    I am receiving weekly demands from Cabot and they have very recently checked my credit file four times, twice in one day!
    It is in regard to an old account that originated with a People's Credit Card, that was taken over by Citibank, I believe that this account was sold to a DCA during 2002, but I have not received written proof.

    2002 DCA purchased account balance of £2885
    2005-2007 Token payments made
    2007 CCA requested
    2007 Account collection on hold
    2011 Letter received demanding payment
    2011 Reconstituted agreement received
    2011 interest has accrued from 2007-2011, balance now just over £7000

    The letter accompanying the generic agreement and t&c's states; "that the reconstituted agreement complies with section 77/78 of the CCA and is a true copy, enforcement means that we are able to obtain a CCJ against you."

    I sent a copy of P1's CPUTR 2008 request and their response states; "I can confirm that we have been unable to obtain a copy of your original signed agreement, however, the reconstituted agreement fulfills our obligations and we intend to initiate legal proceedings."

    It is likely that they intend to litigate quite soon and naturally I would prefer to avoid the stress, what could or should I do next?
    I refuse to offer any payment, given the amount of interest added to the account.

      Can you confirm, when exactly did you last pay? If it was indeed 5 years ago then they'll make wild threats based on the fact it's less than a year until SB....

        It has 13 months to run before being statute barred, so they have plenty of time to litigate and on browsing, that seems to be their current theme!

          Nah you'll be fine. Get the legal template sent off - that puts you in control.

          Can I see their attemp at cca or have you had nowt?

            I have taken a fresh look at the reconstituted agreement, it is simply a typed page headed with: Credit Agreement Regulated by the Consumer Credit Act 1974, the parties to this agreement are:Peoples Bank of Connecticut and below is my name and address, there is no signature and no date, then several pages of t&c's, it is simply a generic copy that could be attributed to anyone.
            The huge amounts of interest that are being applied are listed as penalty interest, but do not show at what rate it is being applied.
            I'm tempted to SAR Citibank, but have no idea what address to send it to, or if it is actually worth spending the money on.

              They've cooked their own goose with that statement....

              It might all be huff and puff; if they believe you to be an ignorant consumer, then they could issue papers to try for a CCJ by default but their sol. will/should contact you before that happens.

              If you follow the protocols on here, then chances are they'll back off.

                Pointless SARing them, stop stressing we'll not let anything bad happen to you....

                Just send the legal threat off as directed above and chill. From what you've stated above this will be UE anyway.

                      I like the idea of giving them another number, but I didn't give them mine in the first place!
