    Hi,

    I am a newbie, I heard about this forum from another friend who said everyone was helpful. I have requested for my credit agreement for my bank cards which I recieved yesterday. It seems to be the one I signed. I am not sure what the next steps are (?) as in what do I need to check. I was trying to access the example letters as I thought this would help but I could not because I have to post before I can.

    Hello everybody,

    Just a little about me, I was made redundant in 2008 and I had a few contract jobs since that time but not for long. I then started living on credit to make ends meet as could not find a permanent job to such an extent that I am ashamed of getting myself into debt now :cry .

    A friend recommended that I use this site rather than credit companies that claim to wipe of your debt. After reading a few diaries I am relieved that I am not alone and still unsure of what to do. I have no savings left and in despair absolutely terrified of debt collectors coming knocking on my door.

    So far I have requested the CCA's for all my credit card agreements.

    I have the following debts:

    Overdraft - Natwest £300.00
    Credit card - Virgin £2,100.00
    Credit card - Natwest £2,500.00
    Credit card - Royal Bank of Scotland £5,300.00
    Loan- Halifax/ Bank of Scotland £9,000.00


    This is going to be a long journey, thank you in advance to all that help me.

      Thank you so much, I will scan the copies of the CCA's I have received so far and I will email them across to you shortly and explain my situation.

      I will also start a new thread, I am in complete despair at the moment coming up to Christmas and very ashamed really for letting myself get into this mess :cry !

        Hello and welcome Jade,
        Congratulations on making the first step to sorting out your debt problems.

        Take a look here - viewtopic.php?f=49&t=9

        This will guide you through the process of starting your diary and how to list the individual accounts that you are having problems with.

        If there is absolutely anything you are unsure of just ask or PM any of the mods here.

        Now don't be worrying any more. We have all been where you are today, and I promise you will receive the very best help and advice available here.

          Hi Jade, and welcome to AAD.

          We will all be here to help and support you. One thing I would add to allands post above - if you haven't already done so, open up another bank account with someone with whom you have no other financial link. This is so that you may have any wages / benefits etc paid into it, and your creditors have no right to touch the money in it.

          It will be a long journey, but please, don't be scared, we are in this together, and you'll soon learn that the "debt collectors" are just a bunch of muppets, with less power over you than the milkman!

            Hi Jade,

            It's great to have you on board!

            One thing to remember is that, sadly, there's no quick fix but we're all here to help if we can and if we can't (i.e you can't expect everyone to be great at everything ) there will always be a shoulder here for you to unburden yourself on.

              I honestly didn’t have a clue where to start after reading other threads I do feel relieved. I have tried opening a bank account with Santander last week but they refused me – I have not been able to find out why! I will try elsewhere after Christmas if they still not happy for whatever reason. Thank you for your support and kind words as I am going to need it!

                Try the co-op bank - I've never heard of them refusing anyone

                  Have you been defaulted on any of the credit cards you mentioned?

                  That could be why, you should try for a basic bank account with Barclays or the Co-op.

                    I don't think I have but I have been late in making the minimum payments for the last 3 months on all my accounts as I have been juggling to pay of one or the other to a point where it has become a complete and utter mess could that be the reason? I will try Barclays - thanks

                      Wow I am really impressed, I was not expecting such quick responses all in one day thank you Angelic and Swanfan I will try both banks after Christmas. I really do feel much better now

                      Just a quick update:

                      Overdraft - Natwest £300.00 - I agreed to pay back by February 2011.
                      Credit card - Virgin £2,100.00 - Received CCA emailed copy to never-in-doubt@live.co.uk
                      Credit card - Natwest £2,500.00 - Received CCA emailed copy to never-in-doubt@live.co.uk
                      Credit card - Royal Bank of Scotland £5,300.00 - I bank with RBoS so I am going to change bank account as my credit card is tied in with this account then will request CCA
                      Loan- Halifax/ Bank of Scotland £9,000.00- would like to settle with final payment, how shall I proceed with this?

                      From next month the loan and credit cards will be in a default status

                        This is, unfortunately, enforceable as you applied online and confirmed authenticity when you ticked-in-the-box. Not much we can do with this i'm afraid - you should be arranging some kind of repayment plan with these i'm afraid.

                          As you're skint, i'd be prone to blag both accounts above. If you wish to attempt this then simply respond to both MBNA & Natwest with the following template: ---> viewtopic.php?p=1503#p1503

                          Bear in mind all I can do is advise, what you decide to do is up to you.. Worse case, they could ccj you! Not the end of the world, and no - its not a criminal offence in any manner either!

                          One final point, blanking out the CCA means i'll always say they are enforceable. Sorry, but hiding the key components that I check is like taking an alcoholic to a tea party! Not much use really..... I have enough people on here to back me up, ie my integrity.

                            Thank you for looking at my CCA's, I did not really hold much hope going down the enforceable route after looking at other copies of CCA my copies seemed up to date compared to the unenforceable ones.

                            In all honesty I don't mind if I do get defaulted or a CCJ but I was hoping to offer a final settlement.

                            Could I do this, after I have gone down the route of ‘blagging’ it? To see what happens then come to offer a final settlement? Would this put me in jeopardy in anyway? Only reason I ask is because I am not working at the moment and do not have a steady flow of income to stick to a payment plan.

                            I don't doubt your integrity for one second after reading other threads you’re a hero . (Sorry I was a little apprehensive as my ID's were stolen in the past, I will send my next CCA as to your requirements)

                            I am happy that I am doing something about this and not letting myself get into any more debt than I need to.

                              Ok regards to blagging it, this is why I suggested this course of action. Basically i'd look to blag it, wait til you get defaulted and account sold to a DCA and then we can look to haggle F&F offers. Right now the lender will refuse any such offer, as they want full payment - they always do!!
