    Hi there, I have been lurking for a while now. I really didn't want to step in at such a traumatic time for NID and his family. It was good for me though because it made me realise my recent unemployment and debt wasn't such a big an issue as I first thought. Family,friends their health and well-being are so much more important.(and our own of course)
    I am so glad DD is on the road to recovery.
    NID I am in awe of you! Even with me just lurking,you have been an inspiration to me.
    So I am no longer lurking, here I am.

    for a few years now I have been paying off my debts via Consumer Credit Counselling Service. I managed to repay several and was left with just two:-
    MBNA £4600 taken out May 2000
    Lloyds TSB £7500 taken out ? 2001

    I recently became unemployed so contacted Consumer Credit Counselling Service re going down the avenue of bankruptcy.They told me about DRO but went on to say that they didn't think I should do either.They hinted at just not paying and sit back and see what happens.
    Thats when I started broswing the internet,petrified that both companies were going to lock me away for a long time.(mind you after some of their phone calls,being locked away from them would have been a blessed relief TeeHee)
    I came accross the other site (whisper) but I was reluctant to post there seems to be quite a few moral preachers. I was frightened enough so I wasn't going to put myself in the firing line. Then OH MY GOD! I found the link to here.
    This site has made me so much more positive about the future. Just sharing the knowledge you all have was wonderful.
    I now realise that I am not going to be sent to the tower for eternity for my debt. That there's light at the end of the tunnel no matter what the situation is with debt.
    So whilst I was lurking I took advise and sent cca requests off.
    I got back a copy of an application form from MBNA and a letter from Lloyds TSB
    If anyone gets the chance could you please advise what to do next.
    If they are enforceable or unenforceable.
    To date neither has been defaulted MBNA just has Delinquent on my credit file.TeeHee I'm sure that implies youth, TSB status as normal.Which I find pretty amazing since I have been paying them of through Consumer Credit Counselling Service for 5years now.
    I hope I have managed to upload the letters properly.
    I thank you all for the help and time you have already have given to so many.
    I Thank you for the time given to read my diary and advice and support I know you will offer.
    No more lurking for me.

    You've messed this right up... can you edit your post and only include the most recent questions you have - you've done a screen print of info which ruins the post

      From memory you sent something to lloyds right? What about MBNA?

        Hi there,
        yes after you took a look at them for me and deemed them unenforceable I sent Lloyds(26th july 2010) the lloyds for your perusal letter.........You start by saying because you sent a a copy of "reconstituted agreement etc etc. on the 2nd Aug I then received a letter thanking me for my complaint.On the 3rd of Aug I received a final response letter telling me that they are unable to locate my original agreement so therefore cannot provide me with it. then go on to tell me that I have used the card and they are confident that the agreement is valid and enforceable.
        i have not responed to this letter and to date have only received statements from them.
        On my most recent statement in small print it tells me that my account is in serious arrears and so they have instructed a debt collection agency,MHA Collections. It doesn't say what they have instructed them to do lol. but that if I am unable to make the payment on the statement then I am to phone them(MHA). I have of course not responded.

        MBNA I sent the CCA query as advised on the 26th july 2010. I recieved a letter dated 6th Aug asking me to make a payment otherwise they make take action.
        I didn't respond.
        Yesterday I received a letter from Optima Legal notifying me that they have been instructed by MBNA to commence legal action against me etc etc.

        Several months ago I would have needed incontinent aids after opening such mail. Because of you Nid and your helpers, I kinda smiled and thought, if you can get blood from a stone then try it. lol.

        I love the new site but as with all new things it takes time to get used to so I am sorry for messing up and adding to the work load.
        I look forward to advise as to what to do next.

                Hi Niddy, Niddy helpers and fellow site users,
                I couple of days ago Lloyds TSB sent me a letter saying they have now found my CCA. So they have sent me a copy.
                This is of course the second one as they previously sent one which Niddy deemed UE.
                I have sent you a copy of the letter Nid along with the agreement they sent to me.
                Hey! check out page 5 because it is nowt to do with me.
                Yes this was included in my envelope from them and it is someone else's agreement.What a Clanger!
                Both agreements are numbered at the top and mine is the next number in line.
                I am sure it says at the top of the other persons agreement Lucky and that's underlined, then it says, accept £1000- I can't help but think the other guy is going for a F&F settlement and they thing they are lucky.That speaks volumes to me.
                Nid I would appreciate it if you could have a look at the letter and agreement that I have PM'd you and if you could let me know what to do next I would be grateful.
                Niddy, please don't go without sleep to check this out.I can wait ,as can they(lloyds TSB).
                Yes there is light at the end of the tunnel and Niddy,you are clearly holding the lamp for so many of us to follow.
                I guess that you get alot out of doing what you do but be careful you don't wear your batteries out.
                I reckon with your sense of humour I am gonna regret saying that!TeeHee!

                  Ok, seen email - funnily enough in one breath they confirm they previously wrote to you confirming they couldn't find your agreement but now they have pleasure in enclosing, Mr xxxxx's agreement ;LOL ;LOL ;LOL

                  Ermmm, ok! Regards to what they have sent, purporting to be your agreement, it is nothing more than a signed signature acceptance form, no prescribed terms - nothing!

                    Hi All :hello , doesn't time fly when you don't worry about your debt on a daily basis.
                    Thanks to Niddy I am getting on with life for the first time in a good few years. For the advise nd guidence from niddy, I could him.
                    Well of course I have heard fro Lloyds TSB and MBNA.I have had the usual monthly statements and the odd letter telling me they will give me one last chance or THEY MAY TAKE ACTION ...........
                    After several phone calls to my sisters home(MBNA) whom has the same initial as me and lives local to me,asking for me(they said they got the number from 118 because I wasn't answering my phone) and numourous calls to my home from different mobile numbers they were using,I contacted BT. I explained to them what was happening and they changed my number fre of charge.
                    Yippe! Peace! not quite on earth but definately on the phone.
                    There letters ahve been to ask me to contact thenm to arrangelower monthly payments ( Err I am currently paying nowt,can you get any lower?) or to arrange a final settlement.
                    I of course have not been in touch with them.
                    Not sending myself into an early grave worrying about the debt as yes at the start of this journey I did eat ,sleep and live the debt,well not much sleep.
                    Niddy has enabled me to get on with my life. I have found work after just 6 months and I am looking forward to 2011. Thank You so much.
                    I know the journey isny over and I expect a backlash any day now but I know I now have the mind set to deal with it.
                    Keep up the good work Niddy and helpers and the rest of you stay strong as there is light at the end of the tunnel.

                        Excellent to hear you're doing well again - lets hope 2011 is a good year for you - like it will be for most the users on here! Saying that it won't be good for me when they all fly the nest though - Niddy will be sad :cry

                        Keep us updated, and don't worry - whatever you do, it's just not worth it - always remember in the back of your mind, they have absolutely no powers! :what

                            I am just "dandy" thanks to you.
                            I am glad to see you are taking breaks from the site. We wouldn't want you to burn out and go.

                            I have had the odd (odd as in few lol) letter from Lloyds TSB and MBNA and their choice of debt collection companies asking for payment. I have of course ignored the requests.
                            I however,recently sent them both the final response letters. It seems they just pass the account back to a previous or a new collection agency.
                            So i will continue with sending out the same letters to whoever.

                            When I started walking this road I was absolutely petrified. Within weeks I gained an inner strength and that was thanks to your reassurance. It gave me a whole new outlook on life.
                            I regularly read the new members posts and some exsisting/old posts from members and the stress some people put themselves through is immense. I totally understand how they are feeling as I felt that too.
                            Its all down to lack of understanding and thats where you come in.
                            Charlie is chuckling.......and I am sure the nhs has saved a fortune because of you. No more visits to the doctor,no more anti-depressants.
                            And of course you have saved me a fortune.
                            I have said before that I understand that you enjoy doing what you do. What ever your reasons(I believe I grasp most of them TeeHee) it still takes a very special person to dedicate so much of your time to this site and helping others.
                            Thanks again Niddy and you have a bloody good holiday.
                            I know at some point in the future I will be calling upon your wisdom to help me walk further down that road so you take care and stay well cus we can't do it without you!
                            Its a good job I don't contact you often cus I don,t half rabbit when I start Lol.
