  • Why Won't Barclaycard Default Me ?

    I have 23 creditors and they've all defaulted me except Barclaycard (3 accounts). What's with them? They haven't had a penny from me for over a year, and only £5 a month for the two previous years. I'm well over the limit, missed payments, in fact my account conduct is shamefull. So you'd think it's common sense that I may just have defaulted on my credit agreement (if there was one obviously). Methinks it's because they like heaping on interest and default sums each month. But could there be some hidden agenda?

    I want them to default me so the six year clock for CRA listing can start ticking. Don't I?

      Trying to extend the Statute Barred scenario. Took 'em a year and three months or so to actually default us after the defective Mercers DN had been issued. Then sent a letter of apology for the inconvenience this has caused us claiming this would be the case.

        Well in that case they're just being silly. If they checked my date of birth they'd figure out that they're probably going to have to get in the queue at probate time if they dilly dally much longer!

        Do you know whether anything 'official' happens when you are formally defaulted in paperwork terms? I can see the "date defaulted" from CRA entries but this is often some months/years after I received the DN. Are creditors obliged to tell you when they've defaulted you? In fact was does being 'defaulted' actually mean? Just a black mark on the CRA file or the end of the contract terms?

          Its just their own stupidity IMVHO. The clock starts at the point of the very last payment or acknowledgment by you of the alleged debt. I think its all a ploy hence the activities of the likes of Lowell who have used CCA s78 monies by paying it into the account and then claiming that you have made a payment on the debt. Or falsley claiming you made a payment just prior to SB.

          The problem I see is that the default entry can stay on your file for six years and the later they do it the longer you are trashed. It then becomes another battle to get it removed. This is a contentious issue and I'm sure one of the DN experts will be along to throw more light on it.

            Wish we had a Barclaycard mole on here to share the company's policies with us . . .

            My next question is why won't Barclaycard terminate me? The only creditors who have terminated me are the ones who have sold me on. I'm thinking this means I have to be terminated before I can be sold. So the ones who have sold me without a Termination Notice have messed up? I guess you can't terminate someone retrospectively.

              Surprising scenario. BC are a law unto themselves. Normal procedure:-

              Mercers defective DN in red.
              Threat and demand for monies not yet due from Calder Financial.
              Demand for payment in full for outstanding balance from Calder Financial
              Both of these latter constitute a termination which they cannot take because of the defective DN from Mercers. Both of these companies are actually BC in house wholly owned thuggery. Mercers is a dormant company (ref Companies House) and all of their current activities are unlawful under the Companies Act 1986 and amendments and Companies House regulations.

              Next step is out to a round of DCAs who do not own the debt in Absolute so they cannot enforce anything in a court of law from their own volition. BC are slow to sell on but will try anything else to bring you to heel.

              They cannot terminate until they have issued a fully compliant DN. However the SB clock is as I stated and not when they finally get around to recording the data with the CRAs.

                Just to add from Garloks earlier post; under the FOS guidance a default should ve registered BEFORE 6 months. I am arguing the same with my HSBC problem as I've gone from paying on time to instant default lol. They're soooo gonna regret that! Point is with my case; it's way too soon - even before a formal DN has been served. Over the weekend I'll finish my 67 page dossier on HSBC and their breaches so you can gleam info from this if you want as I'll be going into great detail regards this ILLEGAL default

                Mine is the reverse of yours but the same points apply. They should have defaulted you within 6 months of no payments or acknowledgement being made. Ideally after 3 but definitely before 6 months have passed.

                    Gawd, I'm hurt and insulted, ex Barclaycard staff indeed. l

                    I've been in some pretty awful places in my time but living under a wet stone I don't think is one of them

                      Haha!!

                      I watched their new tracker mortgage advert and changed the man to bob diamond (in my head) and watched them pulley right off the edge - into oblivion.... Then woke up to my alarm "wake up it's a beautiful morning, you're not a banker and so feel so fine..." (hum the tune)!

                        Hey-- have a good careful listen to that mortgage advert---- its a complete CON! How can a fixed rate mortgage be a "Flexible" mortgage.

                        Just how many innocents have been conned just because its on the telly?

                              Thanks for the tutorial Garlok. You're right to be cynical with Barclaycard! So let me see if I've understood this: If I fail to do whatever the DN asks me to do in time then I am automatically 'Defaulted'. The creditor should log this with the CRAs asap. Can I compel them to do this if they don't? I'd like that because that means 6 years later the whole entry gets removed from the CRA regardless of my performance after that date.
