    I've just received this, I do owe SpeedCredit, but they went into administration so hence this has been passed on. My loan amount was for £350. And nowhere near the £4k they want. What do I do, a CCA request? This debt will be from late 2012 or early 2013. More than likely 2012.

    This isnt on my CR & I've never made a payment.

    If I do a CCA request will that not stir the hornets nest or?

    That's ridiculous for a £350 loan! As they say, it has incurred extra charges...and a hell of a lot of interest no doubt!

    As this is regarding a payday loan you may be better posting it in the payday loan section or I can move your post if you want me to.

    I don't know enough about payday loans but I don't think a cca request would be any use because the loan is post 2007.

                Sorry didn't see this.

                So this demand was sent via email? Then they have no idea that the email address is valid, nor do they know that the email address is being read.

                Have you received anything in writing (i.e. in the post, not via email) from this shower? Has your address changed since the inception of the alleged loan?

                Demanding £4k for a £350 loan is frankly preposterous and could be challenged as an unfair relationship if (in the very unlikely event things got to court).

                Is it worth sending a CCA request? At the moment no, because if they've not written via snailmail (not email), then I wouldn't be responding to ANYTHING they send via email.

                However there is value sending a CCA request or a SAR at the correct time because:

                1) It could establish whether they followed the correct procedure in sending pre-contract information so you could decide whether the product was affordable etc (if not then another possible example of irresponsible lending

                2) It would establish whether a debt purchasor has the legal entitlement to carry on adding interest & charges

                3) It would establish whether a creditor could apply for contractual interest up to, and post judgement, should they issue a claim

                All important stuff to consider to help advise you.

                However - in this instance, I'd not respond to the email as it would only encourage them, and wait for them to write via the post.

                  That's fine, I figured you were busy.

                  Yeah this was sent via email, and my address hasn't changed either. So I'll await a letter through the post, which I doubt they'd do. SpeedyCredit is now in admin so all debts have been passed along, this was passed to NDR at one stage, which I made a few payments however they did say that if I stopped making payments then they'd continue to add charges and interest from the day of the first payment upto the last, so any money I would have paid would have been lost. Which would have been about £150ish. Unfortunately Natwest closed that account in error and so I can't get bank statements showing this.

                    If your address hasn't changed, then wait for a letter in the post. With Speedycredit in admin, then if they do write to you, a simple 'prove it' letter should be enough, then if necessary a CCA request or SAR to follow up.

                    I certainly wouldn't be acknowledging anything on a £4k balance on a £350 loan!

                    See what happens, I suspect that the email is just a fishing exercise sent to hundreds of accounts to see who bites

                          Everyone apart from Barclaycard has gone quiet atm. CCA request and SAR has been sent and they're sending it soon. So let's hope they dont comply and it becomes UE.

                              I cant remember to be honest, I wasn't very good at keeping paper trails. I believe so, but I haven't ever received a Notice of Assignment.
