        What is just beyond belief is that the guy settled for I assume the full £850. That is just criminal

          I know. He was "done" on the amount.

          However, presumably the costs to Lowell more than wiped that out and put them firmly out of pocket?

            What a joke!! Almost as bad as the new charging order process.

            What next? Self regulation or worse, allow the creditor a free reign?

              Can you guys stop making me feel nervous

              If a debt is in dispute due to "triable issues" in the county court such as a section 78 default then a creditor can't progress from a SD to full-on BR in any other court. As I understand it the debtor should apply for a set aside which ought to be sucessful Then ask a DJ if the money is owed or not

                Don't worry plan b I do enough of that for all of us. My interpretation is that this guy decided it was a better risk to settle rather than fight. For someone as organised as you you could show beyond doubt that no SD had been received. You also know a good lawyer

                  That's the bit that makes me mad because Lowells prefer to emotionally bully people into submission when they don't always have a legal leg to stand on

                  They've searched my CRA files several times but they have never bought any of my 23 debts (wise move) because they presume I'm not any easy target (if only they knew).

                    Sadly a lot of people end up at "other" sites.... They feel a name such as CAG "must" be right, right....

                      But at least 1,710 members (at the time of this post) and any other guests reading this will have the benefit of knowing that a debtor can challenge a SD and that BR isn't an automatic right of the creditor thanks to AAD

                        Our members level is ideal hence we still have time to offer that personal touch.

                        I hate sites where the management are too busy to speak to their clients. That'll never happen here. Yea I'm slower at responding but im always around especially when things go bad for users etc.

                        Anyway I'm not here to measure dicks with other forums, I was trying to point out that having a bigger brand doesn't necessarily (nor automatically) mean you're better than a smaller/newer/more specialised outfit.

                        I avoid the word competitor cos I dont see us as competition, nor them. I believe we should point people wherever the best source of info is. Simples

                          Now back on topic, this stinks. Imagine what (no names) certain DCA's will do to abuse the system? Christ, some are borderline illegal now so god forbid what they'll be like with the new system. Saddens me what Tories are doing....

                              How will a debt collector abuse this?

                              The changes only apply to cases where a debtor petitions for their own bankruptcy.

                              Creditor petition cases will be dealt with via the courts in the same way as before, as I read it.
