assigned to link financial not paying at the mo. all quiet so far
Letter from link 13/ 05/ 16/ dated 10/05/16.we have received confirmation you elected advisor is no longer dealing with financial matters on your behalf. please contact our offices etc.to discuss future repayments on the above mentioned account. alternatively complete and return the personal budget plan on reverse of this letter indicating you offer of repayment and preferred due date. do we send for the credit agreement now? or wait for the next contact? Still all quiet on this one. only ever had the one letter from them? so whats best here people? sit tight or send off the cca? any advise would be appreciated thanks

letter received 10/05/16. saying not received payment from debt settlement company. £1 needs to be paid now.if not heard from settlement company or myself will contact me directly. think i will just wait on the contact? letter from cap one saying fredrickson international ltd is to act on there behalf. and all payments and contact has to be with them they will be in touch shortly OR phone them on blah blah.letter dated 09 aug 2016. well was off on holiday for two weeks and this was on the mat when i got back 14/08/2016. will just wait on fredrickson and ask them via the letters for the credit agreement. was going to send to cap one but they beat me to it sort of speak.will post fredricksons letter when it arrives letter from fredrickson dated 17th came 20th. contact us to arrange payment asap. to avoid further letters. etc etc.sent off cca request 25/8/16 letter from freds today 06/09/2016. posted 05/09/2016. returning my £1 payment regarding your recent cca request.a letter detailing this will be sent under seperate cover. i suppose the letter will be to advise they are handing it back to cap one? wait and see wot it is letter dated 5th sept received 8th. we have referred this matter to our client but returned your one pound fee which you should receive shortly. as our client does not require a £1fee for documentation we will revert to you in due course. got this letter after i got the £1 fee. ps i thought they all required the £1fee? so just wait on freds getting back now

Start a new post for each debt as Elsa explained in her post # 2

start an unenforceability diary, listing details about each debt in the following format:

• Type of account (credit card/loan)
• Date commenced (ideally before Apr 2007)
• Approx balance
• Date last paid (approximate date you last made a FULL payment)
• Are you on arrangement or not paying
• Status (default/in arrears/up-to-date)
• Account owner (who is writing to you, a DCA or the lender)

Once you've done that you will feel more organised and in control

Remember, you must send a s.78 request for a CCA - a SAR only includes statements and screen prints / copies of letters etc.

Assuming all these accounts were taken out prior to April 2007, if it was me I would establish whether they're enforceable or not before paying anything else to them.
The best way forward, so we know exactly what you're situation is, is to start an unenforceability diary, listing details about each debt in the following format:

• Type of account (credit card/loan)
• Date commenced (ideally before Apr 2007)
• Approx balance
• Date last paid (approximate date you last made a FULL payment)
• Are you on arrangement or not paying
• Status (default/in arrears/up-to-date)
• Account owner (who is writing to you, a DCA or the lender)

Once you've done that you will feel more organised and in control, then send out CCA Requests to each one.

so when the letters drop on the doorstep. should i attempt to set up a payment plan. or should i just ask for documentation etc. any help or advise on a strategy would be much appreciated. thanks in advance.
