    This is a repost of my last update on the previous site.....not a lot has changed since then,still getting the phone calls & letters most of which are being filed...but out of today's offerings from the postman there are 2 letters which I could do with a bit of advice / help with...I will do a seperate post for each of them.


    Last update as of 22/08/2010.

    After reading through the mail awaiting me on my return from holiday, below is a summary of what I received & where I am (or at least think I am) with each of my accounts.
    Hopefully this will bring some order to my thread and help to make the current position with each account clear(er) – without annoying Niddy further.
    Apologies in advance Niddy if I have put too much info down....here goes anyway.
    Amex Credit card
    1 account balance £3K
    Account previously advised by Niddy as UE.
    Letter asking for details of my incomings / outgoings etc c/w copies of wage slips, receipts etc to prove and making me aware that they have formed a specialist programme - R£gain to help assess & organise my finances to help me meet my commitments.
    I will ignore & file this.
    Barclaycard Visa & MasterCard
    2 accounts total balance £22K- again both previously advised as UE by Niddy.
    Statements sent for both accounts applying further charges (PPI even though I have written asking them to cancel it) telling me that the account is 2 months overdue and I may be issued with a default notice.
    I will file these.

    BOS Visa & Mastercard
    2 accounts total balance £17.5K - again both previously advised as UE by Niddy.
    Another letter telling me that they will be calling my home on 24-08-2010 – No one came last time as far as I am aware & I have changed the phone number so they can’t ring me.
    I will ignore & file this.
    Another letter advising me of missed payment etc.....
    I will ignore & file this.
    Default notice also issued for one of the accounts advising if I pay up before the date shown no further action will be taken.
    I will ignore & file this.



    Halifax Visa
    1 account – balance £15K previously advised by Niddy as UE.
    Latest statement received c/w with further interest & charges applied along with another letter advising me of missed payment etc.....
    Also received a letter in response to my letter telling them that they have not complied with my request to send me a true copy of my executed credit agreement – They disagree & confirm that they have supplied a ‘copy of the agreement complying with section 78 ‘ etc and they do not agree with my complaint.
    No threat of action etc – I will ignore & file for now?

    Citi Visa
    1 account – balance £10K
    Weird one this one.
    CCA’d em at the same time as everybody else – no response to date.
    Received a letter telling me I have missed payments etc along with a copy of the latest statement for this account with further charges & interest applied.
    Time to send them a CCA reminder or sit tight & wait?

    COOP Visa
    1 account – balance £12.5K - previously advised as UE by Niddy
    Default notice received along with a copy of the latest statement for this account with further charges & interest applied.
    Default notice also states that if I pay up before the date shown no further action will be taken.
    I will ignore & file this.




    HFC –GM Card
    Another weird one - CCA’d em at the same time as everybody else – no response to date.
    1 account – balance £9.5K
    2 letters received
    One marked ‘without prejudice’ advising me that my account remains overdue and that ‘my account is being reviewed to determine an appropriate course of action to recover the balance’.
    2nd letter - default notice again if I pay up before the date shown no further action will be taken.
    I will ignore & file these.

    LTSB
    2 Accounts 1 visa / 1 MasterCard total balance £10.5K
    Same ‘Final Response’ letter received as for other account.
    Will do the same as previously advised – ignore as UE and they can’t find a copy of the original agreement.
    Copies of the latest statement for these accounts received with further charges & interest applied.

    MBNA
    3 accounts 2 visa (1 Visa ex A&L) 1 MasterCard total balance £17K
    MBNA Visa & MasterCard previously advised as UE by Niddy – A&L have asked for more time to look for CCA.
    1 letter per account received apologising for the delay in responding to me & telling me that they will respond by 13/09/2010.
    Not sure which letter they are responding to as they don’t say & I have sent them a few – so will do nothing for now & wait to see what comes.
    Also received latest statements with further charges & interest applied, along with letters telling me I have missed payments etc on the accounts.
    These I will file with the rest.
    Mint
    1 account Mastercard £10K balance
    Another letter received telling me my account is in arrears etc.
    As they have stated that my account is UE I will ignore & file.
    M&S Money
    1 account Mastercard £6K balance
    Previously advised by Niddy as Enforceable & therefore trying to blag for the time being.
    3 letters received
    No1 in response to the CCA received basically saying that they have complied & that they believe the agreement to be legally enforceable.
    No2 in response to my telephone harassment letter also stating that they can ring my HOME in compliance with the law – this point doesn’t bother me as I have changed the number.
    They do not mention ringing my place of work which is what the complaint was about!
    They also included an income expenses form for me to fill in to enable them to assess / look into a payment plan.
    Ignore for now?
    No3 – Default notice – this one worries me as it says I have 14 days to bring my account up to date from 11/08/2010 or they will demand the full outstanding balance.
    Do I need to do anything as yet? How long does the process take?
    I certainly haven’t got the money to pay the account in full £6K

    NatWest Visa
    1 account £9.5K balance - previously advised as UE by Niddy.
    Latest statement received along with a notice of missed payments & default sums etc.
    No threat of any action etc for now so will file & ignore for now.

        1st letter received today that I could do pointing in the right direction with please...
        Letter received from Amex saying 'account cancelled and passed on to a debt collection agency as is their policy in these circumstances'.
        They also go on to say that 'after a period of 28days from the date of the letter they will take steps to register the default status of the account'.
        By coincidence(me thinks not) I have received calls today both on my mobile (2no) & at work 1 no from Wellmans who I find out are a debt collection agencey.....didnt take the calls of course.
        Question is what do I do with the amex letter...file & leave for now or send a sold whilst default letter?
        And Wellmans do I send them a sold whilst default letter & telephone harrassment letter?
        I have had no correspondence or previous contact from Wellmans to date.

        Any advice would be appreciated.

            leave amex, wait on dca to contact you then send account sold template - however, as you've been informed by Amex, this template serves to tell the dca that amex are in default of your cca request

              2nd letter received today that I could do with help/advice with please was from BOS ....
              It is response to my last telephone harrassment letter I think ,as they dont refer to a particular letter - just a complaint of which I have made 2 to them.

              Anyway my complaint has not been upheld and thay say that they are unable to request their collections dept to cease calling me(despite this being at my work place as this is the only number they now have.)
              They also say that they cannot agree that the account is in dispute and refer to their letter of the 4th of August where they said 'that as we have been unable to provide the originalterms & conditions,we will not seek to enforce the agreement as defined by the case of McGuffick v RBS.However, evenif an agreement is unenforceable,the contract has legal effect and is not void.,the lender is merely prevented from seeking an enforcement order from the court'.

              They also go on to say in the letter of the 4/08/2010 that they 'note from your letter you are also disputing liability for this account but have given no basis for this dispute.as we have provided a copy of your signed agreement and you have not disputed the fact you have had the benefit of the agreement,we do not see on what basis you are disputing liability.we will continue with our normal collections and credit reference reporting activities.'

              All seems rather contradictorary to me....but not sure how to respond or whether I just file ?

              The latest account statement shows yet further interest,default & late fees added....god knows what the total will get to by the end of the 6 year period.

                          looking good matty, we've had one of those letters from BoS as well, quite a few in the last week across the diaries, wonder if they are having a clearout or a sudden streak of honesty??

                            Well done so far & dont let the buggers grind you down.
                            I dont think they will though as I get a feeling that you are becoming quite good at dealing with them

                              Update 4-09-2010
                              Usual barage of mail received yesterday along with several calls from Wellmans,all of which I have ignored.

                              Letters received yesterday:
                              Mint
                              1 from mint saying that if I dont contact them in 7 days to discuss my account they will pass on my account to 'resolvecall who will re establish contact with me by visiting my home'

                              Will send them the doorstep visit letter.

                              1 from Halifax in response to my final warning re harrassment letter......suprisingly they dont agree & again state that they have fulfilled their obligations under section 78 and that this is their final response & that they will not enter into any further correspondence on the matter.

                              I assume I just ignore this for now...?

                              MBNA
                              Similar letter from them in rsponse to my final warning re harrassment letter on all3 accounts with them.
                              They also dont agree with my allegations and have again asked that a provide them with a full financial statement of affairs so that we can agree a repayment plan.
                              No mention of CCA / fulfilling their obligations though.

                              I assume I just ignore this for now...?

                              BOS

                              Default notice received re my Visa card with them.
                              If I dont pay arrears they will terminate account etc.

                              I will file as per others.

                              Hopefully my actions detailed above are the right ones.....just going to have a read up on final response letters though cos something is niggling in the back of my head that I need to do something with these.
