  • is it to late

    had current account with abbey in 1992 run it well until 2001 got into difficulties, the account was closed2004 by abbey and my debt of £2800 passed to dca, and has been to several, have been paying nominal amounts since 2005,tried many times to get statements of the account, finally sent sar request 2011 to bank and received mainly statements no letters or anything, no requests for over draughts no default notices.last week started to look at the statements and realized that this £2800 is the result of charges then interest added , duplicate payments being all resulting in me running this debt up,

    is it to late to challenge the bank over their mistakes and charges????

    Its never too late, just work out from the SAR the level of charges and do a reclaim - Di30 is our specialist on reclaims

                Do you know if your account has been assigned to the Debt collections agency?
                Is it the one the business use, or had it been totally sold to the DCA?

                Now if you have arrears, and the account is still with the business who set up the account, they can try clawing back the charges to reduce the arrears.

                If the account has been fully assigned (sold) to a DCA then you could have the right to receive the refund (directly to be paid to you).

                I note this is an account with the bank, do you know if you were sold any packaged accounts with them, like where you pay for example £15 to £25 a month?
                They usually offer travel insurance, mobile insurance, breakdown, some contents insurance, etc, but were they at all beneficial to you?

                If they sold you a packaged account which was worthless to you, maybe you already had car breakdown in place etc.
                You can also try making a complaint about this and ask for refund of the monthly charges for the account.
                Even if some products did cover you and other's didnt, the FSA say you have a right to make a reclaim.

                Now in regards of charges itself, and in hardship, as soon as you know from details from the Subject Access Request (SAR) we can check for excessive charges and try to make a reclaim on them, and if in hardship as well I believe you are entitled to do this.

                  ...........what I would do is write directly to the bank, head office or complaints dept, and make them aware of your hardship difficulties, and you wish to make a reclaim on all the overcharges and you are requesting they refund this directly to you, in order for you to sort out your own financial affairs.
                  I would also state that the excessive charges have not helped your financial situation and have only made your financial situation a lot worse, if this wasnt the case then maybe you would not be in this position now.

                  As I mentioned about about another claim, via current account, being sold a package that was worthless to you, I would keep that separate from the charges reclaim.

                        Di30 the account is with a DCA and I pay a small amount each month the debt would take several lifetimes to pay off, This was an account with Abbey, the charges are for un paid dd, and unpaid cheque charges,cleard transactions,£1500 in duplicated payments, payments with no recipient interest etc are these sort of things that can be claimed or not??

                            Yes to what I know you can claim the above, and do so now as well under the hardship criteria.

                            I am normally more used to the PPI reclaiming than the banking charges etc, but I am aware that many have made reclaims for what's stated.
