    Details of PPi Claim: With FOS. Bank have said 'yes' PPI is on it and also 'no' and are as confused as we are. FOS advised that PPI is academic anyway as if accounts are UE we should not have paid a penny back. This latter issue has created an interesting fuss therein.

    22nd June 2009: sent cca request (to HBoS in-house collection department, Blair Oliver and Scott.)
    27th August 2009: got reply from cca request
    21st November 2009: sent a SAR

    Notes:
    • This Preference account, is now being linked with fixed sum loan, in a letter dated 17 May 2010 by BOS.
    • is now assigned to 1st Credit Ltd.
    • Also ALL the HBOS accounts are subject to harassment investigation by FOS, which is separate to PPI issues at hand.
    • I cannot find any Default Notice in our files; however account has been passed to several aggressive third parties. I have taken money of some DCAs for their activities herein.

      • Although Santander (formerly GE Money) says this file was sold to them by BOS we cannot find any sign of a DN or Termination Notice to substantiate this allegation.

        History:

        4th June 2009: sent cca request (to HBoS in-house collection department, Blair Oliver and Scott.)
        4th March 2010: got reply from BOS from cca request, which held an agreement for a different account (PAID UP) which was a loan agreement.
        21st November 2009: sent a SAR.

        Notes:
        • BOS are claiming that this preference account is linked to a (PAID UP) XXXXX loan agreement.
        • No sign of DN and no sign of proper termination procedures in place.
        • Sold to DCA on 31/7/2012 – Balance given from August 2012 as being £1,XX2.5X
        • DCA now threatening legal action in a letter dated 22/8/2012.
        • Sent CCA request to DCA on 25 August 2012.
        • On 13 September 2012 we received a large pack of bank statements off DCA only and no agreement.
        • Account closed by DCA on 18 February 2013.

            Details of PPi Claim: - HFC has refunded (cheque to us)some PPI but we reclaimed past 6 years. HFC therefore offered more. We said it was only acceptable if they addressed the issue of the DCA they had sold it to.

            History:

            17 May 2008: sent cca request to 1st Credit Ltd.
            28 May 2008: got reply from 1st Credit from cca request. However, 12 June 2008 was when they sent their first attempt at an agreement.
            10 January 2011: sent a SAR to both HFC and 1st Credit.

            Notes:
            • "Formally assigned" (according to LCS Solicitors/1st Credit's letter of 7/5/08) to 1st Credit but I received a HFC bank statement seeking money for the ‘same’ account in 2010. Letters of complaints have been ignored.
            • HFC sent notice to file a default (not a DN) dated 25 May 2007. They sent a letter regarding SAR data dated 25 May 2011 to us. This admitted that they could NOT locate a copy of the legal agreement and that although they had issued a default notice they had no copy of it.

              Details of PPi Claim: Initially most confusing as the bank also closed a smaller account they had with us . The application forms were confusing and data did not match one with the other . However, this larger account is now with FOS.

                10 August 2009: sent cca request.
                18 May 2011: got reply from cca request from Cabot including an unsigned agreement.
                12th December 2009: sent a SAR.

                Notes:
                • Apparently assigned to Cabot although dates are unsubstantiated on 02.08.2007.
                • PPI claim against Citi now with PPI claims company.
                • Citi issued a Default Notice on 3rd July 2007. We think that the Citi DN is ‘invalid’ as it did not allow us the statutory requirement of 14 clear days to remedy any breach. It is dated 3rd July and gives us until the 17th July, which is 14 days exact.

                HAVE I GOT A SECURE PAGE (AS WITH OTHER ACCOUNTS) RE THIS CITI/CABOT FILE- IF SO I HAVE GONE AND LOST IT...?

                    Batman,

                    Right now the best thing to do really, would be to edit each post and confirm which ones you're claiming PPi on and which you're not.

                    I have added a section, please complete it or add N/A next to it and then update each post. Thing is, I am leaning toward sending off a new CCA again but right now it's mad cos you're all over the shop and with your reclaims in process, you've now wasted the last 2-3 years of SB time passed and also allowed them to reduce the balances, so really you may be best repaying most of these debts as you're gonna have 6yrs to go before they actually become SB now.

                    As I say, fill in the blanks in each of the above posts (the red parts) and we'll then come back to you....

                      Niddy many thanks - I shall fill in the red bits ASAP..

                      No worries about SB as we are quite prepared to wait and have made a fine art of dealing with sharks along the way...and have in fact taken money off several of them for their unwise/anti-OFT guidance activities against us.


                      On that particular point how is it best to address any letters from them so as NOT to affect SB again?

                      I mean how is it possible to answer any letter from either a bank or dca and not knacker up SB ???

                        Again - the FOS stated that it was not really worth us reclaiming PPI if the accounts are UE due to dodgy agreements...You have seen what they have Niddy.

                        So really, and I am talking about the main oppressor here which is HBOS, everyone is in a stallmate. FOS is tearing it's hair out internally over all this as one adjudication officer said one thing then another said something else. We are the pawns trapped in the middle.

                        What fun...


                        PS DCA calls are no problem thanks to Truecall and answering their letters used to be quite enjoyable too.

                          How much are they taking - can you break the agreement as we can do that for you for £0

                          NEVER pay for free services mate - deary me....

                          As for SB etc - you really need to sit back and chill and let things run their course as right now you're in a reclaim fight so let that finalise - although usually the funds will be added to the debt but sometimes they mess up and instead pay you via cheque - so lets see what happens with all the reclaims, in the meantime sit tight and update each post above as and when you get any letters (brief updates) and I'll then pop in and have a read along with other posters.....

                            Yeah I know lol - I was driven to a reclaims company on just the Citi one. This was because both FSA and FOS said they could NOT help us. Due to the age of it I think. I had nowhere else to go.

                            And yes, HBOS have paid themselves back PPI on all but 'one' (CL flog off)account. We have said the amounts are wrong as they have not included contractual interest but FOS of course agreed that the amounts are probably correct that HBOS have given themselves. All up in the air with them and also with the harassment cases they have on HBOS. I won't hold my breath.

                            Stalemate over the UE status too - hence me checking these with you for extra ass-kicking zapp lol .

                            I have referred to the accounts as 'IN DISPUTE' since we stopped payments (monthly tokens at that)due to the nature of UE and the serial PPI misselling issues.

                            HBOS is the main target - the others are more minor.

                            Thanks a bunch...I sure will add to these as you request as we go along.

                              Ok, makes sense - let me check all the agreements and I'll respond to each post with whether it is enforceable or indeed unenforceable - at least then you'll know where you stand right?

                              However for the moment just stop communicating, period. Writing letters is not an admittal of debt that would affect SB however a PPi reclaim obviously is

                              So those you've got any kind of claim with are now reset so avoid all contact now, check with us first before replying to anything - yea?

                              I'll check your 500 emails now and clarify the position of each of the 8 accounts above for you - give me a few mins....
