    Hi all, very new member and hopfully I will receive some sound advice along the way, here goes,

    I owe 10 creditors a grand total of £20,000, this dates back from spending starting over ten years ago when i started my apprenticeship and spent more than i could pay back at the time on the "good will" of the companies i now owe on my good wage when i completed my apprenticeship. (hope that makes some sense)

    Until now i have never come across unenforcibility however i dont believe that i will probably be able to use that route. I have come to the conclusion that i want to be debt free within roughly two years, by this i have broken down my ins and outs and worked out that i can afford to pay £700 a month to my debts. (This i may add has only happened in the last month, until now i have never really got a frip of whats going on and had my head in the sand.)

    my biggest problem at the moment is a payday lender who wants the grand total of £1824.00 and doesnt seem to want to except my proposed offer of £67.56. I am dealing with them by email and am bouncing messages back and forth of which they just seem to refuse this amount. The interest is frozen however i have now made no payments to them for 4 months while this email tennis has been played out. I'm worried that the fact i have not paid them will not be doing me any favours in case this ever went to a court. I have told them that i will only pay them by cheque or bank transfer and they also refuse to give out banking details. They keep threatning to send my debt to a third party debt collector, of which i have urged them to carry out this threat so i can at least start paying off this debt.

    To help us, to help you, please provide the following information for each account:

    • Type of account (credit card/loan)

    • Date commenced (ideally before Apr 2007)

    • Approx balance

    • Date last paid (approximate date you last made a FULL payment)

    • Are you on arrangement or not paying

    • Status (default/in arrears/up-to-date)

    • Account owner (who is writing to you, a DCA or the lender)

        I have only just caught up with the other posts while i have been writing the last message, didnt realise all data was one post per debt, will go again but above you get the jist,

        Flower power, sorry i cant quite work out how to quote,
        the reason i havent looked at UE is as i know the debts are mine, so i thought that if there yours you must pay back what you have spent?

        i have been paying everyone as i believed they would take me to court, kick down my front door and take what i have, also i have associated 700 to debts but am currently paying £400 a month to firstchoice for a holiday next year, I cant see a court saying, soo you can go on holiday but you say you cant afford your debts! and thats why i keep the creditors sweet to keep them from taking even more off me leaving me with bugger all. Im on a fairly good wage and the creditors are not aware of this so i have kept them from prying.

        to put it simply, i have had my head in the sand hoping all this would go away, that didnt work, so turned to a debt management company and had my pants pulled down for over a year as i paid 480 a month with only 400 pound paying debts, so i though i know i will take it in to my own hands, here we are.

          I have tried reading the UE section and without a bit of time on my hands and racking my brain i dont really get it! but none the less what i have picked up is, if the paperwork is not apporpiate then this may not stand in court.
          If it doesnt stand in court what happens to the debt? just written off?
          what about my credit history, i would actually like to obtain a mortgage in the future as at present we only rely on my wifes wage and this will not get us what we want and can afford if it wasnt for the poor choices in the past and poor credit report.

          so your advice at present is, keep paying them something, ask for the cca and wait to see what comes back.
