On 11th May 2010 I bought 'stock goods' from SCS in the form of a corner L shape sofa for £x amount to be delivered on the 27th May. On delivery they broke my light (left me to clear up even though I couldn't walk due to my back), scraped the sofa, cushions all plucked, sofa didn't join together and put the feet on the wrong way (learnt this later).
I called the office at Preston straight away to speak to the manager who seem to think this was funny!(He did have the words shiter in his last name!) lol It clearly says that if the furniture is damage to report to after sales within 72 hours. I did and they told me to ring the store which I had already done.
By this point the sofa had completely collapsed and could not be used and to add insult to injury they had sent the sofa the wrong way around (right hand instead of left)
I called the store many times and the head office, emailed and wrote letters and they ignored me for a while. Eventually they sent an upholsterer out who said he had seen a lot of things with SCS but not quite this bad. He propped it up with my yellow pages and phone directories!
The manager at the store said he had ordered me a another sofa (the same one but LHS) I told him to take it back and leave it due to their own T&C it says on Paragraph 3.4.2 that 'stock goods' can be returned and the contract ended. The manager wouldnt take the sofa. When I spoke to another member of staff they said that Mr Shiter (not full name just the end part) had not even ordered me any other sofa which delayed even more time (13 weeks or more)
I did speak to TS and consumer but they just told me to put in writing that the law clearly states that if there is a problem within the first 6 months its held in breach of contract under the sales and good act 1979 (amended) the good should be of satisfactory quality.
After months of more letters, emails, customer services, a letter to the CEO of SCS, upholsterers and 3 change in store manager's they came to me and said that I was to take another sofa. The manager picked one for me that was a corner ROUND shape, nothing like the one I first ordered apart from part of the colour was the same! They wouldn't take no for an answer and as I was so ill at the time and no alternative sitting arrangement I took the sofa.
The sofa has now (despite being sat on only a few times due to it being really bad for my back) has started to spit at the seams, dips down on one side and is in the garage! I am borrowing an old one from a friend who had her new sofa delivered a few months ago!
They sent an upholsterer to look at the new sofa. He took pictures on his phone and said there was no damage. I complained and they sent another who said they would repair the right hand side of the sofa when it was the left hand that was damage!
When he came to fix the sofa he forgot the part and said he would have had time to do the work anyway as they had only allocated an hour when it would take at least 2 hours. He said the whole of the right side needed to be completely taken off and re-covered!
After all this time Creation (who the loan for the sofa is with) have held off while things are being sorted out but they now say that SCS have said that they will replace the bit that the stitching has come undone and they have contacted me when they haven't. Creation are now ringing me day and night and even though they are fully aware I am ill they say that I need to pay the loan back immediately and are adding charges. I did speak to them and numerous times but they dont listen and am now getting letters all the time and the calls. I have dealt with the calls and stopped them but I am at a loss as to what to do next?
I have thought about sending back to SCS (Niddy says) lol
The new agreement was 9th Nov 2010, delivered 9th Dec 2010.
I hope this isn't too long and too much waffle.... I will answer more technical things when you have read the story.
