  • HSBC - unfair handling

    Basically, my mothers HSBC account has been sold to Metropolitan collection services.

    bit of history.

    Had an arrangement to pay £10 per month, i wrote to them after 6 months offering to increase to £50 per month, received a default notice inbetween increasing the offer.

    They replied to my letter stating they needed a signature (i know!)

    So replied with original letter but included a digital signature.

    received a letter today (28th march) dated 22nd march saying that as the default had not been corrected the account has been passed to a debt collection agency called Metropolitan collection services.

    Are they an in-house DCA?

    Im guessing handling of collection has not been passed in absolute as i have nothing to say its a NoA.

    Can they still use ROSO?

    EDIT: just done some research, they are an in-house agency, but according to others, seem to be quite fair in accepting low payments, so perhaps i will wait this one out.

    I do want to try UE but my mother is not in a position currently to stop using HSBC hense the ROSO comment.

    If and when i receive a NOA i will go down the UE route.

    Metropolitan is HSBC! In the same building as collection (Leicester).....

      Metropolitan collection services. are part of HSBC..

        thanks guys, yeah i just did some research and noticed.

        I will play the long game with these i think as my mothers not in a position to avoid using HSBC but we will keep the account below £500 incase of ROSO.

        Soon as she gets a NoA in absolute ill go down the UE route.

                Question time...

                1. Type of account
                2. Balance of account
                3. Default date
                4. Date you received the DN
                5. Have you missed payments
                6. What makes you think they'll utilise RoSO if you're paying into it

                Basically, I suggest you just carry on paying what you previously paid and thus things will carry on as before. The DN is normal based on the fact the account was not run as per the agreement, so the default will remain.

                  Mate, after i posted, i went away and thought about this one, and realise im being an idiot.

                  Your right NoA means nothing, i may as well go for it with this one anyway regardless.

                  I think maybe some of the dates mentioned previously with this were incorrect and ive gone away and checked each letter now.

                  The credit card is over 30 years old from the days of Midland bank probably.


                  1. Type of account: HSBC Credit Card (gold i think)
                  2. Balance of account: 10k
                  3. Default date: around 19th January 2012
                  4. Date you received the DN: around 20th January 2012 (received 2 final demands after, 20th feb 28th feb)
                  5. Have you missed payments: No
                  6. What makes you think they'll utilise RoSO if you're paying into it: Cos of ignorance on my part to be honest, i thought if the amount being paid was less than min they could use RoSO once defaulted.

                    Hiya

                    Now you've told me what the account etc is I will revoke my last post and say stop paying and CCA them - BUT make sure there is a parachute account first as they will try RoSO on a £10k balance......

                    Thing is this will 100% be UE ONLY if it was taken after 1974!

                      It will Def be after 1974.

                      Ill make sure she has another account with another bank set up and sorted. in the meantime ill do a CCA request.

                        Nice one - if she holds a high balance maybe consider getting the new account BEFORE you CCA as this will ring alarm bells mate.

                        Oh before I forget, there should be no record of this on her credit file either as old midland agreements were verbally agreed with the manager where you signed a simple "request form" which did not contain any PT's and best of all it never authorised the bank to share data (it was pre DPA as well remember).....

                          Nice one! were taking a trip down town friday to sort out a new account somewhere so ill hold off the CCA request until thats all done.
