      Its regarding an alleged HSBC debt. I never had any real CCA correspondence with the HSBC as my last letter to them was I am being made redundant and I was trying to make them a full and final offer which had to be retracted because of this circumstance.

      Anyway it went very quiet for years and now these guys pop up.

      This is a pre April 2007 matter

      The history with these is as follows;

      1. They contact me I CCA request them.
      2. They send me a copy of an incomplete application and some T&C's [I can email these if you request]
      3. They kept phoning
      4. Sent them telephone letter and it stopped.
      5. They write to me to say they have supplied enough so pay up and this is a Final Response.
      6. I write the following letter as they pissed me off;



      Then i get two letter as they like to write from different areas of the same address This from MKDP;



      Do i ignore or write to FOS?

      And this letter from MKRR;



      Do I respond to this or await contact from Raven Recoveries and go through the whole CCA issue?

      I wouldn't be ignoring a court threat regardless. This is what happens with UE, it gets passed on, you fight them to a standstill, then it gets passed on again, I would definitely be sending the account in dispute as soon as Raven contact me

        I will not ignore the pre-court stuff I was just wondering about the previous letter as it is a response from a Final Response so not quite a Final Response lol

          Based on items i have read in this Section I am considering the following;

          With regard to Cabot:

          1. Politely remind them that I still have a Dispute with Citi as they have failed to provide a 'True Copy'; and

          2. Explain the statements they [Cabot] have provided are not relevant; and

          3. Refer them back to my previous letter that the account has been sold whilst in dispute and I have had no correspondence form Opus.


          With regard to MKRR:

          1. Ignore as it was a Final Response; and

          2. Await the Legal dept to contact me in which case I explain to them or as they are all under the same roof I assume, repeat myself.

          or

          as i have just read in DNW Diary send a one liner that i will complain to the FOS.

          What ya think crew, would like to get these out by end of week or early next week.

            In response to your letter dated xx May 2013 reference DHSXXX you have failed to provide an adequate response with regard to my dispute with you and the HSBC and therefore I give you notice of my intention to refer this matter to the Financial Ombudsman Services.

                Sorry this was missed.

                As you say even if it confuses them its more time in the bank for you.

                Think MKDP have to be treated with bit of respect at the moment as they seem to be litigants of the month.

                  An ongoing battle but boy are these guys stupid, they gave me an Application form with only an old address the rest was blank. It was a Midland Application and not sure i had a CC with them in any case.

                  Lets see what they say.

                    A lawyer taught me to always read the last paragraph of a letter first because that tells you the current state of play. If MKDP had said "this is our Final Response because we think you're absolutley right, we haven't got a legal leg to stand on so we'll stop chasing you for this debt for ever" then all well and good. But they didn't say that. They just said they weren't prepared to debate the s.78 UE issue with you anymore. That doesn't mean they're not going to issue a summons so you can carry on the conversation in court.

                    MKDP will also know that there is an "understanding" that firms should not issue legal proceedings during a FOS investigation. I expect you will get a letter back asking for proof that you've filed your complaint with the FOS and then they may put collections activity on hold. No guarantee though so keep your wits about you

                      I would be inclined to send a fresh CCA request to Cabot (as owners of this account now) and give them the headache of retrieving the relevant information from whoever.

                      I know that, in theory, you don't need to send a fresh CCA request when one s still outstanding to somewhere else but as Cabot now own the account, they are also in the position of potentially issung court papers unless you give them something to stop them in their tracks.

                          They have given me 30 days so I can do this in leisure at the weekend.

                            Dear oh dear these numpties try it all.

                            Received a letter yesterday from RAVEN RECOVERIES - MKDP and MKRR reprobates.

                            Letter is dated 30th of May funny enough, the day i posted my letter to MKDP that I will complain to the FOS, I have kept the envelope, but it just has a barcode on and probably means nowt when it comes to the actual postman putting it through my door.

                            Anyway it gave me 7 days to reply funny how I receive it on the 7th day!!!

                            Typing a response now but left my memory stick at work with all correspondence on so just going to say that MKDP and MKRR failed to provide a 'True Copy' of an agreement and I have give them notice that I intend to refer this matter to the FOS

                            That's all I can do, but will do a Guaranteed delivery for Monday at the Post Office tomo.

                              Going to send this tomorrow, is this OK?

                              If i never left my memory stick at home I would have printed everything and sent the paper trail but just want to get this sent off as the 7 days has expired and I know their little standard letter machines will be printing my next letter as i type!!!

                              Thank you for your letter dated the 30 May 2013, received by post on the 6 June 2013 [envelope retained] which I will respond as follows.

                              I have been corresponding with both MKDP and MKRR which I note you all share the same address so my correspondence cannot be too far away for you to review.

                              Just in case you find it difficult to liaise with the other departments I will summarise the dispute as follows.

                              i. CCA request sent.
                              ii. An incomplete application form provided. To clarify this just had an address filled out, nothing else was completed, the enclosures had many flaws.
                              iii. Letter sent stating that they have failed to supply a true copy of the alleged executed agreement.
                              iv. Final response sent stating that it complies with the Act.
                              v. Although a final response I reply stating the faults and I point out that they are wholly misguided and that my letter is not without prejudice so their conduct will be brought to the attention of the appropriate tribunal when matters of cost are addressed.
                              vi. They reply by still not dealing with the matter and a reminder previous letter was a final response.
                              vii. I respond to inform them of my intention to take this matter to the Financial Ombudsman Services.

                              As this account is clearly unenforceable, I expect you to write back and confirm that no further action will be taken and that the account is now closed and no further correspondence will take place, irrespective, unless you do supply a copy of the original agreement I will not correspond with you again and any threats will be averred and unlawful and vexatious with a counter-claim forthcoming.

                                Update on MKDP in today's post:


                                Further to my notice I gave them that I intend to complain to the FOS it said

                                in order for us to suspend all collection activities whilst we await the outcome of the FOS investigation, we kindly request you provide us with any correspondence received from the FOS detailing the outcome of their investigation or stating the current status of this dispute with them.
                                Do I have to tell/show them anything?

                                I gave notice but understand I have 6 months to complain from a Final Response letter.

                                Best to ignore?

                                Not heard from Raven Recoveries regarding the letter I sent as shown in my previous thread above.

                                What do you think.
