No idea what to do with this company / debt

  • No idea what to do with this company / debt

    Hi All,

    First time poster here so I hope someone can help.

    A few years ago I had a credit card with citibank. There were a few issues, the call centre were useless and I ended up writing them a letter to complain, asking for a refund of charges and to ONLY contact me via writing.

    This was way back in 2007.

    I heard nothing until a few weeks ago when a company called Tempus got in touch to say that I owe 6k. This is treble the original balance I last recall having with citibank.

    Everyday now for the last 2 weeks I've been getting 2 - 3 phone calls a day. Never a voicemail left.

    What the best way forward with this problem. I've no idea how they managed to add 4k on to the original amount. I've not been in touch with the debtors at all for fear of saying / doing the wrong thing.

    Any advice is appreciated !!

    Hi Closing and welcome to AAD

    Just a bit more info needed so you can get better help...
    When did you actually take out the card?
    Date of last actual payment?
    Who actually owns this debt now...have Citi sold it on, and did you get a notice of assignment?

    First things first though, and don't ever speak to them on the phone about this, keep everything in writing from now on.

    Have Tempus actually contacted you in writing, or is it just the calls at the moment?
    If so what exactly did they say?

      When was the last time you payed or acknowledge the debt ?

        Thanks for the prompt reply.

        I'm going through a metric tonne of paperwork right now to see what I can find out.

        When did I take out the card.... Pass
        Actual last payment.... Pass

        Apologies its not CitiBank it's barclay card. Citi are another major issue ive going on.

        From what paperwork I have.

        Aktiv capital were assigned the debt. This was then passed over to Tempus who have now passed it back to Activ.

        I've not been in touch with them at all. Should I use the prove is debt letter or some form of communication as their last letter stated..

        Through the information we have gained, we are now recommending to our client that your account be passed to External Field Agents. They will attend your home at an agreed time, to assess your assets and where you live, to gain a better understanding of your circumstances.

        Tempus solutions are the hole third party to be able to offer you Aktiv Kapitals incentive programme 'New Deal" so you wont get the same great benefits and rewards with External Field Agents.....

        Time is running out if we don't hear from you in 14 days your account will be passed back to Aktic Kapital who will instruct their External Field Agents to contact you.

          OK. Did you take out the cards before or after April 2007?

            Hi All,

            Thanks for bearing with me. I'm stressed out, not thinking clearly, rushing etc which I know is a PITA for those helping.

            Ok I've found out the following.

            The debt with Citicard was for approx 2k at the time of defaulting over
            Account issued 27th September 2007
            Last Payment made 28th July 2008 (so far at the time of checking a shedload of statements.


            Like I say a letter was sent disputing charges and fees and asking that all correspondence be done in writing. As far as I recall, statement stopped and then nothing for a good long while.

              perhaps the account was sold whislt in dispute? sounds about right to me, someone else with better knowledge will comment, but sounds to me like a simple account sold whilst in dispute letter.

              Whatever happens, i wouldnt pay a penny at the moment.

                It's fine Closing, don't stress

                Shame it's post April 2007.
                See what others say, but I would think a Subject Access Request to Citibank might be the way forward here, to find out when and why your balance ballooned and form a basis for reclaiming.
                Also-Any payment protection on this account?

                  I think that SX guy might be onto something here. Its possible the account was sold whilst in dispute.

                  There was payment protection on this account however my ex employer refused to acknowledge anything to do with me what so ever. So I'm thinking that's where it all went south.

                  (sighs as I knew this would get complicated)

                  Should I go with the debt sold whilst in dispute or Subject Access Request?

                    I would ignore them right now, or at the worst send the "prove it" template - right now you're less than 2 years away from SB so why risk bringing it back to life?

                    I would simply send this, do not edit it as it covers you within limitation act (1980) ---> Our Templates | Harassment & Intimidation Templates | You know nothing of the Debt / Prove It

                      I'm not sure how I can ignore it as I'm getting letters saying that "External Field Agents" are going to be in touch to arrange an appointment.

                      You're right I don't want to bring it back to life so I'm treading carefully. I did order a statutory credit report which I since learned might be a mistake as pretty much all other credit reference agencies and collection agencies, can see that I ordered it and my particulars.

                      If I go down the route of Prove the debt is that the safest option?

                      (as I type this my phone rings for the 2nd time from 0800 328 0708 lol)

                        Ok, well send the prove it letter asap - and regards phone calls, sit it out for now - lets see what that letter does.

                        Field agents, if anyone knocks at your door just tell em to piss-off and shut the door in their face. They have NO legal rights, remember that

                          Who do I send this to? It was passed to Tempus who have passed it back to Aktiv capital so would I be right in thinking of sending to Aktiv?

                              The letter is on it's way to them now to ask them to prove it.

                              Today I received my statutory credit report. I can't see anywhere on there where It mentions citibank or any debt of that amount. Also, am I right in thinking, that this shows me ANYONE who's done a credit check or report on me? I.e If a company is chasing me and have done an investigation on me I should see that right?
