Received CCA from Santander, in the cover letter they refer to it as Client Credit Agreement. Font is tiny and hard to read, will scan it and email to Niddy.

I'm a newbie too, only joined a week or so ago but already feel so much better. They're lovely on here. Very supportive and give good advice. Make sure you have a read of the diaries as it really put my mind at rest.

I have to assume right now your credit file is intact - then why are you doing this?

I am asking cos you only stopped paying last month, is this really wise being the small amounts involved? You will ruin your credit rating if you proceed with UE. Its less than £5k in total, surely things aren't that bad that means you need to do this?

Its enforceable in any case as there are all the prescribed terms attached to the signature page! It may well be a recon though, as it does look rushed, to say the least! Is it your handwriting/signature?

yes that is my handwriting/ sig unfortunately
Thanks for taking a look, unfortunately my circumstances have changed for the worse recently and my other half has accounts which we are having to deal with as well. I will have a look at reclaim on the PPI, as this would make a big hole in this balance.

Regards OH, it may be an idea to do another diary for him, a few members have done this by creating another username (and another email address) then do two diaries or merge them like the "dopeys" or the "scarednshaking" diaires...?

Regards to that enforceable one above, do you want to blag it - being you cannot afford repayments? If so then send this off and see what happens, it buys you time which is the main thing here...

Received response 15/3/2011 from Opus.

Covering letter reads. Further to your request for a copy of your credit card agreement xxxxxxxxxxxx, we enclose a true copy of your agreement with CCAM.

The true copy includes:
1. A copy of the original T/C of your agreement, including the original interest rates, applicable at the time of your application.
The copy agreement does not include the signature box, signature or date of signature as in accordance with Regulation 3(2) (b) (ii) of Consumer Credit ( Cancellation Notices and Copies of Documents) Regulations 1983; we are not required to provide them.

At the end of the letter they say " We have satisfied our obligation under section 78 of CCA. We will not be entering into any further correspondence with you regarding the requirements relating to the provision of a copy agreement"

What they have actually sent is an 11 page computer recon of the original Citifinancial agreement, and a 5 page recon of an agreement with Opus ( Which I have never seen or signed ).
Oh and a complete response to someone elses CCA request

I think I should send a Terms and Conditions sent/ missing prescribed terms template, disputing existence of original agreements ?
