    I am having a wee fight with some DCA's - long story, but basically they are pissing me off so I am fighting back myself now. As you can see, it only takes a simple email for compliance from the Head Of - however, it shouldn't have even gone that far!

    Niddy vs 1st Credit - email complaint sent last Week....

    reply today:
    Dear Mr Niddy,

    Re: XXXXXX/XXXXXX

    Thank you for your recent e.mails.

    I note your e.mail of the 19th August copied in Mr Najib Nathoo. Please be advised that he left the company in February 2011.

    I note the comments in your e.mail and you are of course fully entitled to your opinion.

    We thank you for the most helpful documentation you have attached. We have of course removed your address from our records and do of course apologise for any inconvenience caused.

    Reminds me of the one I got from Sara de Tute, Vice President of the CSA and compliance director at Wescot.

    A very 'grudging' apology I must say.

      Yea, thats how the email above came across to me - i.e. almost as though he's being clever in his reply by suggesting I have an opinion, I did remind him that I don't form opinion, I stick to law and fact - lets see his response to that!

      Thanks for your email. I also copied in every other investor and high level exec at your firm - I am aware that Najib left but as an original shareholder I thought it pertinent to copy him in, as I did with the other execs as well (i.e. Eddie Nott to name one).

      Thanks for confirming removal of my details, however I also want you to remove any link that you have created between myself and the incorrect link of xxxxxxxxxxxxx. If you have not created one but searched between both addresses then you need to send a letter to the CRA's informing them you are also happy I am not the same person.

      I am sick of this, nothing about this person is mine and the hassle it causes is unreal. Please also write to me at the address provided, confirming you have removed our address from your records as per the other proof I sent in to you.

      As for your 'clever' comment about my being entitled to an opinion, sorry I think you mean I highlighted a few facts? I do not operate on opinion, I stick with facts and you'd do well to remember that. I am not your average Joe Public, that much is a certainty and the fact you have missed most of my points about the incorrect link leads me to think you seriously don't care about your CCL at all. I also told you that I expected you to consider compensation for your illegal practices, yet I note you ignored this and never attached a copy of your complaints process to this email.

      I suggest you go away, have a re-think and come back to me. Pointless issuing you a deadline as you ignore those, so suffice to say if I do not hear from you within the next 7 days then you can read all about this on our busy internet forum here: allaboutFORUMS afterwhich you'll hear from my solicitor directly.

        anyone notice his obvious mistake in the initial email yet? Its not the 19th of August yet.....

          yup i noticed (the 19th, i've had letters addressed to me with a dear Mrs xxxx, even though the letter at the top had Mr X XXXXX 2 complete names let alone title) that, but thought that was with reference to a last year e-mail that you sent to Mr Najib Nathoo, and it was them just getting back in touch!! lol

            Thank you for your e.mail.

            I detail below the actions we have taken;
            1) We have removed your address from our records.
            2) We did not create a link so there is no link to remove. We solely used data provided to us by Call Credit. They state that you would need to contact them directly, (Mr M Ward, Head of Consumer Relations, Call Credit, 1 Park Lane, Leeds, LS3 1EP).
            3) A letter will be sent to your home address.
            4) A copy of our ‘complaints process’ has been despatched to you by post.
            We do of course greatly sympathise with the inconvenience caused to you by the incorrect data held by various credit bureaux.

            Hmmm, so I fired this back at him:

            Thanks for your email - can you please confirm then that Call Credit have created a link? I do not use them as nobody considers them a real CRA - however I will issue a SAR if you can confirm that they have a link? if not, as I suspect is the case, then I only want to know how my address was ever brought into the equation?

            Both Equifax & Experian have no record of any such link, thus are you saying whilst searching Niddy @ the address that is not mine, there was a link to my correct address or are you saying that you searched me at my correct address and got a link to the incorrect one?

            Please clarify.

                ... plainly has the implied meaning that the addressee's opinion is somehow defective.
