Hello everyone! What a fantastic forum you have here!
So here's my story. I'll try and keep it short and simple.
I have two credit card debts totalling around £12000. One with MBNA for £4k, the rest with Barclays. Until the start of this year, I was in a DMP with StepChange, but fell out with them when they tried to add one of my partners debts, which she is servicing to my plan, as I am a guarantor.
I contacted both MBNA and Barclays, and explained that I would like to deal with them both directly, and offered to pay them £200/mth each until the debts were cleared. Both were happy with this, until 3 months later, I get a statement from Barclays showing they've put the interest rate back up to 23% and have taken £148 of the last £200 payment as interest.
I phone them up to find out what's going on and why they're not honouring the agreement, and basically get told tough s__t, that's what we're doing. I went on moneysavingexpert for some advice and someone suggested checking the CCA. So I did.
The credit card was originally an Egg card dating back I'm sure to around 2004/05 before being bought by Barclays in 2010. I've asked them for the CCA, and have been sent an undated document with no signatures. It was Googling what to do next that bought up this lovely forum, so here I am. Ready to go.
Ironically, it's all Barclays own fault. If they'd just kept to the agreement I'd be paying them, but I refuse to pay their punitive interest rates and am quite happy to see this through, as I strongly suspect they have an improperly executed agreement here.
They won't be happy of course, but I refuse to take lectures on ethics from Barclays of all banks...

if you read a couple of diary's of people that deal with Barclays (berzeklys) you may find they seem to be a law unto themselves, one hand doesn't know what the other 3 are doingI'm an official AAD Moderator and also a volunteer, here to help make the forum run smoothly. Barclays sell the debt to DCA1, probably at a small loss. DCA1 starts the harassment campaign. Harassment campaign unsuccessful, so DCA1 sells the debt on, again at a loss, where it's bought by DCA2.
DCA2 begins harassment campaign. Campaign unsuccessful, debt gets sold on, again, at a loss, where it's bought by DCA3, who begin.... And on, and on, and on.
Presumably this goes on until the debt is being bought for pennies in the pound, with each DCA trying their hardest, but having to stay within the law. No sign it seems of burly men turning up in the dead of night threatening broken legs - as far as I can see anyway!
That's why the DCA names keep changing and the process keeps starting over every few months. I guess the trick is to keep records of everything, and hold your nerve!!

I am now saving the money each month that was making little difference to the balance and not a bit of difference to my credit file as a result of finding AAD.

some of mine have been sold and then passed to the same debt collector twice, if I'm not going to pay them the first time why do they think I'll pay the second time.
I've even had them tell me that their legal team have sent me the required documents, but can't tell me what they sent coz they don't keep a record of what doc's are sent,??I'm an official AAD Moderator and also a volunteer, here to help make the forum run smoothly.
