    May 8th 2012 - letter sent to Moorcroft, template for previous no CCA letter
    June 06th 2012 - Letter from Wescot demanding payment
    June 14th 2012 - Letter from Wescot - Final Notice - 10 days to reply !!
    June 15th 2012 - Letter sent to Wescot - letter prevuiously confirming no CCA, received before from Moorcroft
    August 31st 2012 - Letter from Wescott - Spreadheet type prints of name, address, job title etc
    October 12th 2012 - Letter from Nelson Guest Solicitors - willing to consider options or further recovery action will be taken
    October 12th 2012 - Letter sent to Nelson Guest - Account sold in dispute
    November 2nd 2012 - Letter from Wescot - same as letter on August 15th, spreadsheet of my name, address, work details etc ?

    Feb 13th 2012 - Letter From Barclaycard (via Apex) CCA Received, Niddy says
    Feb 14th 2012 - Missing prescribed terms letter sent
    Feb 25th 2102 - Letter From Apex, Disputing missing prescribed terms, sent to Niddy to check over
    Feb 26th 2012 - Final response - Unenforcable, (CCA sent) template sent to Apex.
    Mar 9th 2012 - Letter from Apex, recon agreement acceptable to them and no signature also acceptable ?. Advised to ignore.
    October 26th 2012 - Letter from Apex - Notice of sum of arrears
    Dec 28th 2012 - Default notice from Apex, unless payment made further action will be taken
    Jan 25th 2013 - Letter from Apex, Agreement terminated, pay balance immediately

      October 25th 2012 - Letter from Shoosmiths - Client has confirmed s78 request on 16th may, and confirmed in letter August 18th. fill in expenditure sheet to offer proposals for payment
      October 26th 2012 - Letter sent to Shoosmiths - CCA received, unenforcable
      November 2nd 2012 - Letter from Shoosmiths - regarding unenforcability and saying proceedings will be issued.
      November 14th 2012 - Letter sent to Shoosmiths, saying is it too hard to find a legible copy of the agreement to send me
      Jan 7th 2013 - Letter from Shoosmiths, enclosing agreement and terms, slightly clearer than before
      Jan 21st 2013 - Letter from Shoosmiths, contact within 14 days otherwise claim will be instructed
      Jan 18th 2013 - Letter sent to Shoosmiths(crossed in post with above) explaining circumstances and enclosing I/O sheet with pro-rata offer
      Jan 23rd 2013 - Letter received from Shoosmiths, saying offer unacceptable and requesting over twice whatt was offered
      Jan 26th 2013 - Letter special drafted by Undercover Elsa to send to Mint, with copy sent to Shoosmiths explaining offer was made pro-rata and should accept
      Feb 5th 2013 - Letter from Mint, investigating my complaint, will be in contact again within 10 working days

        June 15th 2012 - Letter from Triton demanding payment and also RBS saying they have met all aspects of the CCA request.
        August 9th 2012 - Letter from Triton Credit Services, notice of legal proceedings.
        August 9th 2012 - Letter sent to Triton, account in dispute with Royal Bank of Scotland.
        September 5th 2012 -Letter from Natwest ?. Copy of my last letter which was sent to Triton (account in dispute) with a covering letter
        saying the £1 fee has not been included and they also want a copy of my signature.
        September 29th 2012 - Letter from Green & Co solicitors, notification of possible court proceedings.
        September 29th 2012 - Letter sent to Green & Co - Sold in Dispute
        October 2nd 2012 - Letter from Green & Co - Account with them closed and sent back to Trition Credit Services
        November 12th 2012 - Letter from RBS - Do not condider account in dispute, contact FOS if not satisfied
        November 19th 2012 - Letter from RBS - Unable to come to suitable repayment plan, account passed to Direct Legal, will contact within 14 days
        December 4th 2012 - Letter from Direct Legal (part of Hillesden Securities), contact to agree suitable payment proposal
        December 7th 2012 - Letter sent to Direct Legal - account in dispute
        December 14th 2012 - Letter received from Direct Legal - acknowledgement of my complaint
        December 17th 2012 - Response to complaint letter I sent Dec 7th, do not consider themselves as harrassing, referred account in dispute part back to RBS and are awaiting a response
        Jan 2nd 2013 - Letter from Direct Legal, RBS have confirmed to them that they have complied to their obligations
        Jan 29th 2013 - Reminding me of letters sent previous, copies enclosed and to contact FOS if unhappy
        Feb 8th 2013 - Letter sent to DLC describing circumstances and enclosing I/O sheet with offer of pro rata payment

          This is the letter from moorcrap, when they eventually get a brain and send another do i just send the account in dispute one to the idiots ?

            Keep that letter (dated and stapled to the envelope it came in) very safe. They cannot take court action where there is no cca.

            You don't need to send anything back to Moorcroft. Just wait and see what they send next, if anything. They may just pass it on to the next dca in line.

                They can, and probably will, 'sell' this debt on but we have templates to send to the new DCA, so keep this letter safe. When anyone writes to you about this debt just post up a short summary and we will advise which is the best template to use.

                Just checking that you have now stopped paying this now as the last payment says 01 Jan 12.

                  Another of Moorcroft's idiotic templates saying "the Information Commissioner's Office has confirmed that whereas a debtor is not obliged to repay the amount due to the provisions of the Consumer Credit Act....."

                  Someone should tell them it's the OFT...

                        Sorry to ask this question, i know I should not. before I was introduced to this site I used to read posts etc of another site that deals in the same sort of things as you guys. CAG. Since finding this site I do not use it anymore but do have a question.

                        I know by reading the posts here that the UE route works, but still concerned that the other site says to go down the "drop everyone to £1 per month route", they did this with me. are there any recent cases of the UE route not working if they cannot produce a valid CCA and take it to court ?

                              Hi,

                              FP has pretty much said it all. However to bring this on to a legal level, the managing partner of one of the specialist litigation law practices in the country that are experts in consumer law and act for consumers says the following in the public domain:-

                              " it is perfectly proper that large sophisticated financial institutions should pay the penalties laid down in the Consumer Credit Act 1974 for not complying in full with the requirements of the Act. Those penalties being forfeiture of all of the benefits of the alleged agreement."

                              Or words to that effect. Also if the agreement inception date falls prior to April 2007 then in Law the court has no jurisdiction as such to grant an enforcement order of any kind.
