    Hi everyone
    Some advice would be appreciated!

    Just an update:
    Type of account: Goldfish Barclaycard
    Date Comnenced: Many years ago when was just Goldfish
    Approx Balance: £11,600 at start now £12,600 after interest and charges
    Date last Paid: August 2010
    Arrangement: Not pay
    Status: Default
    Owner: Now Credit Solutions (see below)

    History:
    CCA request 8/11/10 no reply
    Letter from Mercers Nov 2010 - sent response as per Niddy's link above on 3/12/10
    Letter from Calders 11/2/11 - sent same letter 18/2/11
    Letter from Credit Solutions 28/4/11- sent same letter 3/5/11

    However, I have today received a letter from Power2Contact telling me they have been instructed to make a home visit and giving me the times they may come but no date. They are based at the same address as Credit Solutions Ltd. I have 72 hours to respond to Credit Solutions - their 'instructing agents.'

    I have done a bit of research and they seem to be very aggressive and some people have had visits so I would like to respond as forceably as possible as I don't want them to even attempt a call. Obviously, I need to send one of the Threat of Home Visit letters, but I am not sure which is best.

    Thanks for your reply. I have only sent one CCA request and that was to Barclays but have had no response. I was going to send your CCA reminder letter to them, but should I now, as per your message, not correspond with Barclays now that it has gone to Mercers?

    The letter from Mercers said they were acting as agents for Barclaycard so does that mean they now own the debt or not?

    Hiya what second letter are you thinking of sending barclays? Who actually owns the debt, is it Barclays or is it Mercers? If you have sent a CCA Request to EITHER of them and they've not responded then it is unenforceable and stays that way until they do furnish you with the paperwork.

    Please don't jump the gun or rush things, just ask away on here and we'll get back to you!

    Niddy, I held off sending the Mercers letter until the CCA time was up. Needless to say that have not sent anything nor, according to the post office (as at today), have accepted delivery of my letter.

My thoughts were that they could deny that one letter didn’t reach them, but two?

    Anyway, in the meantime I have had a letter from Mercers on 12 November saying that the debt had been passed on to them, asking for payment of arrears etc.

    Could you please advise how I should respond to them? As they have now taken over the debt do I send them the CCA request or tell them that I have made it already to BG?

    Regards to Goldfish - ignore this for the time being, you need to give them time to respond...... so no action necessary right now.

    Thanks for the info re: these services. I didn't know about the silent call one, going to check that out now.

    I'm registered with TPS and it works brilliantly with unsolicited calls eg for double glazing but doesn't stop calls from lenders/dcas.

    there is a Law for 'Silent Callers' ie; this would also include where they Automate call your phone, till you answer it sits silent before it kicks in at there end this is still silent call as you are not talking to anyone (frequent calls, if you know who they are and keeps record of the number called)....

    where you can register the callers number (and its FREE), Don't know if this works on mobile phones though.... Silent Call is a FREE Registry 12 mths then you re-register the your number again (Don't know if it works on Mobiles though)

    Luckily, Barclaycard don't have my landline number, only my mobile, so I can see who is calling me and ignore them.

    I'm about 6 months in with Barclaycard for a Goldfish account and it's just been passed on to the 3rd DCA.

    My phone took a battering so I bought a device to block them out, if you don't mind changing your number then that would be an easier option, Barclaycard have an automated telephone centre so they ring you so many times everyday and it isn't until someone picks up that they will connect you with one of their telephone monkeys, it's why sometimes you pick up and there isn't anyone on the other end.

    Just follow NID's advice and you will get through it, they like to shout the loudest but so far they've had little to back it up.

    Hi and welcome FB.

    Barclaycard are a pain in the bum for bombarding with phone calls, I was getting up to 20 a day at one point!

    They have 12+2 days to respond to your cca request and it took Barclaycard over a week to send me my 'cca' so I wouldn't be sending another letter just yet. I've had responses from lenders when the Royal Mail tracking was still saying 'being processed'. While all cases are different and you can't make comparisons, have a look at some of the UE diaries to gain an insight into the process. It's easy to be impatient at the start of the process but, as a lot of us have come to realise, there's not usually any need to rush.

    With regards to Mercers, they are still part of Barclays and, coincidentally, I had a letter from them just after I had sent the cca request.
