  • Oscars Natwest UE Diary.

    Hey up Niddy,

    Thought I would do this than hit you with a few PMs, plus it may help others.

    Bit of background (Niddy, you may recall).

    CCA sent long time ago, October 08 - onky sent badly photocopied T&Cs. Didnt chase up at time and continued to pay ;D . Anyway, stopped paying them in March as couldnt afford it, and knew it wasnt registered on credit file (pre DPA), considered as had one default, one more wouldnt make much of a difference if they did manage to put it there (in light of McGuffick).

    Anyway NID, after your recommendation for a letter - demand for payment to/from Triton (aren't these inhouse?) for full amount - which they state is £2709.xx - and about £50 higher than at default or account termination stage.

    Am I right in thinking I can blag it (as not CCA'd Natwest since above) with this - viewtopic.php?p=1501#p1501.

        why matey - what happens on 21/22 september?

          10 loans/credit cards - 3 confirmed UE, 3 recon/copy received, 3 not received a CCA reply, 1 might be enforceable

              So i'll ask again, what is so important about 21/22 september? So what if that is the date of CCA expiration - you ignore them afterwards as it then becomes UE until they respond, so really you forget it now til they write to you again..... ;30 ;30

                Ok, quick update. Letter recieved from Triton (RBS/Natwest inhouse).

                They "refer to previous correspondence... remain dissappointed ... have recommended legal proceedings ... this may involve a CCJ .... may become public records ... may adversely affect credit file"

                Should it remain unpaid.. they will:

                "apply for visitation, gain a charging order, take money direct from employer, I will have to attend court and give a financial statement under oath"

                Of course I have the usual - "we would rather you contact us...."

                SO..........

                File (under R for rubbish or U for utter tosh) and wait for further response, or write a response?? (they still havent returned any CCA which of course they would need for a CCJ for starters)

                    Well, had a convo with Triton today, only brief. Know its not recommended, but can be fun.

                    Young lad obviously didnt know what he was doing from all the umms and errs .... confirmed very basic security.

                    Didnt have to ask about my letter, he asked if I had received the banks response (which was allegedly sent yesterday - only two months late then) - no. So account is now on hold for 7 days. Apparently bank have stated in theor letter (in the last paragraph so he was telling me) that when I recieve the letter, I am OBLIGATED to deal with triton!! 1 ;LOL

                      Haha - you are not obligated to deal with anyone unless the bank, triton and you agreed to assignment. I sincerely doubt that in which case you deal with the lender and if they try and take action you then show proof you did send letters and responses to the legal account owner....

                        Got the response (from Natwest Complaints) matey from the above letter ..... quite amusing...

                        "My understanding of your complaint is that you feel our request for payment via agents breaches CCA (1974). Please let me know if you think I have misunderstood or missed anything"

                        Think you have missed quite a bit....

                        "I have investigated your complaint and confirm that we provided you with the all relevant documentation in response to your written request under s78 (1) of the CCA in October 08"

                        What I got was four badly photocopied pages of generic T&Cs appearing to be linked to more that one account - not really legible at all and a current statement (at that time)

                        "...As we have not been received any payments toward this account since March and we have been unable to negotiate a suitable repayment plan, you must cooperate with Triton Credit Services direct"

                        lol ...

                        Of course I then have the usual "referral rights"

                          Hmmm, so they think you can only have one CCA now do they? If you request another then they will respond - simples..... Muppets really, what a joke! Mate, just ignore it and see what happens next.

                            Mate that was the above letter (threat-o-gram? one).... I sent a request for the CCA 7 September .... to which they never responded ..... but they did cash the £1 cheque...... That was the formal request (S.78 letter) - the one that also mentions S175 and S189 and CPUTR.

                            As letter clearly states, the funds are not to be used for anything else ..... so wonder what they were used for if they dont want to supply the documents.

                            Incidentally, I would email you the "T&Cs" but the are so badlt copied/microfiched that all you would get is a page of black splurge

                              Dude this has confused me now lol. Ok, as things stand they are in default of your CCA request made in September therefore they cannot take formal action and as you have previously sent the threat-o-gram letter you need to sit and wait - ignore this for the moment.

                              Hope that explains it - please stick to layman, I don't remember the history (eek) cos i've just updated 50 threads in the last hour y y
