    Hi Everyone!

    Glad I found this site.

    My oh has finalised his divorce earlier this year and now the fallout begins.
    Credit files gotten-

    Default April 2012 - Tesco Loan - credit agreement June 2004 - £3374 - still in house with Tesco
    Default July 2011 - HFC Bank - laptop loan - £148!! (I know!) credit agreement 04/01/2008
    Default July 2011 - Northern Rock Loan - credit agreement Nov 2011 - £9356
    Default June 2011 - Lloyds TSB - current account overdraft £5530 account says it started in July 2009 (nearly a year after separation) but joint account opened in 1995 with ex wife.

    After essential outgoings he has £300 left to service his debts and thats with us on an interest only mortgage at mo.
    Luckily I make enough for us to socialise (and save on my part)

    We want either DMP/help/advice/what best steps are?
    He has acknowledged these debts recently as he attempted to set up self managed DMP but finds he underestimated his outgoings.

    The only Credit agreement we have is the one for Tescos.

    and no- his ex has no intentions of contributing towards the joint debt, run up by her and her alone!

      Hi

      Acknowledgement means making payment, traditionally.....

      If he has not paid then it won't be acknowledged....

      Regards the actual debts, can you clarify the exact start date this is the most important element....

        joint debts (ie bank account and/or loan) will be due by either/or so he could just 'vanish' hence leaving the ex open to repayment.....

          Exact dates (from Experian report)

          (MackHall pursuing) HFC 04/01/2008 £138 default balance default entered 30/07/2011
          (AIC pursuing)Northern Rock 10/11/2006 defualt balance £9356 default date 27/07/2011
          Tesco 02/11/2004 default balance £3374 defualt date 02/04/2012
          (wescot pursuing) lloyds 01/07/20069 (must have been when overdrat was extended by ex but he did not consent to this) default balance 5530 date 07/06/2011

          He reclaimed the charges from lloyds citing hardship and received a cheque for half of 1800 last year.

            Well luckily the smallest debt is the newest which is not eligible for UE - the others however are.

            I would be sending a CCA to each lender excluding the £150 one.

              I already have the Tesco one, he reclaimed PPI on this late last year.

              I think he wants to settle the HFC asap, but would like to attempt negotiating the default off his file.
              Does he even have a hope?

              If any of these are unenforceable then what does he then do? nada?

                Defaults will never come off, anyway having one is as bad as having 21..... it's a guarantee that they will not agree. Tesco do not entertain such thoughts, so forget default removal...

                    I suppose then he will have to live with them, for interests sake mortgages will have to be taken out in my name only so ho hum.

                    What do I need to look for on the CC agreements then? I hav the Tesco one in front of me.
