information regarding an admission form for a CCJ

    I haven't been on here for afew weeks but it seems busier than ever with all the new posts hope niddy is getting his rest in and enjoys his holiday :-)

    I'm sorry if this isn't the correct forum for this post but i did look and couldn't decide which one it should be.
    Its also late and i'm ready for my bed lol

    Further to my posts regarding my friend she's now recieved a CCJ form from northampton
    she knew it was coming and she's accepted that this is the best way to go for her. She's accepted the amount that the bank has said she owes and we've filled in part of the form this morning. Most of the information was straight forward. But when it came to debts i couldn't help her with the information thats required on the form.
    Her situation is that she's on a payment plan for 4 credit card accounts ranging from 50-75 pounds for each account.

    I assume these payment plans will be extended but she hasn't had confirmation of this but her sitiuation isn't going to change in the near future.

    On the form it requests credit debts does she put the amount that she's paying on the payment plan and Will the fact that she's paying more for her payment plans than the offer she's going to make on the CCJ will the bank expect her to pay more for the CCJ and this then affects her other payments ? I'm not sure which has greater significance i assume its the CCJ. The debt on each card varies but the CCJ is the larger of the credit card accounts owed.

    hopefully i've made sense it is late. She's coming over again on friday to fill out the rest of the form.

      If the CCJ is the largest debt, by rights they should get the higher proportion of funds. I cannot see why she allowed a CCJ to proceed being she is on a payment plan with the others - she should have considered making payments to the CCJ account to avoid such from happening......

      Personally, I think she's went about things the wrong way - however, not much we can do about that really. Seems she knew what she wanted.. Ok, to answer your question, she needs to list all her debts - as for the outgoings, the Judge will pick up on this and may enquire as to why she is paying more than any CCJ offer. She needs to work out a proper repayment schedule and offer each credit an appropriate amount based on the level of debt vs level of income, although it would make sense to pay more into the CCJ. If the Judge sets payment levels too high then she needs to apply for a redetermination.

      To make things easier, she ought to lower the other repayments and increase this CCJ debt. To do it equally read the attached guide.

        thanks niddy i don't think she's ever sat down and looked at her debts in total she's older than me But i'll do my best on friday for he.r the booklet does help so thank you. When she does get in touch with the other banks does she tell them she has a CCJ thats why she has to lower her repayments this i assume may lead others to think they might as well CCJ her also ?

          I'd suggest she speaks to CCCS or certainly, at least speak to Citizens Advice.

            she's of an older generation niddy which isn't any reason not to get help but she i dont think she would do this if she knew i was going into so much detail online she wouldn't be pleased but i only know bits from the forums like this so i can only help so much.

            One other question but i know your probably at work etc but if anyone else could advise before friday when she puts down income she gets a joint pension with her husband her husband knows all about this but is older than her. but the debts are only in her name does she split the pension they recieve down the middle or is it better to include everything to save complications. they don't spend too much they don't go out the money they do get is just divided between the debts.

            ps are you going anywhere nice on your holidays ? my husband and i are going to spain in a month or so can't wait to get away from this dreary weather lol

              His income is separate from hers as the debt is sole to her; however as a married couple isn't income classed as a family or "household" income in such a respect?

              I guess some people still live frugally and also within their own means, ie keep their own salary etc so I see no reason why they couldn't say they have separate accounting....? Whether the Judge (if it got that far) would see it the same, who knows?

              We're off to Caribbean - can't wait. Hope you guys have a good time away - deserve it

                  I've updated my own situation and thought i'd let everyone know what happend with my friend. She posted the CCJ admission form last friday first class recorded delivery delivered monday. She phoned wesnesday to confirm that they have recieved the letter and they had. They then went on to tell her that they had accepted the amount and the first payment will be 25th march but the first payment is higher than the agreed amount by over a third. the reason being to make things add up over 60 months. They asked for her direct debit details which she gave them. Now i assumed if you get a court judgement saying you pay x amount it should be that they can't alter that ?

                  My own opinion on this is that she should have waited until recieveing some information from the court rather than just accepting what they say ? or is this being too harsh. I thought the Judge decided upon the date the first payment was made or are they just relaying his/her verdict to her ? will she actually get any information from the court ?

                  edit. this has made her see sense and she's contacting all her creditors and asking for reduced payments until she can organise her finances better. I'm encouraging her to go to CAB or at least talk to someone from the CCCS.
