  • Arden/Mint and Barclays loan

    Hi everyone, I'm new to this site but registered after googling Arden to find out if other people had been having trouble with them, and to share my story and what I'm doing.

    I had an arrangement with them (originally Mint loans) to make affordable repayments of £40 per month for 6 months. As soon as six months passed, I was contacted by phone demanding a review of my circumstances to see if the payments could be increased. I said everything was the same and I would continue to make the payments as before, and send out an updated (but very similar) income/expenditure statement because I didnt have all those details in my head, naturally.

    From then on every day for about 10 days I got inundated wit phone calls asking for the same information, an average of 10 calls per day. I kept saying the information had been posted, but the calls still came. One staff member asked for a £10 'Holding Fee' which would stop the calls for a time, until my information was processed, and stupidly I paid this fee. I was told later this would not stop the calls.

    Eventually the calls did stop, but only after telling them I was going to report them to the police for harrassment. I complained to Arden in writing about my treatment, and the holding fee - and had no reply at all.

    After no reply to my written complaints after 8 weeks had passed, (and researching using internet!) I wrote to both the FSA and the OFT to complain about Arden. The FSA have just wrote back saying there is an approx. wait of 8 weeks till I hear from them again due to a large number of complaints. The office of fair trading do not investigate individual complaints, but do look into whether companies are fit an proper to hold a credit licence. So my complaint is now on their files and if there are several complaints they may investigate further.

    That's basically my story so far. I would urge others in the same boat as me to complain in writing and hopefully get this disgraceful company closed down.

      I am still paying them, was happy to pay what I could but the amount of harrassment I got off them just for a straightforward review of my finances was unbelievable. That stressed me out a great deal at a time when I can well do without it. At no time were my payments to them missing or late.

      Dont know what a CCA request is, will certainly look into it though - am happy for any advice. Would have preferred someone at Arden to actually be a normal, reasonable human being but since they've done what they have, I was determined to make official complaints.

      Not sure how effective the FSA and the OFT complaints will be, but the fact Arden didnt even respond to my initial complaint to them has certainly made me more determined to carry things through and any advice or support on here from people with similar experiences will be welcome!

        Not much sadly, as you're a consumer so you must use directgov, not OFT direct.... but if they do get enough complaints they can (and do) investigate so you done no harm, but I doubt they will act to be honest....

        I would look at the UE route, nothing to lose have you...?

          I'll certainly have a look at the unenforcable route and see what that's all about. I could certainly get used to causing them some grief if nothing else, they've caused me enough.

                thanks

                It was a mint loan
                date took out approx 2006
                balance outstanding approx. £5000
                have been paying reduced payment, but last full payment sometime in 2009
                current arrangement, paying £40 per month
                in default
                Arden own the account, correspondence comes from them.

                I have a larger loan debt with Barclays, which am paying off £80 per month.

                  Am liking the sound of this! So if either was to be unenforceable, do the creditors simply give in and write the debt off after one or two letters?

                  Hadn't heard of the unenforceable thing before, but the way they've reacted in my case, or if you're a couple of days late with a payment, it's hard to believe they would cave in.

                  But as long as its all done in writing I'll be fine, just dont want visits to the house or to have to go to court if I up the ante this way.

                    When was your Barclays Loan taken out ?

                        ps mint loans from 06 are usually enforceable so don't get your hopes up but for £1 gotta be worth a try.....

                          Thanks for the tips. Letters wouldn't bother me, my only concern would be lots of phone calls or visits to the house, just because I live with my parents and have kept the extent of my financial problems from them.

                          Anyway first things first, think the first job tomorrow is getting a couple of £1 postal orders then taking it from there

                            Dont worry about the calls or the threats of visits, there are letters here you can send to put a stop to that straight away.

                            The first thing you should do, is stop all communication with them by telephone, from now on you want everything in writing, that way, they cant say anything they like, and it doesnt make you feel threatened or presured in to agreeing a payment you cant afford.

                            If they continue to ring, you can tell them that you wish everything to be in writing and if they continue to ring you will report them for harasment.

                            Once the letter tennis starts, and you threaten to report them if it doesnt, they will give up with the calls.

                            As for visiting, they have no legal right to visit you without prior appointment, and since we do not wish to make an appointment with these muppets, they cant come round. or at least, if they threaten to, again there are letters you can send to put a stop to that also.

                              An update for you. Sent off the CCA request and the postal order to Arden credit management, 10 days have passed with no response.

                              I have also had my complaint form and documents returned from the Financial Ombudsman Service saying I need to wait 8 weeks for a response from Arden to my complaint. However, the initial compliant in writing was made to Arden on 10th May (and I put this on the FoS form) so more than 8 weeks have gone by with no response.

                              So have emailed the FoS asking if they have made a mistake with this, with a view to returning the documents back to them to investigate the complaint properly.
