    ^^^^^^ Ok, valid points mate - however the templates themselves can also lead the debtor into difficulties as they are quite blunt and direct thus without really seeing the info that was sent, it's questionable regardless.

    But yea, each of these templates are similar with the addition of one para per situation so it's really not much difference either way! But I do see your logic shine through (somewhere)

    Lets not forget that SDG never sent out agreements until your first statement so not many people signed them and going on the dates of the account, I would bet my house that they do not have an agreement ergo the OP could just say feck off

    Well, this current agreement may have some prescribed terms in it, just nothing at all to do with what ones would have applied to the account.

    Which is why I was think more of emphasising that a copy of a current agreement, that may or may not contain PTs, is not acceptable.

    And that using that to mislead you into thinking an original might exist and is enforceable is unfair.

    While it may be more "technical", if you are going to bother responding at all then it may be best to make sure that whatever you send covers your situation and what they sent as closely as possible.

    Otherwise you just invite further rounds of letter "ping pong".

    Just my opinion though, being pedantic as I am.

    Yea, these will also do but maybe too technical as right now both fail with PT's thus I suggested this version: ---> CCA Query - Missing Prescribed Terms. They're all similar give or take a paragraph - so take your pick, any of these will be suffice to send off.

    That will remind them what they need to do, however you'll find yourself going around in circles but to ease your mind send one of those, to each.

    Have you checked your actual credit files yet? Have they registered these "defaults" there yet?

    Are you wanting to pay, but just have room to breath?

    Or if you already have the defaults on your credit files are you happy to just tell them to naff off?

    This is a civil matter and therefore no bailiffs can attend, similarly they have not fulfilled s.78 so let them bring court papers, we'll then beat them away for you - really, stop worrying....

    If you feel you want to reply to them all the time then you'll soon be skint - so weigh up the odds. Remember we specialise in this and you're in the right forum for help, but you need to consider some trust and read other peoples diaries - otherwise you will go awry, happens to the best of us....

    Ignore them, if they've failed your s.78 request which they have done - also, the worst they can do is default you, does that matter? If in other debt then it won't matter one iota. Also, they cannot enforce these debts, and their letters are total bull - none of what they say is true or legislation so seriously, forget about these idiots.

    Regards to defaults, we can sort that at any time but the system works one default per debt. Not per purchase....

    they always are - are you in any other debt? I would also cease repayments on both accounts and STOP calling these on the phone, they'll wear you down and lie, cheat etc to get what they want - your money!

    i have got into a bit of a mess with both these cat's, kays & very, i have been paying to NDR for both accounts for nearly 12 months. last week i sent off the request for Credit agreements with £1 postal order for each, to day i had default notice's yes plural 22 to be precise LOOKS LIKE PER EACH ITEM PURCHASED??? from just kays , what do i now, what happens next ????? i have telephoned them was no mention of the credit agreement request just that they wanted me to pay more than i can afford, i said i couldn't she said continue paying what you are but the account will be passed to a debt collector.
