    Ho Ho Ho all

    Thanks again for comments on previous posts

    It's just that and u can imagine after coming clean with family and friends

    About my own personal financial circumstances (already known)

    Every now and then a friend / family member asks if a can help ,

    Which I always recommend / refer to this site as its been so helpful.

    However a very close family member as explained her situation, which I feel needs

    Expert advise - the problem is she ;-

    Lost in court 6w ago with a cc debt with costs awarded but as heard
    Anything from anyone ie county court or claimant

    So Wot can she do next ???

    And can she still make a full & final settlement ???

    Hi wotsitallabout,

    If she has lost in the county court then she will have to conform to the order that the court placed upon her, in principle. I think we would need some more information about the issues and the case before making too much comment.

      Also the ccj will remain (albeit settled) for 6yrs if not paid within 28 days of judgment
      I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website.           Thanks for replies

          Her story reads

          Appointed a sols after ref by friend, Paid them 800 to help
          had a Good case (Wot they all says ain't it)

          Went to court July , adjourned for judgement
          Which was heard in Oct, lost to lloyds with costs awarded

          Appeal granted but not 100% sure (very scared at time)

          Sols explained would cost her more money which
          She never had , so it seems they hv gone cold no further contact since
          (surprise surprise)

          I've told her to contact court , who explained to her its
          Not the norm coz she's sols Rep but would send her
          Paperwork out to her case given sols position (await thoose details)

          Any further advise pls ???

            I'd like to know why she lost, but it does look like her lawyer had been misinformed by her or had given rather poor advice as to her case.

              Sols felt default wasn't good enough , and judge did

              Wot do u mean by sols bad advise ???

              Plus isn't it just best to accept decision move on
              Given she hasn't got funds to carry on plus my opnion
              Is I think she had enough too stressful

                Hi

                She recieved order from court today stating

                She needs to pay cc o/s balance + interest on it + their
                Court costs approx 20k

                Problem is letter says it had to be paid over a month ago
                So Wot happens now ??????

                Should she contact creditors ????

                Can she make a monthly payment offer or a lump sum ??
                (How much do u think on both is acceptable) ???

                Or contact court and explain her situation ,

                She really scared now coz its a month late and scared
                Baliffs will be knocking soon

                Urgent advise needed from all pls

                  First off matey, is to get back in touch with the solicitors who she instructed to handle the case and GET SOME ANSWERS!! They ususally react pretty quick when threatened with a formal complaint to the SRA and the Legal Ombudsman Service.

                  This has been disgracefully handled by them but you will have to proceded via their in house formal complaints procedure first. If you ring ther legal ombudsman they will issue you with a case reference number ( a bit like a crime number LOL) and tell the practice this and they will realise you are serious.

                    Explained to family member yr first step,
                    Which she will consider

                    For now however she spoke straight to the creditors
                    Because she's worried about the delay and potential
                    Baliffs , no other advise given on site which is a shame

                    They accepted a monthly payplan - for now

                    Which seems to have calmed her down,

                      Hi watsitallabout - seriously there's no issue. I'll wipe the last few posts and lets actually go back to the point in hand here and try and help you fix the issue.

                      There's definitely no issue, I just felt aggrieved at a reply and got defensive as I would do if anyone tried to poach my moderators or our site users. If someone comes now and suggested you leave here for X forum I'd pretty much tell them to get lost - I'm just very passionate as you'll appreciate if indeed you've followed our progress.

                      I'm sorry if I caused offence, as I say it wasn't intended.

                      I'll wipe the last few posts in the coming hours and pm you this message in case you miss it and wonder what's happened.

                        Family issue resolved with a monthly payment plan

                        Though I did suggest to her to strike while the iron is hot for a f & f settlement figure

                        She owes 20k, I was thinking of offering 3-5

                          As they have judgment they'll reject. You'll be looking at £15k in a lump sum to get rid but there's no need as the ccj will stay for 6yrs now so may as well pay monthly for the same 6yrs!!
