    Hello Niddy

    So here i my first steps in trying to sort my gf's debt issues out. She has no financial acumen and her ex husband abused that situation leaving her broke and almost homeless. I intend to with this sites help, restore her faith in the male race!!

      Hello carlsberg, and welcome to the forum. I am sorry to hear of your girlfriends plight; lets hope that together we can ease her burden.

      Please remember that NID and the site moderators give their time to help others on a voluntary basis, in their own time, and around their home lives and jobs. It is not always possible to respond to an enquiry immediately, but please rest assured that your query will be given attention asap.

      Niddy does scan through all of the queries (there are usually hundreds to look through on this and other threads) and will deal with anything requiring urgent, immediate attention. Checking over any paperwork takes time, so please bear this is mind.

      Back to your query, please do scan the documentation provided by Barclaycard, and email it direct to Niddy. The subject title of your email should be your username, together with the name of the creditor ie. Barclaycard, and he will get back to you as soon as is possible.

        Thank you so much for yr reply. didnt mean to appear rude at all and i apologise if it read like that. I fully understand that NID and mods are very busy. I just thought someone might guide me as to whether i should wait for an invitation to post or just go straight ahead and copy the documentation. I will do as instructed and i really do appreciate any help any one can give.

          Ok please email me the stuff received, and please bear with me - as I always say to people, if I am not around just sit tight as i always browse things but those I dont reply should consider them not being urgent.....

          This was not, in my opinion, of an urgent nature thus i never responded as quickly as I usually do, because I knew i'd not pick up any emails until today so had I replied and said go ahead and email me, then you'd be wondering why I never replied right? lol

            Ok regards to Barclays, they have written and confirmed that they cannot find the agreement and as such they realise they cannot obtain judgment - well done, that's it - done and dusted as far as you're concerned. Basically, ignore them from here-on-in. Obviously as and when you receive any correspondence, give me a shout and email me whatever they send.

            Basically, as they have confirmed they have not got the agreement they cannot take any formal action, yes they can ask you to pay (and hassle you) but that is all - they cannot obtain any judgment against you. Therefore you need to learn to live with this for a year or two til things die down, after 6yrs from date of default registration the entry will vanish totally.

            As to the payment holiday premium - other than saying WTF!! ;EEK I honestly think you're wasting your time arguing this, basically as it is UE you should not make any payments to the account again meaning to you, it won't matter if the balance is £1 or £10k - you aint paying are you? ;N

            So, although she'll have a default registered - that is her lot, nothing else can happen.

              Niddy what can i say but whooooooooooooo hoooooooo.

              Some good news at last. :UE

              Right I can move onto the next two debts with a degree of optimism.

              I will start new threads in the diary section and I will post em to you when I can.

              I've got to open a new bank account first for her as the debt is with her existing bank.

              As regards being hassled, Fredrickson International (impressive title), ring every day 3-4 times a day!!

              I think that debt is statue barred but I need to confirm this (presumably by doing a credit check?)

                Hi carlsberg - great news indeed !!!

                When you wish to add new debts, just keep them within this thread, and add a new post. It keeps things all together, and makes things easier for you/us to find.

                Good luck with the rest of the creditors - hope you get good news from them too.

                    I have just received a reply from HSBC. 3 weeks after the CCA request. I will copy and send to NID, stating that they don't need to provide an exact copy of the agreement but a varied one is sufficient as they claim they have the power to vary the agreement at any time. They also claim they can by law omit the signature box and signature.

                    They have also enclosed a photocopied agreement form with my partners old address handwritten by someone at HSBC after the form had been copied!! that does not include signatures or dates, sums involved, interest rates. They also enclosed cc terms and conditions and a generic changes to terms agreement.

                    So it would seem they don't have an original copy or in fact anything much.

                    What is the next step. I wish to put this account in dispute, can i do this and which letter do I need to send?

                        By the way, there was no notice of variation within what they sent so it remains unenforceable - i'd not worry about this, you can see they are clutching at straws based on what they sent you - or never sent you, as the case is lol....

                        Just send the letter as above - then update us to any replies.

                          Hi folks

                          Reference the HSBC debt described above. We have received a default notice from the bank. We also keep receiving statements with interest added.
                          Do I ignore or do i need to stop them adding interest to the account. I sent a notice previously as advised stating as they failed to comply with my CCA request they could not keep requesting payments. Am i right?

                            Hello again guys.

                            As well as the HSBC debt, my GF is having hassle from Barclaycard. They have started to ring her at work demanding payment. Are they allowed to do this? She is also still receiving statements adding interest account. Do I need to anything more or do I just ignore?

                              There will be someone more experienced along soon, but I think the short answer is that they will probably keep requesting payments even if they haven't complied with the CCA request. I'm not sure what the position is re interest.

                              As regards Barclaycard hassling by telephone, there is a template letter for that. http://forums.all-about-debt.co.uk/s...94&postcount=3.

                              There may be somethign else you should send, I'd wait for Niddy just in case! But just to reassure you that there are template letters that will help you.
