  • MBNA - I WON CASE DISMISSED

    Great news today.. MBNA left with their tail between their legs. Case dismissed.

    It took three hearings and ended up with a 2 hour narrative Judgement.

    I could not have done it without all the help given here on this site.

    Thankyou to everyone who had input and encouragement. In Particular Niddy and ATW

          Thanks Guys.... hungover but feeling relieved ..that is victory over LLoyds and MBNA in the last two months.

          Thanks again for all input whether technical or encouragement. I have learned an awful lot in the last 6 months.. mostly I am as thick as siht XX

                        The case was won on the grounds of estoppel right? So its unlikely any other agreement from the same period will be able to use the same argument since its not specific to what was supplied but what was agreed.

                            an Estoppel is an agreement between two parties, like a contract. Jack had an agreement which he had proof of, that himself and MBNA agreed to a repayment plan. The account was defaulted and terminated during this time, and the judge agreed that as it was an agreement to pay a sum between two parties, they were wrong to terminate.

                            I don't think the judge rulled on anything bad in terms of the original agreement, but I could be wrong, will wait to see the judges summary.
