  • IF (HBOS) rejecting payments what next?

    Hi All

    I make payments to blair oliver scott for a defaulted credit card, Payments are made via online banking. However a couple of days ago the payment was bounced back to my bank (intelligent Finance) as rejected by recipient. This is how the court process started with hsbc a year or so ago, so I expect this is going to be the same.
    Question is do I phone them and find out what is going on or just wait for correspondence from them.

    Brief history:
    in my opinion the DN is faulty, the recon that came with cca request was probably not good but received another that is probably good with the SAR.
    A couple of years ago on the back of what I thought a dodgy DN I did rightly or wrongly send a letter of unlawful reccission to IF informing them that the installments I was paying was towards the arrears at date of Default as that was all they were entitled to.

    What can I expect now from Blair, straight to court or skinned alive.

    BOS won't take action (spineless twats) - if you've been paying then ring and ask why it bounced?

    Get the answer from the horses gob then let us know please.....?

      Thanks for a quick reply, my initial reaction was to phone but I thought I should ask here first, as general rule is not to speak to DCA's only written communications.
      I have resent the payment to see if it bounces back again, so if it does I will phone them. Oh happy days.

        Nice one keep us updated.

        Obviously when you call first thing you say is "hi just to let you know this call is being recorded; ok"

        That makes them talk normal and alleviates the risk of them trying it on. All you'd be saying is "why has payment rejected". If they ask other things just reply with "please answer my question as that's all I'm ringing about and remember I'm recording this call"

          You are so devious, you've done this before

          I do record calls, I usually make the statement when their recorded crap says that they record for training purposes etc, I usually say words to the effect that I also record all calls for clarification.
          If anyone is interested I use an Olympus voice/dictation machine linked to the phone line works pretty good and can download the voice file to the pc for storage.

          Will keep you informed.

              Thanks, I know what you mean. take what ever means required when dealing with the scum bags. But be led by their good example and be honest

              They had the second attempt at payment yesterday before noon by faster payments process, and it hasn't bounced back yet, We'll See

                Well just checked my online banking and it shows that the second payment that I sent has not been rejected.
                I suppose I could give them the benefit of doubt, and assume it could have been a glitch in their system, or it could just be as Niddy said

                BOS won't take action (spineless twats) - if you've been paying then ring and ask why it bounced?

                  Well received a letter from Cabots yesterday seems they have bought the account from Halifax, this happened early in August but only just informing me.
                  In the envelope was also a letter from Halifax informing of the Assignment to Cabots.
                  the letters stated different amounts owing only small but equal to 6 months token payments so I wonder was this all set up 6 months ago? The last payment I made was forwarded from BOS to Cabots.


                  The advice I need now is do I now SAR Cabots and see what paperwork they have if any and see if it is enforcable, or do I phone them and carry on making payments ( they will want more ), or at what stage should I be looking at negotiating a small percentage F&F

                  Any comments appreciated

                    wait till they have sold it then you can try and negotiate with the DCA..... However if you're paying monthly amounts (why??) they'll probably refuse. It weakens your stance.

                      Cabots have bought the account so the letter says, I'm making small token payments on all my cards have been since 2008. Thought was what I should be doing.

                      I thought that if nothing is paid then its fast track to court and CCJs etc.

                        No that's not quite right.

                        Cessation of payment to then come in with an offer is the way to play to play the game but of course nobody can predict what the dca is going to do so it's always a gamble BUT it gives you the upper hand in negotiating settlement.

                        Usually 3 months of no payment promos a good settlement - but you can try an offer now if you have funds to settle..?

                          I think you may be right cease payments and see what crap comes my way. can't offer much as F&F so it would be refused anyway.
                          Should I also SAR Cabots to see if it is in fact unrnforcable.

                            A SAR doesn't do that

                            If its post 04/07 then it'll be enforceable

                              This account is from Oct 2005.
                              I am going a bit loopy cos I allready did a SAR back in 2009/10 and got a copy of CCA its a4 size with information set in 2 columns with my sig and date.
                              The default notice allows 14 days from the date it was written which was a Saturday, so that is lacking in itself.

                              A SAR doesn't mean anything to me, I could do with a crash course in banking gobbledgook.
