I look forward to meeting chatting with you guys in the future but i keep an eye on things from my phone but struggle to keep up with the fast chat that goes on in the chatty bit, but always try to keep up with the other stuff.

    So rather than chuck everything on in one hit (not got the time, love me dog walks k ) i am going to list my debts below then add a link at a later date as and when they get updated if that is possible.


    So a list of my problems as follows;

    AA Loan - £30k ------> Gone very quiet
    Capital One - £9.5k ------>
    CITI Card - £3.6k ------> Cabot on me backside
    BarclayCard - £3k ------> Gone very quiet
    MBNA Card - £1.5k ------> Arrow Global on me backside and confirmed as and Gone very quiet
    HSBC Card - £0.5k ------> MK
    Comet - £1k ------> Gone very quiet
    Homebase - £1k ------> Gone very quiet
    Next - £0.9k ------> CLOSED

    AA Loan

    Type - Loan - Circa £25k and is now around £29k interest and charges
    Date - I have date somewhere but not to hand but AFTER April 2007
    Approx balance - Circa £25k and is now around £29k
    Date last paid - TBA but over a year on the full payments and Repayments were £415ish
    Are you on arrangement or not paying - I ended up paying £99ish after giving an income/Exp, stopped paying when made redundent and i wrote to them to confirm that.
    Status (default/in arrears/up-to-date) - DEFAULT
    Account owner (who is writing to you, a DCA or the lender) - Only until recently they left me be.....Just got a letter from Wescot.

    Now the Wescot letter says the loan is with Bank of Scotland Personal Loan, does this matter as I thought they are called Royal Bank of Scotland? But Loan was with the AA? Nevertheless not to sure i have original agreement. But i have since moved and i know there is a BIG box with paper work in.

    The other thing is i have a feeling it will be enforceable, but what can i do now its with Wescot? Even if it is delay tactics. AA never even wrote to me to say that they are passing it on.

    Is it worth sending a CCA request?

    Should i send i have no knowledge of Bank of Scotland Loan?? As it was with AA just for the time being?

      Hiya

      AA loans/cards used to be issued by HBOS - not RBS...... are you getting confused here? I think now it may well be coop that deal with their financing... In any case being it was taken after 04/2007 then unenforceability is not an option as you have no s.127 protection. i.e. they can obtain a judgment as and when they want to......

      You can either blag it with wescott or you can agree to a repayment plan? Its up to you but if they attempt court action you'll have to buckle then.... when did you say you last paid into this, I mean last paid as in any payment?

        Hiya mate.

        Last made payment Feb 10 and 10 or so days later the company I worked for went pop.

        All correspondence has been from AA finance service, I appreciate that this dosh comes from a bank but was wondering if they should quote who I actually took the Loan out with, but it helps if I still had original agreement. So does the name have to be exactly who is on the agreement so HBOS rather than bank of Scotland Personal Loan (Loan taken out in 2008 btw so what was HBOS then).

        I was hoping for a technicality to be honest like I have heard of AA as all correspondence comes from them but who is Bank of Scotland I never took a loan from them.

        Tbh I just need to delay things until cash-flow improves and I sort the :UE ones out that way I can pro rata the others and do some negotiating

        Should I just blag with I do not recognise this agreement letter bud?

          Hiya

          You will never win UE on technicalities - there are none provided for within the act. The CCA is not there to allow debtors off with debts that they "won't pay" - it is there to protect those than "cannot pay" due to mis management etc - NOT for typo's or other small errors. Even your name being spelt incorrectly would not qualify for loan write off - please, forget that approach - you have more chance of me supporting Celtic than winning your fight if you're going for a technicality!

            Should I tell them I currently have not got a pot to pee in at the moment?

            What would be a good step to start negotiations?

              LOL, yea tell them you're brassic and they cannot get blood from a stone - but seriously, don't worry too much about that cos they won't really pay much attention anyway - they rarely do!! gh

                LOL dunno if that's good news or bad.

                Should I send an Income/Exp form then or ignore them for a bit?

                As I said I just need to buy some time until New Year. What I have scraped together is what I want to spend on kids for Xmas.

                Thank God for the Mother in Law doing the Xmas dinner otherwise i would if been having Bernad Mathews Turkey Drummers :cry

                  I'd ignore them for a week or two...... also don't worry about paying them, the kids do come first (in my opinion) - anything these muppets do we can sort out for you, unfortunately we cannot sort the kids' christmas.....

                    Cheers bro.

                    I will wait for their in house Solicitors to write to me with a 10 day letter lol.

                    If anything this one is my biggest worry due to the sum involved, the Cap one I had for 10k you have confirmed as , and although they on ignore list I have heard nowt since the letter you told me to write and send to them.

                      Concerning the AA debt....

                      Got a letter saying I have not responded to their last letter, we know you live here (idiots I am writing to them re another debt that I know nothing about, how many people if the same name live in my house)

                      Anyway usual crap, collection service or doorstep visits

                      Ignore or send something, as I said I may have to negotiate this one but after Xmas is my plan.

                      On that do I negotiate with them or the AA. Not sure they sold it and Wescots is just acting for them?

                      No rush got just under 10 days to ignore.....I mean respond

                        Just ignore them....... if this worries you then feel free to start a repayment plan whenever you want, however I always say not to and offer it as and if they take formal action.....

                          Righty ho...i am back after a long time of not hearing much from banks, alleged Solicitors and DCA's

                          But now i got the pita that is Cabot on me back.

                          This is for a 2008 agreement with CITI. Originally I was told it will be enforceable because of the date but no agreement was scanned or shown, has this changed now things have moved on?

                          Anyway to keep it brief it seems after sending them a CCA request and reminder (as a blag btw) (I forgot to do final, which i only did the other day, prolly should have come on here 1st) they sold the debt to someone called Opus and never told me (they are now saying they did in a letter from Cabot).

                          I responded to Cabot saying that the account has been sold while in dispute and they came back with what seems a personnel touch letter saying that they are doing everything correctly but they are just checking back with Opus on the matter.

                          They say they are doing everything in accordance with S78 blah blah and it is enforceable, but they do not intend to enforce it at this time blah blah.

                          I should also tell you they enclosed a letter from opus issuing the agreement on the 15 December 2011 - I never got this letter as i keep a very good file of all letters i get, and they start their letter with we write further to your request for a CCA (or words to that effect, not got to hand as i am at work), when i never even wrote or heard of Opus until now. i only requested it from CITI back in Feb 10!!

                          Have they finally got me by the you know whats and i may have to start a payment plan with the buggers. They have also chucked a load of interest on which does not help matters.

                          If you want me to send the purported agreement i can at your request i have not had time to scan the Cabot letter yet as it arrived yesterday.

                          Please advise

                          And VERY impressed with the site how it has moved on since i was last on

                              Thanks for the email over the weekend Niddy, I have made a copy of that letter ready to go.

                              However, over the weekend i scanned and emailed you the Cabot letter i mention above as it had a kind of personnel touch to it rather than a standard letter.

                              Can you please cast your eye over it before i send the letter you advised of.

                              All a bit of a blag but Cabot are quite pushy so just want to try and get them off my back.
