    CCA request help please......I sent a cca request to Fredrickson re a debt they are supposedly chasing. Received a reply outside the 30 day period from JD Williams for an old debt with them which is made up of their charges etc. The original debt itself has been paid the rest is charges. This is going back to 2003.

    This is JD Williams response to CCA request which they have now told me I need to contact Fredrickson regarding future payments.

    "Please find enclosed a reconstituted "True Copy" of your credit agreement, along with the current terms and conditions applicable to your account, to which you have agreed. (No signatures!)

    We have also enclosed an itemised breakdown of the account dating back to March 2005

    When responding to a section 78 request, a lender does not have to provide a photocopy or other literal copy of the executed agreement nor provide a copy bearing or some other proof of the customer's actual signature.

    In response to your futher comments we would advise that there is no legal requirement to provide you with a copy of the deed of assignment, notice from the assignee, JD Williams, is sufficient under the Law of Property Act 1925 to require you to pay the assignee. This would not carry your signature, as depts are freely assignable without this."

    Advice please as to where i go with this now as i am totally confused as to my next step in view of above. Fredrickson are constantly ringing my phone which i have now taken to ignoring. This did stop when i sent in cca request but has just recently restarted again.

      This is a standard response from creditors/dcas JackBoy.

      Read the link given by in2deep, let us have more information and then we will know how best to help you rather than just giving advice without knowing all the facts.

      In the meantime you could send this letter to Fredricksons.

        And now today......I have received a letter from Bryan Carter Solicitors......

        "Payment must be made in full within the next fourteen days failing which we will recommend to our client that proceedings be issued without further notice.

        Should proceedings be issued, additional charges will be added to the existing balance.

        Before the account is referred to us to litigate you still have an opportunity to contact Fredrickson International Ltd with your payment proposals. In order to avoid further action you should telephone them immediately.

        This is a serious matter and you may wish to seek independent legal advice."

          we need to know more about the debt Jackboy then we can help. We need to know dates, taken out, last paid. when you sent the CCA and what letter did you use and what did you get back. It really needs to be uploaded to Niddy so that he can have a look.

            Okay...I.ll get that done....new to all this....assume that i need to scan documents, save and then send through via the link?? Wont be able to do this until at work as dont possess scanner.

            Sorry, just really worried now. Thought i was doing the right thing sending CCA request and now been hit with these two letters.....

              try not to worry, most of these letters from DCAs like Freds are bluff and bluster, but some are not, so if you fill us in with the circumstances, you can help us to help you

                Right I'm off for two weeks now; we asked you to provide info for a reason - so we can help ease the hassle and stress. If you don't do as we ask; you may as well roll over. Read the diaries; search forum for "Bryan carter" - 4 other posters got this EXACT same threat this week. Coincidence or have you heard that you can pay £10 and get a solicitor signed letter? Well you can!

                Send this to Bryan carter - they WILL respind saying it should have gone to the creditor and not them; however as a gesture of goodwill they'll forward a copy on for you. It's so predictable my sides hurt with all the laughter...

                Now, can you respond with the following answers ASAP please...

                Requested Information for UE Process

                If you're thinking of going down the UE route, then before commencing a diary please read the following information as it will help you to help me, which in turn means you'll get responses faster cos I can follow your progress with ease - the more complex you format your diary, the longer it takes me to respond cos I leave them til the end of the day when I think i'll have time, sometimes these sit unanswered for days because I struggle to find time.

                Sending your Agreement to Niddy

                To help me, to help you, please provide the following information for each account:

                • Type of account (credit card/loan)

                • Date commenced (ideally before Apr 2007)

                • Approx balance

                • Date last paid (approximate date you last made a FULL payment)

                • Are you on arrangement or not paying

                • Status (default/in arrears/up-to-date)

                • Account owner (who is writing to you, a DCA or the lender)

                Providing the above information, for each account helps me. Then, when you start the process lay your diary out in a format like this example
                All you have to do is read down, you'll see Pixie has placed each account in its own post with updates in colour under each so when she updates these, it is easier for me to spot any changes and advise accordingly.

                When you get a CCA back, then email me
                (see here: ---> Sending your Agreement to Niddy) enclosing the agreement and any accompanying documents. Please do not blank bits out. When you email, put one account (or CCA) per email and ensure your site username is in the subject line so I know who it is. I usually reply to all emails on here. If you do not have a diary then I will not respond to your email.

                  Sending that template above buys you another month so I'll check in when I'm back from hols. You'll be fine; just trust us and do as we suggest for best resolution....
