  • This may make you laugh!!!

    One of my friends at work is having problems with LLoyds TSB at the moment over a old loan. They didn't have the paperwork so , I suggested that they did a SAR to hopefully get copies and to also see what LLoyds had been upto internally.

    The SAR's pack came though after more than 40 days of course!!!! but as is normal in these things a load of paperwork was either missing or redacted.

    The funny thing is though, when my mate checked they credit record at the weekend suddenly 2 defaults had a appeared, so he rang up the bank asking what the f**K was going on, only to be told by the senior commercial manager that they where there because he had applied to the "SAR" orginisation for the data and thats what happens

    Bring back the days when bank managers had a brain and actually could understand and manage things

    As a lifetime bank manager and friend of my elder brother said he is glad to be out of it in retirement, I quote:-

      Shocking, requesting a SAR does not constitute sharing of data, however it may have triggered the old missing defaults to be placed back on view as such.

      In future don't tell people to get a SAR if they're not paying the debt and/or there is nothing on their credit record as this does happen a lot so best to avoid it by being not so open, and transparent

        Dont worry Niddy, there was already some adverse on the credit record and my mate wanted to get a clear understanding for what the bank had paperwork wise.

        As I said the funny bit to me was the SAR causing the defaults to happen, that was the managers only reason for them being there, he couldn't tie them to an account or facility

          How strange, they have to be tied to an account, can you clarify were these old defaults being re-added or like brand new ones with a date of like 2011?

            LLoyds really have got themselves in a bind, they have lost agreements, keep rolling over arrangements in joint names even though he is now divorced, applied defaults while he still has open bank, loan and OD's. They really don't have a clue what they are doing. This is why he did the SAR to try and piece together a paper trail becuase LLoyds dont seem to know!!!

            I must admit it's the first time I've come across a person that has both a default and a operating account with loans and OD's with the same bank!!!

              No, impossible - they must default within 6 months of first missed payment..... I would await copies then let me see, or i'll give you my number and call me....

                Presumably brand new as in "not seen before"?

                He needs to look at the actual default date. Not the "last updated" date, or the last time a D or 8 was recorded in the monthly status codes.

                If they have been stupid enough to add brand new recently dated defaults then that would be a gross breach of the DPA and ICO guidelines on several levels.

                    The 6 month thing is recent, its also not legislation, it is OFT Guidance mate

                      It's a bit of a wishy washy requirement under some circumstances.

                            If there are no time limits at all, why would a crditor ever issue a DN then unless it is to terminate and take an alleged debtor to court?
