    Not really sure where I should post this as it's not going to be UE and although I have touched on it in my UE diary didn't want to clog it up with this. Cloggy does a good enough job doing that without any help from me

    Anyway
    I owe WDA £960, when I lost my job spent a month or so arguing about how much i should pay them and settled on £1 per month even though they started off by saying min £10
    In Dec it was up for review and they wanted £5 but I stuck with it and stayed on £1.
    In early March I wrote to them asking for a 6 month break in payments, completely ignored , phone calls etc
    I made a formal complaint and today got an email from Richard King (even though they had a letter saying writing only not email!) answering some but not all of my points and for example only quoting the times they spoke to me not the 4 or 5 times a day they called.
    Anyway I have pinged it back to him with a copy of OFT guidelines on debt recovery (aren't I nice) and basically said come back to me when you have answered all the questions .

    Not sure wh i am posting this, just wanted a bit of input .
    I will say they have behaved better than the other pond life that are PDL's but floating on the top of this pile is hardly something to be proud of

      Funny you should ask that. A lot has happened since then and I do mean a lot and I had forgotten all about it. So far I have had no response.

      This one is totally separate from the ones in the thread payday loand hassles that Niddy pointed you to.
      As you are from Hull I do hope you don't have any wet cloths around you

          I have more than I care to admit and less than I could have. You reminded me so I checked. Alas they did accept a 6 month payment break which runs out soon. Will deal with that if and when. I have no money and no assets and little chance of getting a job for a while at least so....

            You mention that PDL debt can't be UE.

            But that is only in the context of the CCA 1974 you are referring.

            I would suggest that there are elements of law that would challenge PDL debt in other areas and also make them UE. The rare cases I have seen PDL get CCJ's its when they have got judgements by default.

            I think that when they are challenged they do not want to risk the court route as it could throw open a whole can of worms that could bring down the entire PDL industry.

            See my own UE thread. I have several PDL debts, not one has yet to take me to court (not wanting to draw the attention of the evil eye of course).

              Update. Yesterday received 5 yes 5 identical emails from WDA asking me to contact them as they haven't been able to collect payment as arranged. Please remember this is a very long standing account not a new one. I guess i should ignore for now. If i remember there are no silly penalty charges etc and i do not think a DN has ever been issued although i would not like to bet on it.

                    Jon - I would suggest that this on its own would be enough for it to be frowned on it court.

                    Consequently I seriously doubt it would ever get that far.

                      Jon - I would also seriously consider a complaint to the OFT. I know they cannot comment on individual cases, but they are investigating the whole PDL industry and an investigation of WDA's charges here would not go amiss.

                        SnV thank you so much, you know how things get to me
                        I have just been reading through my emails etc and yes there was an agreement to suspend for 6 months that ran out mid Oct there is also a letter from me expressly stating contact only in writing and not email. Tomorrow when I am more with it I will collate all the emails and lodge a complaint with the OFT.
                        Do you think I should respond to WDA, of course that means I have seen the emails and I said in writing only. I almost feel like sending the rizzle special which if you didn't see it basically said fuck off, if you have the balls make me BR but in a much nicer way.

                        Just to really piss me off the DWP have not only not paid my ESA today but not returned my phone call and my train was cancelled which meant I missed a really important appointment. Well things come in 3's

                          Well I decided to email WDA enclosing a copy of a letter I sent before that said in writing not email . Also said I rarely check my email and thus by chance came across them, please explain the £400 and also that i had a letter from them saying that they had breached DPA and OFT guidelines and they would contact me prior to the end of the 6 month suspension.
                          Also said I was considering a complaint to the OFT and i would get help from people much better able to make the point than I am and I pulled the mad as a hatter card

                          They have replied offering a final response within 4 weeks

                            Well today I received a DN from WDA dated 13th and posted 2nd class . In it they say I have until 27/11/12 to pay 965.50 or they may
                            1) Register a default (oh dear never had one of those)
                            2)On or after the date make a full demand for payment
                            3) May bring court procedings etc etc etc

                            Then it says
                            INTEREST PAYABLE AFTER JUDGEMENT

                            YOU SHOULD BE AWARE THAT IF WE TAKE YO TO COURT AND GET A JUDGEMENT AGAINST YOU REQUIRING YOU TO PAY US THE MONEY YOU OWE US UNDER THE AGREEMENT . YOU MAY HAVE TO PAY US BOTH THE AMOUNT OF THE JUDGEMENT AND INTEREST UNDER THE AGREEMENT ON ALL SUMS OWED BY YOU AT THE DATE OF JUDGEMENT UNTIL YOU HAVE PAID THESE IN FULL. THIS MEANS THAT EVEN IF YOU PAY OFF THE WHOLE AMOUNT OF THE JUDGEMENT, YOU MAY STILL HAVE A FURTHER SUM TO PAY
                            Do they mean that they will charge interest after judgement is entered ? If so I assume it would be at the statutory 8% . Is this right?


                            Anyway i am not stressed by the DN at all and it has been filed away with the envelope and date of receipt

                              Yes it'd be post judgment interest at 8% but don't worry about that

                              I'd ignore the fookers
