    As Requested by Niddy ive made a thread here from my other thread here: In a pickle with NatWest - allaboutFORUMS


    I had a loan out in 2005 i think it was for £2,000 then every year or so i would extend the loan (stupidly i might add, me being young and having a decent job and my now ex partner demanding things i couldn't buy on my monthly salary but could afford the loan repayments), my current loan which i have detailed in the other thread is my current loan which was 15K and the agreement made in 2008 (or so it says on online banking)

    Im not quite sure about exact details as i don't have any details/docs from the bank (Natwest) so not sure how to go on with this

    Di30 is best to help with this but to start with you need a SAR so get the ball rolling and send the bespoke SAR below to the bank - it is person specific, not account, so it should provide everything and all previous dealings with the bank however try and provide all 3 loan account numbers if you can, you'll get it from old statements and if you can't then just use the current loan account number.

    * you need a tenner to send with the SAR mind you (via cheque/postal order)...

    Subject Access Request - S.7 Data Protection Act 1998

    Please supply me with a copy of all information your company hold on me including a list of accounts and details of payments along with copies of statements.

    Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, I hereby request that you supply me with any and all historical data in your possession which relates to me and am entitled to under section 7(1) of the Act. If you store any of the older records on microfiche, please be aware that the Information Commissioner deems this to be a relevant filing system under the Act. As such, any microfiche data must be sent to me in fully legible and comprehensible form.

    Additionally, where there has been any event in my account history over this period which has required manual intervention by any member of your staff, or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention, or other evidence of that manual intervention in relation to my business with you. If you are unable to supply this data because there has been no such manual intervention, then please be so kind as to confirm this in your response.

    For the avoidance of any and all doubt, I reiterate:

    I hereby request that you supply me with any and all historical data in your possession which, in any way appertains to me, including (but not exhaustively) a copy of the original signed executed agreement; statements of account; duplicate statements and/or print outs of all account transactions; all internal and external correspondence sent or received by you including memo’s, logs, notes, screen prints and transcripts; notes of manual interventions such as telephone attendants' notes, copies of stored telephone conversations, internal and external emails; any other information held on all types of media in any relevant filing system (microfiche included). If you have disclosed any information to a third party (with or without my express permission), will you please include details of this in your reply, along with notes of any legal action passed or pending (to include a true copy of default notices, court orders and the like).

    Where any information that you provide includes any charges, for example returned payments, late payment fees, and so forth, would you please advise your breakdown of actual costs (liquidated damages) incurred for each charge, and the Term or Condition on which you rely upon to claim such a charge. I also require that you forward a true copy of the Terms and Conditions that were in force at the time my account was opened, and any subsequent amendments to those Terms and Conditions.

    I have a personal loan account which has been upgraded/increased near enough year on year and the previous loans contained PPI repayment cover. Please ensure you attach with your response details of all previous loans throughout the group, and do not just rely on the current loan as there was PPI on the previous loans, i.e. the one that started in 2005 at £2000. I have also moved addresses a bit so to help locate my account history my previous addresses as as follows;
    1. Address 1
    2. Address 2
    3. Address 3
    4. Current Address

    I enclose the statutory maximum fee of £10.00 to access ALL data held by you about myself. You should be fully aware of your statutory obligations under the Data Protection Act and that any failure to comply with this request will involve a complaint to the ICO as well as potential legal action.

    You have 40 days in which to comply with this request and note that this request has been sent Recorded Delivery so I can ensure compliance on these issues comply within the legislative time frames.

        If you know the details and account numbers you could actually use their own form and not bother sending a SAR in... up to you really?

                    sorry if its a daft question, also the loans have been taken out at different addresses, would that change what i put in the letter

                      Yea you'd add a section - I will edit the main letter - so go back and check it in 5 mins....

                          Cheers Niddy, will get it sent off tomorrow at the post office and see what doc's i get back, i had a look at my online banking but couldn't see any referance to account numbers, just monies in and out, and before i put 5k in to lower the repayments in, in sep 2011 i was paying 280 and change in, and half of that was interest.... quite shocked, all that interest for something on a bank database, something which isn't physical

                              Hi there

                              I agree a SAR would be the first way forward, especially if you've no paperwork, as details of all loans, credit cards and everything you taken out with them should be enclosed.
                              If you banked with them, you can use your bank account number and the SAR will cover for all products you taken out with them, and all for just the one payment fee of £10 cheque or postal order etc....

                              When ready, to make a complaint, you can do so by letter or the complaint questionnaire issued by the Financial ombudsman Service (FOS) this appears to be the most used now, the complaint form, but your choice.

                              I do however, have a template letter here:

                              But I would tweak it to make it more your own, and if you were mis sold on all for the same mis selling reasons, you can use the same letter for all, but remember to enclose all loan account numbers.

                              If different mis selling reasons, use separate letters for each.

                              When you taken out one to pay the other, the full amount with PPI would have been carried over, (if no gap in the loans), they may have reduced the balance with the PPI as well to bring the balance down when taking out another loan, although you would not have seen the amount, they usually use it as a rebate, this may not apply to all though.
                              Which again is why it's good to SAR

                              Always keep copies of what you send and receive for future reference, for example if you need to complain to the FOS later on, hopefully it will not go that far.
                              And we suggest to post by using signed for recorded delivery for your proof of posting.

                              On the FOS website you will note they have issued PPI complaint forms for customers to use to complaint to banks etc, and they also have their own complaint form for eg, if you need to complain to them, so make sure you click on the correct link to the relevant complaint form.

                              Make sure you complete the form in the box (for the form to complain to the bank)
                              You can do so by word or PDF.

                              The one's shown above the box is the form - if you need to complain direct to the FOS later on.

                              Do ask for further help if required, once your PPI comes back and if you need help with that as well.
