Hi have been told that will get some good advice on here for my sister. She took out various payday loans last year and never paid them. She has been living with friends so has had no hassle but she is due to move in with partner and of course will have bills etc sent there so new address will go on record and they will find out where she is living even though only partners name is on tenancy he can't prove that what is in house belongs to him should baliff's come round and also its not a good life to lead being scared all the time. What is the best thing that she could do as there is no way can afford to pay them, she doesn't want to contact them and is not in employment at the moment.

DCAs are not bailiffs...they have no right to enter your home and take anything.
The only problem she might have is with the council debt (is it for council tax?) as they can use court-appointed bailiffs but she can make an offer of payment for that.Let your smile change the world but don't let the world change your smile

Hi again you must think Im a right one. I thought I would post on here as you said one my other post that there was a person on here that knows all about payday loans and thought would be quicker to post than read through all other posts.

Let me just adress a couple of points in your first post:
1. (again) DCAs are not bailiffs and cannot come into your home and take things away. I have quite a lot of debt and loads of threats of DCAs coming round. I've only had one visit and he left as soon as I told him to...no hassle or anything.
2. You stop being scared when you start fighting back. DCAs rely on people being scared by their threats written in big red letters. Just post any letters on here and we'll help you (your sister) with the correct reply.Let your smile change the world but don't let the world change your smile

What address did your sister use when she applied for the loans? Was she employed at the time she applied for the loans?
Putting the council tax aside, I'll explain how PDL companies operate. They may sell the account to a debt collection agency (DCA), who may find out where she lives once her address is updated with the credit reference agencies.
So you can see there are lots of ifs and maybes but if you can find out more about how she applied for the loans and who with that would be a good start.
But right now - your sister should NOT contact them as it'll only open a can of worms."I fear all we have done is to awaken a sleeping giant and fill him with a terrible resolve."

Hi sorry it's been manic here with kids. She applied for the loans at a house she was renting a room from and at the time was in employment but then left there and job.
the loans were applied for online and they were from Cash Gennie, MEM consumer finance, Wonga, CFO lending, Quickbridge x3 so not sure if they are DCA, Mr Lender but some of the names on the credit report are portfolio recovery ass which we think is what wonga has been sold onto.
These were all taken out in 2013. Also some of them say settled or satisfied and they have never been paid so these also must of been passed to debt collection agencys.

There is also the very small chance that a creditor may issue a court claim to that old address, and obtain a default by judgement, but PDL companies issuing claims is very rare as they don't want to be challenged in court.
I would suggest she not open pandoras box at the moment by contacting them, and stay under the radar and wait for them to contact her, it carries the above risk, but you have to weigh that up.
If she calls them, then she effectively acknowledges the debt and resets the statute barred clock (6 years), after which they cannot enforce the debts.
Her Council Tax arrears are the priority at the moment, so I'll get the thread split, and a new thread set up to deal specifically with that. If any of the payday loan companies track her down then we can deal with things at that point.
