    Hi people,

    this is my first post on here after joining last night and after reading through a few posts this place seems like a breath of fresh air after spending a couple of years posting on CAG. I've not been posting much there lately as the only impression I get from people, mainly mods, is that the unenforceable route (and the DN route, and every route!!) is dead in the water now after recent court cases like McGuffick and Carey. From reading the threads here, it doesn't seem to be the case?
    I have a few? credit cards, some with BC, some with MBNA; I've only had a mixture of T&Cs and Application forms and I've even had letters from the OC stating they havent got the agreement and cant enforce, but when sold on the DCA is ignoring that and stating that now its enforceable!

    So, all in all, I suppose I don't need to ask, but I'm right in saying that unenforceablity is not ''dead in the water''?

    Hi Seamus, and welcome to AAD!!!

    Hundreds of people on this forum would agree that it is not "dead in the water".

    Please take a read here: http://forums.all-about-debt.co.uk/showthread.php?t=5 and then start yourself a diary with the required information.

    Update each creditor with what stage you are at, so that as and when you receive correspondence, we can give you a nudge in the right direction as to how you might respond.

    Congratulations on finding us; we'll all be here to support and assist.

    (oh, and the letter from the creditor stating they haven't got the agreement - keep it safe - you may well need it!!!)

      The CAG is a little pro bank/dca right now - they've lost our respect and we keep getting their decent posters here so to be fair, it's win win for us..... them, well what they do is their prerogative. main thing is you've found the only forum in the world that exclusively deal with UE issues and proactively help you to beat the banks - for free.

      As diddly pointed out, start yourself a diary and we'll come by and offer help, support and guidance where necessary...

      In the meantime, anyone hassles you on a debt where you have a lenders confirmation that they do not have an agreement - you respond with this: ---> CCA Query - Letter Previously Confirming No CCA

        Welcome to our band on AAD! Have a read around. Shout up with anything you need and help will be along. No matter trivial you fell it is, ask and we will try to find an answer tailored to your need.

        There is no abuse of other posters allowed here so there are no worries for you in that direction.

              If unenforceability is dead, then Stevie wonder can see, pigs can fly and my willy is ten feet long!!!

              Sadly the arguments utilised on the GAG are dead, but things evolve, if you look at the cases which have been fought and won, many are in our case law library, you will see that UE is not dead, its very much alive.

                That did make me chuckle, went on there and seen in a payday loan hell thread, an advert for wonga - I kinda pissed myself a wee bit (as you do).....

                              Many thanks for the welcome guys, after only 1 day I've decided this place is fan-bloody-tastic!
                              I've a day off tomorrow, so I'm going to get my files out (I've made a separate file for each card and kept everything they've sent me including envelopes) and make up this diary.
                              One small worry I have. By making a diary showing each card, with details of amount owed, etc., will DCA's be able to work out who I am (I'm guessing they've found this place and done a bit of snooping)?
