  • SAR personal data/insulting!

    Right, didn't know exactly where to put this one, but it's in regards of some sensitive wording on some SAR Data.

    I have actually put some of the paperwork too safe, but it was when we made a complaint via PPI - Nemo Personal Finance.
    Looking through the paperwork there was personal comments made by the staff at Nemo that had nothing to do with the loan.

    It all started when we were in application for a loan advance with Nemo and my beloved now deceased dad was forever back and forth in hospital, so the loan advance had therefore taken longer to process.

    Nemo had left messages on our phone to call back where we didn't always have much time to do so, because of being back and forth to the hospital on many occasions.
    At the same time we were taking my son for specialist appointment for his assessments due to autism, so he was also having some time off school for that to attend these very important appointments.

    Anyway, when we did contact Nemo we explained all the above had taken up our time and we had not got round to dealing with the loan advance (not that I should have to explain myself to them anyway).

    Anyhow, in time, going through the complaint of the PPI later on, we requested for a SAR, there were wads of it and the comments made were not nice.
    I know it may be me being oversensitive but surely they should have not enclosed this on the paperwork for us to see.

    They made comments about "their autistic son should be at school, no wonder he's the way he is", and comments about my dad forever being in hospital, saying more or less we were making these as excuses.

    I have to be honest, I was deeply hurt and felt so angry with the comments, but did not have the energy in me to complain about this at the time with lots of other stuff going on at the same time.

    Am I overacting on this, or should have I had made a complaint, there is also more, but I will have to find the paperwork.

    woah - this is strictly forbidden within DPA as they should only add notes relevant to the actual content - personal comments are not allowed as their opinion doesn't matter a jot! .... this could generate a lot of compo especially as your dad is no longer with us.

    I'd look to speak with paul (again)....

        Not sure of the legal implications, but surely they should not have done this. And how stupid to let you see it!

          Thank you folks.

          I had not got round to dealing with this side of it before, as many of you know I lost dad last year aged 69 and he was very poorly for a number of years.

          I will start digging for the paperwork, but remember it well, I can always remember being in tears reading them.

                definitely not allowed Di, i know someone who was "caught out" like this, wrote that a woman sounded like a gasping fish and referred to her as "gasping fish". She was sacked and a very great amount of compo was paid, incidently another operative who had also added something on the file but not "gasping fish", was disciplined cos he never dobbed in his colleague, go girl

                      I agree with all the comments above, this is absolutely disgraceful behaviour and I agree with niddy in that you need expert advice on how to go with this to not only ensure that is is handled in the right manner but also to maximise any compo due.

                        Thank you all so much.

                        This came to mind when a friend made a complaint to a business over the last week, I told her to fight for more because they offered her £500, they are now considering this, it seems unsulting/personal comments were found on her SAR, so folks go through yours with a tooth-comb as well, I just wanted your opinions on some of the comments made on mine, yet there is more, cheers all.

                          definitely make a complaint about this as this "data" isn't relevant to anything on their systems.

                          Understandable if it was your work and was detailing for an absence i.e. reasoning behind but only then could it say along lines of "Absence to look after son who suffers from Autism"

                          Data held should always be minimal and relevant to the Data Processors needs.

                              I recall a case some years ago in Manchester, where a raddled and most unattractive whore had been arrested for plying her trade on or around Minshull Street. On the paperwork, in the place for job/profession, the arresting officer had simply written "UGLY".

                              I am unsure whether or not she received any compensation, but the charges were dropped and she received an apology from the Chief Constable and a bouquet of flowers.
