    Afternoon all!

    I've been lurking on here for a while, but thought I'd better post because I could use your help!

    I have an old Halifax credit card debt of £5550. The card was taken out back in 1998. In 2007 I lost my job and had to go onto reduced payments, and the card was defaulted in 2008. The account was passed to Blair Oliver Scott, then Iqor in 2009. At that point I CCA'd them, got nothing back,stopped paying them and apart from a couple of letter from Robinson way in 2010,I heard nothing.

    However, last November, I started getting calls and letters from 1st Crudit. I received a notice of assignment from them, then steadily more threatening letters from their solicitors. I CCA'd them in January, then in mid Jan received a letter from them saying they'd go back to the original creditor to get the docs, in meantime they'd put the account on hold.

    Anyhow, I've received nothing back, apart from a steady stream of letters, and today I got one saying they are going to pass to Connaught Collections unless I respond....grrr...

    What should I do now? I didn't send the 12+2 letter. Any help appreciated!

    If you CCA'd in January and they agreed to put on hold then they're in breach of OFT Guidelines on debt collection - however for now let them pass it to connaught and then give us a shout and we'll clarify what to do next.

    Do you have proof of cashment of the £1 (for the CCA in January) and also proof of postage for the CCA Request?

      Wow, cheers for the fast reply mate!

      Umm, no I don't have proof, I sent the £1 postal order not cheque, and I'm not sure where the registered post stub thingie is. In the words of Homer, 'Doh!'
      I've kept the letter they sent afterwards saying they'd put the account on hold. Should I send another CCA to be on the safeside?

        So when you got the PO they gave a receipt with it right? Has this been cashed or have you not kept the records?

        I would leave it a few days and keep us updated as and when they hassle you.....

          No I didn't! I'm normally good at keeping records, guess I got out of the habit.

          I'll wait and see what comes next then. Many thanks for advice!

            I've just checked my credit file - the entry relating to the Halifax card has disappeared!
            I assume it will appear again, but will show 1st credit own the debt now..

                  Evenin' all!

                  I've just received a letter from Connaught Collections,saying as they are not aware of any reason for payment being withheld (umm, what about my CCA), please cough up within 7 days, etc etc.

                  Should I ignore, or remind them I'm still waiting for them to provide the CCA?

                      Hi, since early January - they (1st Credit) replied a few days later and said they'd put collection activity on hold - since then I've got a load of letters and calls from them, and they've passed it down the corridor to Connought.

                        just hang in there, bear in mind it could be a long wait, we've been waiting for some of ours for nearly 2 years.

                        check the letters and let us know if there is anything that may need replying to, a quick wee resume of what you have received since you sen the CCA request will keep you right

                          Great!

                          Just got a letter from Connaught saying they are returning the account to Halifax! Even though it was fully assigned from Halifax to 1st Credit. They said they would return the account with a recommendation the Halifax go for a CCJ or doorstep visit.. thought that was Connaught's job!

                            As the s78(1) request has not produced any documents, s78(6) applies and, until/unless they do comply with the request, the agreement remains unenforceable.

                            They do not need to honour the request before they send a numpty to see you but, then, there is bugger all a doorstep wallah could do.

                              Typical Worst Crudit and CONnaught. They're brilliant at making threats and useless at carrying them out.

                              Their favourite pastime used to be issuing Statutory Demands when they had no intention of suing for bankruptcy. I don't know whether they still do that or not but I know they had a warning from the OFT (why is it always warnings and never bloody action?)

                              The Hellifax obviously don't want to deal with this or they wouldn't have farmed it out in the first place. I suspect it will just get passed on to another useless DCA and it might even go on a sight seeing trip around several of them before it goes SB.

                              As for the CCA letter and the one pound, the reply saying that they would ask the original creditor for the documents and put the account on hold is obvious proof in itself that they received it. If you want to, you can always send another request to the next DCA just so you can keep accurate records, but you don't need to.
