    OK, goal is to pay everyone off, but I know that's seen as "bad" - lol. I've used unenforceability a little as a delaying tactic more than anything, so I guess I need the hard sell from Niddy!


    I have no bank account at the moment, and I have an RBS account I would like to use as main account. Obviously not going to at the moment, due to the risk of MINT debt being offset. But MINT are no longer accepting applications and rumours they are being sold. Would like to keep my eye on this to see if it might affect their offsetting allowance?

    Stopped paying, waiting for them to decide on a new DCA and will CCA them then.

    Completely ignored letters as kept getting transferred to different DCAs; now with MKDP and received CC claim 1st May 2014; will acknowledge and send a CPR 31.14 in the next week or so, and CCA them, and defend.

      Account owner no one is writing to me at the moment or for some time. I do get the occasional (once yearly) statement from them to my old address.

      October 2013 got a letter threatening court from MKDP

      Sent CCA request

      24 October 2013; got a one page copy of agreement and statement of account - sent copy to Niddy.

            Jan 2011 - Halifax through Iqor sent me a copy of my application form, not my agreement (thanks Niddy).

            Sent letter to Geoffrey Parker Bourne (on behalf of Iqor) Threat by Lender/D.C.A - To commence litigation

            Sent iQor CCA Query - Application Form Received

            4th Feb: Received back a letter from Geoffrey PB: "Thank you for your letter of 21st January 2011, the contents of which we note. We confirm we are taking our Client's instructions."

            2/1/12 Received final notice from Westcot.

            11/1/12 Sent Account sold while in dispute letter

              Feb 2011 CCA'd - standard letter, no response yet (sent last week)
              11 April 2011 (letter dated 30 March 2011) - Cabot attaching documentation - Niddy have scanned and emailed you - think it's just my application form plus some standard terms.
              18th April - sent "application form not agreement letter"
              16th May 2011 - received letter (dated 6th May) stating that the paperwork they sent me was indeed a signed copy of my original credit agreement; again they're still referring to the application form.
              16th May - sent Refusal by Lender/DCA - to accept Unenforceability letter

                Account owner unknown - will check my paperwork for last letter but it was ages ago.

                March 2011 - Arrow Global sent a letter they now own the debt and have assigned Moorcroft to collect.
                28 March 2011 - sent CCA.
                5 April 2011 - Moorcroft have sent a letter acknowledging receipt of a £1 payment. So they have used it towards the balance rather than for CCA request. Is there a template letter to reply back to this?
                April/ May received several letters chasing re doorstep visits. Sent no doorstep letter
                13th May - sent CCA final response (no response from DCA / Lender past 12 days = unenforceable)

                    Iqor on behalf of Halifax for about £4k - I sent the initial letter with postal order on 15th November 2010. Received a pack of statements last week but no contract or agreement. Need to respond - what do I send??

                        Ok, so I am thinking of sending f+f offer letters offering 20% to all creditors excluding Nationwide (no way enough to think about them for a bit), and Santander (not passed to a DCA yet) in the hope that they're all with DCAs and have been for years - they might accept?

                        Putting aside the unenforceability route for a sec - whaddya think?

                          Not wise - you know my thoughts on this. You're throwing good money away that really, you ought to be saving in case any of them try and take action against you. If you wish to attempt F&F then you need to follow a set formula as detailed here: ---> F&F Offers Explained

                            Thanks Niddy, I know. I don't think it's in me to keep up with all the letters and hassle to be honest. I've always been working towards paying them off but certainly paying as little as I can get away with

                            If I use the breakdown on that link, it works in line with offering them all 30% give or take of the total debts, so fingers crossed will start sending letters off to all bar Santander and Nwide tomorrow when I have their addresses etc (left them at home doh).

                            Am i right in thinking the f+f template is just a little friendlier than the default removal f+f template but achieves the same ends?

                              Why don't you drop the sum you have available by £2,000 to lower the percentage of offer as you always start low and increase it as you go along......
